1969.04.01_TC_Minutes MINUTES: TOWN COMMISSION OF HIGHLAND BEACH - April 1, 1969 • The regular meeting of the Town Commission was called. to order by Mayor Horton on April 1, 1969 at 7:00 P. M. All Commissioners were present. The minutes of the regular March 4th Town Meeting and workshop meetings of March 14th, 18th, 21st, and 25th were read. After a correction was noted on the Town meeting minutes, they were all approved as read by the affirmative vote of all present. A suggestion was made to air condition Town Hall for the summer. Commissioner Beekman read communications from Florida Power & Light, req- uesting use of the w t r line easement for a route for an express feeder line. Commissioner the motion and Vice-Mayor Vedder seconded it. Mr. Kemery reported. that the Town has no legal right to grant this. Mayor Horton said that in view of this information the Commission will defer action, and pass it on to the Attorney. The motion was withdrawn. Mayor Horton read a letter from Hallman, Meeker, & Sanson, Attorneys in Boca, representing John Spinnenwueber, objecting to the proposed rezoning of lim- ited. business to R4B, specifically Lot #l, and objecting to the ordinance as a whole. A letter to the Executive committee from the owners of the Delray White- house property was read by Mayor Horton. They are boarding up the property and will answer the Town requests to clean it up. Mayor Horton stated that in regard to the law suit from Terra Mar Inc., the Town Attorney forwarded • the brief from the Town to the Judge, so action will be delayed. On the Police matter, negotiations are being carried on with Gracey Bros. who have access to Companies doing business with the type of coverage needed- false arrest and the attendant perils. The Commission felt that the Town could not enter into a contract without this coverage. The Mayor also reported that the Attorney feels there is no possibility of keeping churches out of residential areas. The priest asked for and was given permission for a sign but it is not in conformance with several provisions of the sign ord- inance. The Commission felt that this was not the proper time of year to pursue the matter with due diligence. However a letter was written pointing out several instances in which ordinances are being violated and that they would be waived until after Easter at which>>time the priest will be contacted to be sure ordinances are complied with. Commissioner Beekman reported. taxes collected to date are $ 51,676.43.- out- standing are $ 4,181.20. interest, one $ 5,000 bond wil yie , yield 6.15 interest. The Mayor reminded the Commission that this month con- cludes the fiscal year and though expenses have been running lower than an- ticipated,in April there will be a large payment of interest and premium on Water plant bonds and last of the year expenses. Income was high due to the Finance Commissioner McCook reported total income to date is $ 92,090.18, expenses to date; $ 49,554.31. There was excess money in the checking ac- counts which was invested in~Treasury notes. One $5,000 bo d will yield 5.5 ' 1 ld 6 7 interest and one~5 000 bond will • building boom which brought in revenue from building permits requested by developers. MINUTES: TOWN COMMISSION OF HIGHLAND BEACH - April 1, 1969 Pase two • Vice Mayor Vedder reporting on Health and Zoning stated that progress is being made on the proposed zoning changes and it is hoped that it will be completed by the middle of the month. Mr. Pond asked if citizens could have some say in the proposed changes. Mayor Horton explained that the workshop meetings are to iron out problems and thus it would be impractable to open to all in the Town, however citizens can be invited to give assis- tance. Mr. Bonner stated that he is interested in the changes also and could he have a meeting with someone. Commissioner Hackman reminded the Commission that all meetings are open to the public and the Mayor expressed agreement. Mr. Pond feels a questionaire could explain the plans and get the feelings from property owners and residents of the Town. There was pro- longed discussion. Vice Mayor Vedder reminded those in attendance that this was voted on in the February meeting so people were informed. Commissioner Hackman said that the workshop meeting thursday the 3rd could include in- terested citizens and reporters. Commissioner Hackman reported for public works that the March consumption of water was 5,195,500 gallons, that 345 tests were taken and we serve 98 meters. Mayor Horton reported receiving several complaints on color, and clarity of theinvater. Commissioner ackman explained that the problem is with the check valves that operateater plant, and Brockway, Gwen and Anderson have suggested methods to alleviate the situation. Mayor Horton recommended tapping procedures,from new construction, which may stir up sediment, be altered and asked if clarity tests could be taken in di~e~t- • ent spots in Town? There were many comments and much discussion. The Mayor suggested. that if the water is not satisfactory, the consulting engineers be changed or invite Mr. Anderson to investigate and alleviate the con- dition. It was also suggested to use some of the surplus money in the bud- get for improving the water plant. A request was read from F~.nr.ida Power & Light for an unde'r,g round cable under AlA at Penthouse Highlands and it was commented°~hat this formal procedure. Commissioner Hackman made the motion to notify them of Town approval and after Mr. Vedder seconded it was unan- imously carried. The Russell Rd. paving sketch, including a water line and fire hydrants, was submitted for further study and approval. The signs at the Intracoastal Canal for water line warning will be installed next week, and a letter was received from Boca Raton giving approval. Vice Mayor Vedder reported on the sewer progress. He stated that the minutes explained about the gift money and that a preliminary report has been rec- eived from Russell & Axon. He has also received a contract from Delray, using their outfall as this was more feasible than Boca or crossing the Canal. Final meetings with Delray will be held shortly. There were comments and discussion about pollution, when it will be completed and how it is to be financed. Mr. Vedder explained that he is pursuing other financial angles than General ob- ligation bonds as financing is a major problem. The second reading of rezoning of Limited Business was read. Mr. John Spinn- enwueber, who is interested in one parcel to be rezoned asked for an expla- nation of R4 districts. Mayor Horton stated the zoning in R4 and explained that years ago an allowance was made in two lots in Town for limited busi- ness in apparent anticipation of a bridge construction. Since this was not done the present Commission is trying to correct this ..zoning. Attorney Meeker, representing Mr. Spinnenwueber, commented also. Once again the Mayor stated the uses of R4A and R4B districts as put forth in Ordinance #132. Vice Mayor Vedder made the motion that the ordinance be passed on the second reading and Commissioner Beekman seconded the motion. Mr. Urbanek, a developer from Ft. Lauderdale, questioned the proposed ordinance changes, and was invited to attend a meeting on Thursday with Mr. Vedder. There were questions as to when they will be done, and comments from property owners. Mayor Horton explained that it is a time consuming job rezoning the Town from one end~to the other and Mr. Vedder stated that rezoning is to make this a Town to fit the 'two neighboring communities, who have recently rezoned. The first reading is expected at the May Town meeting. Mayor Horton read the outstanding bills and they were unanimously app- roved for payment. The meeting was adjourned at 9:25 P. M.
