1969.08.05_TC_Minutes • MINUTES: TOWN COMMISSION OF HIGHLAND BEACH - August 5, 1969 The regular meeting of the Town Commission of Highland. Beach met August 5, 1969 at 7:00 P. M. Due to a power failure, the meeting was recessed until Tuesday August 12, 1969, 7:00 P. M., at which time the meeting re- summd.with Mayor Horton presiding. Al Commissioners were present with the exception of Vice Mayor Vedd.er. The minutes of the July 1st meeting were read.. Mayor Horton asked. a corgi rection be made to read. Miss Cain, rather than Mrs. Cain. Mayor Horton called. for the corrections to the June minutes which Comm. Hackman had. requested.. As the corrections were not available at this time, the June minutes will be completed, and. presented. at:..the next regular meeting. With these additions and, corrections, the July minutes were accepted. by the affirmative vote of all present. Comm. Beekman announced. the absemce of Atty. Poulton at the last meeting was due to illness, and. not a neglect on the part of the Commission. The report of a conference with Sheriff Heidtman and Mr. Wm. Stewart was submitted. and, is included. as page 4 of the July minutes. The minutes of the workshop meetings of July 12th and. 26th were read.. Col. Burnside asked. for clarification on the matter of the developers agreeing to firm their own group to work on the sewer program. With this clarification, the minutes stood. as read.. • A wire rec 'v ed. by Comm. Hackman from Mr. John Havens was read. and is included as page ~of these minutes. Mayor Horton announced. that the method. of conducting the Town meeting will conform with Roberts Rules of Order and. comments from the floor will be recognized, only in their appropriate order. He asked. those having questions on committee .xeports to make note of said, questions amd present them in their proper order. Executive report by Mayor Horton: Due to Mrs. Roberts vacation the Post office will be closed. for two weeks. Mr. Crego, the building inspector, will be in Town Hall during the morning hours to answer any questions which may arise. The appeal filed. by Aquirre Investment against the decision handed down by Judge Hewlet several months ago is poogressing. The Town Attorney has submitted. a rebuttal. Due to a previous commitment the Mayor was unable to attend. the County Commission meeting regarding public recreational facilities. A bid. has been receive from a local service company to cover spraying and. fertilizing lawns.~l The spraying would. be made every two months and. fertilized. two times yearly. The cost would. be $ 15.00 every two months. • Without any suggestions to the contrary, the Mayor stated that he will procede with the program. ~~ (~T • MINUTES: TOWN COMMISSION OF HIGHLAND BEACH- August 5, 1969 Page two A summary of the new Home Rule Law was made and. Mayor Horton stated. that the Town Commission may now make certain amendments to its charter by a majority vote and. referendum of the voters and filing said. amendments with the office of the Sec, of State. The first change anticipated. will be the fiscal year. This change has been prescribed. by another act of the State Legislature. Tax Comm. Beekman reported. only two outstanding tax bills. Total colleted to date: $ 53,902.70, outstanding $ 2,652.55. Comm. Beekman and. the Mayor attended. a meeting held. in W. Palm Beach with representatives from 13 local communities and. the Co. Tax Collector to discuss the collection of Municipal taxes by the County. The representatives were unanimous in their opposition, the 1% charge to be imposed. being one reason for said. opposition. Finance Comm. McCook reported, the Town expenses for the year to date were $ 11,015.37;income for the same period. $ 10,011.48. The income figures did not reflect the water sales for the month of July. Public Works Comm. Hackman reported. that the air eelease valve has been in- stalled, and. is functioning satisfactory. Lime is now being used, and, he rpeorted that we now have an excellent grade of water, 307 tests were made on the water during the month of July and. all found. to be well within the Bd, of Health requirements. Black fill is being put on the area inside the fence to deter wind, erosion of the sand. A 100 feet plastic pipe has been installed. on the drain from the lime tank. Arrangements are being made to • paint the fire hydrants. During the power failure last week there were three water plant operators on hand. and, it is gratifying to know that this manpower is available. Mr. Hackman stated, the power company has not yet installed. the lights on Belair and Highland. Beach Dr. He then presented, a motion that the Town purchase tapping tools in the amount of $ 400.00 In the past we have had. to borrow these and. in his opinion it will be a good. investment. Comm. Beekman seconded. the motion and. it was passed. by the affirmative vote of all present. Mayor Horton sated that the fire plarshall recommended. using different colors on the hydrants to designate the pressure on them. Comm. Hackmanb~,iR~ stated. that the hydrants will be painted. under the supervision of the Fire Dept. and. they will no doubt comply with this suggestion. There were no bid's received. for the paving of Russell Dr. and, the advertising for said, bids will be placed. again in 90 days., according to the engineers. Comm. Hackman also reported. a plastic soaker has been installed. at the Water Plant and. sprigs of Fla. holly planted. on the circumference. Mr. Kemery of the zoning committee gave a summary of progress tod.ate on the amendment to Ord.. #132. The first reading was made and. Mr. Kemery stated. that existing conditions on construction sites may prove disastrous in the event of severe storms. Also, in his opinion, the appearance of said. con- struction should. show the need, to take immediate acti~no~n these amendments to the zoning ordinance. Mayor Horton called. for a meeting of the committee to be held, Sat. Aug. 16th at 9:00 A. ~. ,zf~f1~1/p~,lp~xi~f/ regarding building plans and. other matters and. Mr. Kemery requested. that the building inspector also be invited.. Comm. Beekman recommended. the announcement of said. meeting should. be placed. on the bulletin board.. The engineers have received approval for the design of the sewer project Phase ##l. Advertising for bids is now appearing and bids will be opened at Town Hall August 26th at 7:30 P. M. The engineers anticipate a 75 day construction schedule to operational stage. After several meetings with the builders, they are looking favorably on trying to complete the system in one phase, but there are yet many factors to be considered.. The appraisal of the west side property known as Ocean Terrace was a figure of $ 10,800.00 Mr. Wm. Stewart reported, he met with Sheriff Heidtman today and. it has been established. that provision of police service on a contractural basis is legal in the State. One of the men in the Sheriffts Dept. is preparing a cost statement for our study, and. it should. be ready within ten days. The second, reading of the amendment to ordinance #132 was made. The Mayor read a lefiter from Don Ross representing the Property Owners Association,..~._,Y_..~_,_ _ requesting delaying action until the members have an opportunity to disc. s._ the consequences and. express their opinion. Open discussion on the reading `- and, its contents followed.. After lengthy and, heated. discourse on the matter, Comm. Beekman called. for the question and, vote on the ordinance as submitted.. Mayor Horton notified. those dissenting that the question had. been called. for and, no further discussion will be recognized.. The votes were cast, with Comm. Beekman, Comm. McCook and. Mayor Horton voting aye and. Comm. Hackman nay. • Comm. Hackman asked, for a show of hands of those present who were also op- posed,. There was a large showing of hands but when Comm. Beekman asked. how many of these were freeholder electors in the Town, it was determined. that only a few were residents. Mayor Horton reminded. those present that because of a an appeal from the Apt. Owners Assoc. many months ago, this proposal was studied. by Mrs. Noble and. the committee and. was consolidated and. resulted. into what we have been discussing for the past four months. Comm. Hackman noted. the hardship being placed on Mr. Larry Wingle because of the buffer zone requirement. Mayor Horton explained. that it is a matter of ten feet more of greenery required, and. that the set back line, which is normal in any society, and. the buffer zone do overlap and. are not in addition to. Mayor Horton suggested. that the attorney who is representing Mr. Wingle contact the Town attorney, Mr. Poulton, for clarification. Mr. Kurzinger ART asked for better clarification in sections 7B3 or in Sect. 15. Comm. Beekman asked those present to recall the condemnation suffered, by a former Commission for the purchase of acreage,~it,,~o~,,~e held. for future well fields. They were looking to the future and~fi8`uld. now be thanked. for their foresight and. action. He stated. that it is just such a thing which the present Commission is attempting to do on zoning. Col. Burnside asked. about a letter being mailed to persons in the Town from the Highland. Beach Property Owners Association. The letter is unsigned. and he asked Comm. Hackman if he knew the identity of its editor. Comm. Hackman denied any knowledge of the letter. Hackman neither confirmed APPROVED - ~i~c%-r~~ Mrs. Wilda Turner, speaking for the owners of lots in Highland. Beach Isles asked for a commitment on the zoning for said. lots. Mayor Horton advised. that the owners should present, as a united. front, a plan of what they wish to build. and. present it to the Commission for study. Mr. Fred. Bunn questioned. the action of the engineers in the design and, raised. the question gf a possible impact on residents of Byrd. Beach. He and. Comm. Hackman v~mced. the fear that Byrd. Beach may withdraw from the Town. Mayor Horton stated. that from his observation, newsletters such as were circulated. in the past d.id. more to alienate the Byrd. Beach residents and. others, than any other action and. deems such publication to be complet.~ly. inexcusable. Bills and accounts were read. and approved, for payment by the affirmative vote of the majority. Comm. Hackman withheld, his vote. The meeting was adjourned. at 9:30 P. M.
