1969.05.06_TC_Minutes MINUTES: TOWN MEETING OF THE TOWN COMMISSION OF HIGHLAND BEACH- May 6, 1969 • The regular meeting of the Town Commission was called. to order by Mayor Horton on May 6, 1969 at 7:00 P. M. All Commissioners were present. The minutes of the regular April 1st Town meeting and workshop meetings of April 3, 8, and. 23rd. were read.. They were approved. as read by the af- firmative vote of all present. Mayer Horton welcomed. the large attendance and. prsmised to obtain more comfortable chairs and. Air conditioning. Commissioner Beekman, deferring to the April 8th minutes, asked. what happened. to the $500,000 mentioned as a donation from a builder. Commissioner Hackman reported a meeting was held. at the Boca Raton National Bank, attended. by the Mayor, Vice Mayer, Mrs. Noble, and. Messers Kemery, Chingos, ~.ond, Urbanek and Barr It was assumed. that the money was not a gift but was contingent on zo 'ng. The Mayor stated. that he understood. that Mr. Urbanek said. he would loan the money at the same rate of interest he could. borrow it at - 72'x. Vice Mayor Vedder stated. ghat there was a meeting that afternoon at Town Hall with John Klinek and. the builders pertaining to funds from the builders. At that meeting Mr. Urbanek again stated. his offer to loan money at 72•x. His donation in the contract with donations from other builders, was $25,000.00. The Mayar reporting fir the Executive committee reiterated the ruling by Judge Hewett in favor of the Town in the Aguirre suit. He read. a request from Attorney Poulton for membership in NIMLO at $67.50 per year. Mayer Horton suggested. this was°good investment as this was a service to provide • information to Town Attorneys. Commissioner McCook made the motion to answer the request, Commissioner Beekman seconded. the motion and. it was unanimously carried.. Three bids have been received. for more comfortable chairs, the lowest being ~ 5.25 each for Samsonite, with a padded seat. Mayor Horton suggested purchasing 24, using the present ones for replace- ments. Commissioner Beekman made a motion to purchase 24 chairs, Vice Mayor Vedder seconded and it was unanimously decided. There as yet are not enough bids for air conditioning to act on. A letter was received from Mr. Crego, who is retiring from Delray Beach the end. of June, offering to come to Highland Beach as full time Bumlding Inspector for the Town. He will be hired. as an independent contractor for the sum of $3,00,OO~a year and will do building inspections, plumbing inspections, will figure the cost of building permits and wiil assist in such planning and. zoning matters as come up. Commissioner Beekman made the motion to hire him, Vice Mayor Vedder seconded. Commissioner Hackman suggested waiting until after the zoning hearings outcome to see if building warrants hiring a full time building inspector. Commissioner McCook stated that the present outlay for inspections for last year was $3,148.84 and that is not the final figure. Mayor Horton and Vice Mayor Vedder stated they felt there would be enough need. because of the building already giong on.The Motion was carried with Commissioner Hackman casting a dissenting vote. Discussion followed. from several citizens and Commissioner Hackman changed his vote to affirmative. Mayor Horton read a bill about taxing city libraries which would be double taxation. He further suggested sending official notification • to the delegation of opposition to this. Vice Mayor Vedder made a motion to do this, Comm. McCook seconded and it was unanimously carried. The Town Attorney was asked~to contact Don Reed. as to bill #279 which provides that municipally owned property outside municipal limits would no longer be exempt from taxation. Commissioner Beekman reported. taxes collected. to date were $53,417.89 - outstanding- $3,137.38 and that 2,623.15 is from Winterhalter Inn, that has a suit against the County and our collection will depend. on the out- come. Finance Commissioner McCook reported. receiving $150,000 from the builders and. opened. a Sewer Fund. Account. The money will be put to work in bonds as soon as the new check book arrives at Town Hall. A budget has been worked out and was read, but should. be considered. temporary as it would be revised if a contemplated change is made in *he fiscal year to agree with the tax year. The audit is now under way for last year. Commissioner Hackman in checking the water plant operation says itis low. He read a letter from Brockway, Owen and Anderson suggesting expanding the amount of time spent and increasing operators from two,to three, costing 1/3 more. He has inter- viewed Ehel McDowell who has eight years experience. Comm. McCook explained the extra cost would. come under contingency and moved to adopt the budget. Comm. Beekman seconded and ~,t was unanimously carried. On sewers, health and zoning, Vice Mayor Vedder read a resolution authorizing execution of an agreement between the Town of Highland Beach and. the City of Delray Beach making available the ocean outfall system for the use of High- land. Beach sewerage and. made a motion for adoption. Comm. Beekman seconded and it was unanimously voted. Mr. Vedder next read an authorization to per- • form engineering service by Russell and. Axon, continuing service for bobtail Phase which means: connecting on to the outfall system, coming down to the northern part of Town to a master lift station, purchasing land for the lift station, continuing down to where the builders are building with a sewerage line and temporary pump, installing a meter in Delray north of Town; at $100 a day, total $2,OOO.OO.Comm. Vedder moved. for adoption, Comm. Beekman seconded. and it was unanimously carried. There was a question as to the meaning of bobtail system,as to considering sewerage in the whole Town and the widening of AlA. Vice Mayor Vedder read. authorization to h~,re Frank Watson a bond, attorney in Jacksonville, considered to be one of the best, at $2.~0 per $1,000 plus out of pocket expenses, and moved to adopt this. Comm. Beekman seconded. and Comm. Hackman asked if more funds were received would. he be needed. ~7ice Mayor answered. that the Town should have advise from a bond. attorney and. that he is a~,so suggesting other financing ave- nues than General Obligation Bonds. It was stated that three years ago the Health Dept. of Palm Beach Co. warned. the Town to put in sewers, so it was a matter of time. Discussion, questions and. explanations followed. Mayor Horton stated that this seems to be a reasonable solution to a problem and must be done in stages. It was unanimously voted to hire Mr. Watson.:" Vice Mayor Vedder read an agreement between the Town and the developers about accepting a proposal paying $150,000 to tthe sewer construction fund.. The Town will proceed with Delrayand all money will be returned if not done in 30 days. He made a motion this be adopted., Comm. Beekman seconded and i# was unanimously carried. Vice MayorVedder then Stated he wants an agreement • to buy land fo~a4lift station, so he could. proceed. and report on costs, etc. Comm. Hackman ade a motion this be designated, Comm. Beekman seconded. and it was unanimously passed.. Mr. l~nderson informed Me. Vedder that more money may be coming from developers buying at the north end of Town. The Town attorney advised the Office Manager to write a follow up letter, reported. Vice Mayor Vedder and. if there is still no answer then it will evert back to the owner's attorney. On the church matter, Vice Mayor reported he and. Mr. Crego met with Mr. Keller about the sign. The priest said that the land. might be swapped. for land. south of the Town Hall, is meeting with the bishop this month and will take no action until plans are definite. He will submit a' letter before the June meeting On zoning Vice Mayor reported a notice'. ~~, published. in the paper and sent out informing of scheduled meetings. He `~.~ urged. people to examine the copy of zoning in Town Hall and attendance at the meetings. The reading of zoning will be delayed 30 days to allow att- endance at these meetings. Individual problems will be aired and discussion will be held. in detail. Comments and discussion followed. Mr. Pond read. a report on the questionaire he privately sent out. He further suggested a vote of thanks for the work done by the Commission and. the 90 day building moratorium on permits. There was further discussion and. a question was raised. as to height of buildings in Byrd. Beach. Comm. Hackman reporting on Public Works said. two new fire hydrants have been installed and. are operating at the north end of Town. The Bel Lido bridge has been patched. and. repaired., the large pipe from the water storage tank was painted. with chemical paint, Bahia grass seed. was sown around the Water Plant, signs warning of the water line under the Intracoastal were erected.,-Russell Rd. final plans were received. from Brockway, Owen and Anderson and. are here for the Commission approval.Mr. Hackman made a motion to accept these plans, Comm. Beekman seconded and. it was unanimously approved. • Water consumption was 5,806,000 gals, for April, 299 tests were taken and sent to the Bd.. of Health. There were comments as to low pressure, water not soft yet and. what the maximum capacity of the water plant is? 6. question was raised. if there are sufficient street lights and. Comm. Hackman said he will investigate. The Mayor informed. the Commission of a check for $395.00 from Mr. Jurisch for 2 year special State liquor license, having been received. A resolution received. from Delray for recommending approval of a proposed. 12th street bridge construction was presented.. They want this Town to forward a similar resolution requesting prompt attention. Comm. Hackman made the motion to do so, Comm. Beekman seconded. and. it was unanimously passed. Mayor Horton said. there was no report on the police matter yet but a company to issue coverage has been found.. The Town Attorney is advising the Commission on recommended. action.
