MINUTES: WORKSHOP MEETING OF THE TOWN COMMISSION- April 23, 1969 A workshop meeting of the Town Commission was held at the Town Hall and called to order by Mayor Horton on April 23, 1969 at 7:30. P. M. All Commissioners were present as well as several builders and developers. Mayor Horton read a request from Attorney Poulton for membership dues of $ 67.50 per year to the National Institute of Municipal Law Officers which gives information to Town Attorneys. He suggested the Commission think it over and. be prepared. to act on it at the Town Meeting. The Mayor read a letter from Doyle Rogers, an attorney from Palm Beach, regarding a fence on the lot south of Highland Towers, owned by John Mulcahy, ask- ing for a variance to allow fence height as stands now. They had no know- ledge of Town Ordinances at Delray Fence Co., so the owner of the prop- erty to the south of the lot was not notified. A letter will be written requesting permission for variance with Town Commission approval. Vice Mayor Vedder then introduced Mr. Andy Anderson, who is developing Penthouse Highlands. He offered $ 150,000 from seven developers and sub- mitted a draft of .a proposal on who donated. and how much, for Phase #1 of the sewage system, for the Commission and the Town Attorney approval. They want assurance that work will be started and will be available on or before November 1st. and have the same unit cost. Legal steps and ave- nues will now be sought. Discussion followed and the Mayor thanked the builders for the money and their presence at the meeting. • • The Mayor read a letter from Bob Crego submitting a proposal to become Build- ing inspector for the Town effective July 1, 1969 at $ 250.00 a month, total of $ 3,000.00 a year. It will be brought up at the Town Meeting. Mayor Horton reported there is still no progress on the church matter due to Mr Crego's being in the hospital but it will be handled as soon as possible. There was received. from Florida League of Municipalities a legislative bulletin regarding giving municipalities-governmental, corporate affid propriety powers to enable them to conduct municipal govern- ment, perform municipal functions and render municipal services and may exercise any power for municipal pHrposes except when prohibited by special law. The Mayor said that he asked the attorney about the specific meaning. He read a House bill permitting municipal governmental bodies to propose charter amendments by a 3/5 vote with a limit of 2 a year. He also read a bill stating the Towns shall not issue occupational licenses until proof is shown for the same in the state and county. The Mayor will write ex- plaining oppostion to this bill #k 142, and objecting as a policing agent, The Mayor read the decision sn the Aguirre suit in favor of the Town, in toto. He read a letter from Mr. Vansant, engineer in Boca City Hall re- garding arterial streets, informing of a.proposed NE 10th Ave. within the Town limits, with a sketch enclosed. A letter will be sent to Mr. Vansant thanking him for his letter and the information contained therein, and that it was reported to the Commission. A letter from Florida Power & Light was read requesting for participation in the use of the 10' easement used by the water line. This was discussed with Me. Kemery who found that the' orig- inal easement was granted when the meander line of Spanish River was still in exis~ence and. that other use would require permission from adjacent own- ers, who would agree if the lines were put underground and transformers hidden. On the Police matter, Gracey Bros. are pursuing coverage, having obtained it for Gulfstream. A letter from Mr. Bonner was presented relating to the zoning changes and how it would affect his property at 4715 S. Ocean $lvd. There was discussion as to increasing the number of street lights on AlA, Bel Aire Drive, and Highland Beach Drive. Commissioner Hack- man reported. that on the Russell Rd. paving matter, the Town has permission and approval from the State and that now are waiting for the completed plans from the engineers for bids and. other costs. Commissioner McCook stated that the budget is worked out briefly and that it will be altered and completed. next week. There was discussion on getting bids on central air conditioning for the Town Hall. Also the Office manager is getting bids on more comfortable chairs for the meeting room. Mayor Horton suggesting extending the building moratorium one month so to have several meetings scheduled for reading the proposed zoning changes, giving due consideration to anyone requesting special dispensation. ~~ ,~ The meeting was adjourned at 11:00 P.
