Highland Beach, Florida 33487 1. CALL TO ORDER Mayor Hillman called the meeting to order at 1:32 P.M. 2. PLEDGE OF ALLEGIANCE The Town Commission led the Pledge of Allegiance. 4. ADDITIONS, DELETIONS, AND APPROVAL OF THE AGENDA MOTION: Commissioner David moved to accept the agenda as presented. Commissioner Gossett-Seidman seconded the motion, which passed (5 to 0) unanimously. 5. PRESENTATIONS / PROCLAMATIONS A. Discussion on 2020 Revenue Sufficiency and Rate Study —Water and Wastewater Systems Mayor Hillman read the title into record. Mr. Robert Ori, Executive Vice President and Mr. Mark Tuma with Raftelis Financial Consultant, Inc, joined the meeting. Mr. Ori presented a comprehensive PowerPoint presentation on the 2020 Revenue Sufficiency and Rate Study - Water and Wastewater systems. Board Vacancies Board of Adjustment & Appeals Board - Two vacancies for a three-year term. Financial Advisory Board - One upcoming vacancy for a three-year term. B. Meetings and Events September 16, 2020 - 2:00 P.M. Virtual Code Enforcement Advisory Board Meeting September 22, 2020 - 5:01 P.M. Virtual Commission Special Second Public Hearing Budget Meeting September 23, 2020 -2:00 P.M. Virtual Natural Resources Preservation Advisory Board Meeting September 24, 2020 - 3:00 P.M. Virtual Financial Advisory Board Meeting October 06, 2020 9:30 A.M. Virtual Town Commission Meeting October 08, 2020 9:30 A.M. Virtual Planning Board Meeting C. Board Action Report 1. September 2020 Board Action Report Mayor Hillman presented this item and mentioned the recommendations made by the Planning Board at its September 15, 2020 as it relates to the town's rights-of-way. Town Manager Labadie explained that staff and the Town Attorney are working on the recommendations, will make the changes and bring it back to Town Commission at the October 6, 2020 meeting or thereafter. RESOLUTION NO. 20-018 / MERIT INCREASE POLICY FOR NON-UNION EMPLOYEES A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, ADOPTING A MERIT INCREASE POLICY FOR NON-UNION EMPLOYEES AND AMENDING THE TOWN OF HIGHLAND BEACH PERSONNEL RULES AND REGULATIONS ARTICLE XVIII EMPLOYEE DEVELOPMENT AND WELFARE ACTIVITIES, SECTION 6. EDUCATION INCENTIVE; AND PROVIDING AN EFFECTIVE DATE. Mayor Hillman read Resolution No. 20-018 into record. Town Manager Labadie explained the recommendations were to provide a four percent merit increase and education incentives for non-union employees. MOTION: Commissioner David moved to approve the Resolution No 20-018 as presented. Vice Mayor Babi[ seconded the motion, which passed (5 to 0) unanimously. 9. CONSENT AGENDA There was no Consent Agenda items. 10.UNFINISHED BUSINESS There was no Unfinished Business. 11.NEW BUSINESS A. Approval of Commission Meeting Minutes March 03, 2020 Regular Commission Meeting Minutes March 16, 2020 Emergency Commission Special Meeting Minutes March 24, 2020 Special Commission Meeting Minutes April 07, 2020 Regular Commission Meeting Minutes Mayor Hillman read the titles of Item 11A into the record. Town Commission agreed that the April 07, 2020 Regular Commission Meeting Minutes would be placed on the October 06, 2020 meeting agenda for approval. MOTION: Commissioner David moved to approve the March 03, 2020 Regular Commission Meeting Minutes, the March 16, 2020 Emergency Commission Special Meeting Minutes, and the March 24, 2020 Special Commission Meeting Minutes, as amended. Ratification of the Collective Bargaining Agreement between the Town of Highland Beach and Florida State Lodge Fraternal Order of Police Inc. related to the civilian agreement effective October 1, 2020 through September 30, 2023 Mayor Hillman read the title of Item 11B into record. Town Manager Labadie introduced ratification of the Collective bargaining agreement with the Florida State Lodge Fraternal Order of Police, Inc. MOTION: Commissioner Shoemaker moved to approve the Collective Bargaining Agreement between the Town of Highland Beach and Florida State Lodge Fraternal Order of Police Inc. effective October 1, 2020 through September 30, 2023. Commissioner David seconded the motion. Upon roll call the motion passed (5 to 0) unanimously. C. Ratification of the Collective Bargaining Agreement between the Town of Highland Beach and Palm Beach County Police Benevolent Association, Inc. related to the law enforcement agreement effective October 1, 2020 through September 30, 2023 Mayor Hillman read the title for Item 11C into record. Town Manager Labadie introduced ratification of the Collective bargaining agreement with the Palm Beach County Police Benevolent Association, Inc. MOTION: Commissioner Shoemaker moved to approve the Collective Bargaining Agreement between the Town of Highland Beach and Palm Beach County Police Benevolent Association, Inc. effective October 1, 2020 through September 30, 2023. Commissioner David seconded the motion. Upon roll call the motion passed (5 to 0) unanimously. D. Consideration of the Second Amendment to Town Manager Employment Agreement Between the Town of Highland Beach and Marshall Labadie. Mayor Hillman presented this item and commented that the sentence in the contract that reads "this first amendment," should read second. The Town Commission agreed that Section V1, Compensation effective October 1, 2020, that the employee's annual base salary shall be increased by five percent of the employee's annual base salary — should read no less than five percent. Based upon the research of different towns in the county, it was the consensus of the Town Commission to change the language of the contract to include a merit increase clause, based on performance, be between a minimum five and maximum ten percent each year. MOTION: Commissioner Shoemaker moved to approve item 11D as amended. Commissioner Gossett-Seidman seconded the motion. Upon roll call the motion passed (5 to 0) unanimously. Virtual Town Commission Meeting Minutes Date: September 15, 2020 Page 5 of 6 12.TOWN COMMISSION REPORTS Commissioner John Shoemaker provided comments supporting the Chief and police department. Commissioner Evalyn David agreed with the comments of Commissioner Shoemaker. Commissioner Peggy Gossett-Seidman also concurred with Commissioner Shoemaker supporting the Police. She discussed a meeting she attended at the Federated Woman in Tampa and provided stats obtained from Senator Simpson regarding Florida's budgeting practices, businesses relocating to Florida due to the removal or the sales taxes prior to the COVID pandemic, the widening of the Panama Canal, New ports in Melbourne and Cape Canaveral and upcoming budget changes She also encouraged everyone to vote. Vice Mayor Greg Babij echoed Commissioner Shoemakers comments. Mayor Douglas Hillman provided a follow up from a zoom meeting with Commissioner Weinroth and three of his attorneys as well as Eric from the parks and recreations department of Palm Beach County concerning Milani Park. Also, in attendance was Town Manager Labadie and Town Attorney Torcivia. There was a discussion on the plans for Milani Park and the potential danger of Yamato Rock. 13.TOWN ATTORNEY'S REPORT Town Attorney Torcivia provided additional comments on the meeting concerning Milani Park. 14.TOWN MANAGER'S REPORT Town Manager Labadie provided comments on Milani Park, the FR Aleman Trucks conducting a survey for Florida Department of Transportation's (FDOT) resurfacing, restoration and rehabilitation (RRR) projects, the census, the strategic priorities plan, the conversions through BS&A , the repainting of the water storage tank, lift station 5, the evaluation of the sanitary sewer system, board vacancies, the digitization process by the Clerk's office, and kudos to Accreditation Manager .Aronowitz, Officer Shersty and Officer Miller who assisted a future resident regain access to their vehicle after an accidental lockout. He thanked the Commission for their comments about him on Item 11 D. He also provided an update on the roof and crosswalk projects.
