1969.01.18_TC_Minutes MINUTES: WORKSHOP MEETING OF TOWN•EOMMTSSION January 18 , 1969 . A workshop meeting was held at the Town Hall on January 18, 1969 at 9:40 A. M. All Commissioners were present. Also present were Messers Poulton, Ve~i~er, Kamerer, and Kemery and Mrs. Betty Roth. Mayor Horton stated that a citizens committee has been formed to im- prove zoning and to prevent construction of a projected marina. Mr. Kamerer has been selected to head this committee. Mayor Horton read a registered letter from this committee announcing its opposition to any and all business in the Town and objecting to issuance of any permit for business construction. Mrs. Noble brought up a point that set backs are not clear and the width of Russell Rd. is in question. Also the center line is in doubt. Commissioner Hackman made a motion to table the issuance of of any permit for a marina and it was sec- onded by Mrs. Noble.Unanimously approved by the Commission. Mr. Kamerer requested copies of all zoning ordinances and amendments thereto. He was told there are no copies to give ?out but that they are available for reading at the Town Hall. Commissioner Hackman questioned about the expense involved in prevent- ing violations of deed restrictions and was assured by the Mayor that the town is to incur none~nd is not directly concerned with the deeds -----~-----~ themselves. Mr. Poulton o a question from the Mayor stated that when property is purchased the new owner has no right to assume that zoning '~`-"°"~" will not be changed. Mr. Kemery said he had heard that deed restrictions • were not valid after twenty years. Mr. Poulton stated that they do not terminate until such time as all property owners involved agree to a deed restriction change. Commissioner Hackman read a letter requesting paving and water to be supplied on Russell Rd. It was agreed that the Town will do this and that the property owners are to be assessed for the expense. Chapter 170 of tha Florida Statutes contains legal procedure of advertising said assessment. Mr. Poulton said that the paving of Russell Rd. should be determined by a written resolution of the Council.. Commissioner Hackman said `that the engineers employed by the Town have not cooperated with Permutit Corp. The latter has fulfilled its contract and the outstanding $6,000.00 owed to them should be paid by the Town. He stated that any further changes in the Water Plant may be made on Monday after a meeting with Mr. Finn of the Permutit Co. Mayor Horton asked Mr. Poulton to draft an Ordinance changing all zoning on the West side of AlA to R4A. Mr. Poulton stated that there is .some possibility that it would not be effective on the supposition that no action would be taken. Mayor Horton stated that immediately North of the Town Hall the property was willed to the Diocese of Florida for a Roman Catholic Church. The house is now being used as a Parish House and he questioned whether it could be a violation of zoning which iS presently R4A. The Council was . of the general opinion that since no outside alterations would be in- volved, it could not now be considered a violation. Discussion followed as to the number of parking spaces for the Church and requiring of two parking spaces in R4A districts to which Mr. Poulton answered would be discriminatory action. Mayor Horton suggested that the appearance of future construction should PAGE TWO • be considered in granting building permits. Mrs. Noble stated that the ,, zoning board has no power to determine the aesthetic appearance of a building and that the creation of a site appearance board would be ad- visable, headed by an architect or landscape gardner. Mr. Kemery added `,__,,._._...:.~~.-- that technical help on such a board is needed. Mr. Vetter suggested that a committee be appointed with authority to engage professional assistance. Mayor Horton asked Mr. Poulton to draft an ordinance setting up an appearance board. Vice-Mayor Noble read~a letter from the property owners in Bel Lido agreeing and approving zoning changes in Lot 22. Mayor Horton asked whether it has to be advertisedagain. Mr. Poulton stated in as much as it has been done once it is not necessary. The public meeting was held last month and it will come up for vote at next meeting. Commissioner Noble answered the question of establishing bulkhead lines speaking also for Mr. Crego, to the effect that they should be established regardless of exception existent. In the matter of insurance covering the Sherriff's Office relative to the Highland Beach Police force, Mr. Poulton stated that they cannot be deputized by the Sherriff but can be by the Town. Mr. Kemery asked if more than one man will ride in the Police car and Mr. McCook stated ""'""' that Mr. DiCampli does not plan on having more than one man per car. Mr. .Horton asked if $10,000.00 Insurance could be considered sufficient and was answered negatively by Mr. Poulton. • The meeting was adjourned at 11:30 A. M. ~~~~ ~~ ~~~ ~~ -~ ~~
