1969.09.09_TC_Minutes MINUTES: WORKSHOP MEETING OF THE TOWN COMMISSION - September 9 1969 • A workshop meeting of the Town Commission was called to order by Mayor Horton on Sept. 9th, 1969 at 7:15 P. M. A11 Commissioners were present except Mr. Beekman. Also present were Messers Klinek, Walton, Burnside, Attorney Poulton and quite a few builders andfor their representatives. Mayor Horton opened the meeting with a summation regarding the contract between the builders at the north end and the Town of Highland. Beach, stating that Russell & Axon prepared the specifications for the sewer system; notified several in that business and gave theme-the plans; the request for bids were advertised and opened Aug. 26th. The con- census was that since the bids were considerably over the anticipated cost, further study was suggested before any decision could be made. Further meetings have subsequently been held. between the builders, the honing committee, and the Town Commission. He then asked that the builders representatives advise the Commission of their standing and introduced Mr. Shelby Dale, an attorney from Ft. Lauderdale. Mr. bale stated he was authorized to report that the problem was dis- cussed in every facet and the final decision was that the builders think the entire line, with a corporation composed of the developers and their contributions, could be built for around $ 200. a unit. They are unanimous in deciding to go ahead and build a plant; after meeting legal requirements and obtaining cooperation with the Town. Mr. Dale then asked. the Commission to reject the bids and enter into a contract for the whrle development, stating that a corporation would • be formed and that the agreement should provide that on a ten year ]3~~~~ program sufficient unit connecting charges be charged each dev- eloper as land i,~ developed. The projection is 5,000 units in ten years and. the charge could be $ 175. a unit. __ J. Mayor Horton complimented all the builders on this proposal a.nd the work involved. He then asked the Town Attorney for his legal opinion- can the Town pass on to a corp. legal documents from Delray and. the State Rd. Dept? Other legal questions would also arise and need clarifying. The Attorney asked who would own the system upon comp,- letion? Mr. Dale a~&wered they would agree to any legal requirements necessary and he and Mr, Urbanek both explained that the system could be donated to the Town at the end. of a certain period for $ 1.00. / He stated further that the plant would be built according to the en- ~/ gineers specifications, The Attorney brought up the question of re- bidding, that this might be construed as entering into a private con- tract. Mr. Dale suggested alternate plans could include a packaged lift station. The attorney will give an answer later on the bid aspect. Commissioner Ha.ekman reminded the Commission that on the water plant construction, the bids were high and were refused. The Town then proceded to build it with its own contractors, saving $ 100,000, and resulting in a surplus of money. He explained the new and final. plans were changed 60•x. Attorney Poulton stated he was advised that if plans are altered, they should go out for rebid.. Mr. Dale answered that plans would be changed with review by the engineer and the Board of Health, such as 30" CJ • L MINUTES: WORKSHOP MEETING OF THE TOWN COMMISSION - 9-9-69 Page two ground cover instead of 36 inches and using a package lift station, adding the builders could save money by these suggestions. Mayor Horton again complimented the group for this constructive plan and added that if a contract or series of contracts could be devised to cover various problems, the Town would not be subject to possible litigation or major expense. Mr. D~]1 asked the bids be rejected. and asked the Commission give im- mediately their attention to an agreement to be submitted, calling a special meeting if necessary to approve said agreement. Temporary service could be provided to builders having near future occupancy. Commissioner Hackman suggested asking Don Reed, who steered the Town through water plant construction, to assist on this project. There was further discussion on plans, contracting suggestions, col- lecting revenue and. the type of lease. Vice Mayor Vedder brought up several points for consideration, feeling that this new proposal covering the full section might be subject to bidding and suggested the system might be built in two phases. He further explained. that a waiver would. be required in answer to a req- uest for a refund. by one of the builders. Further discussion followed. Mayor Horton said legal problems would have to be ironed out, that many are unanswered at the present time. He polled the Commission for their opinions. Commissioner Hackman suggested. after more discussion, that the bids be rejected and that the Attorneys meet and make their decisions and recommendations. Commissioner McCook is in favor of it after legal perusal. Vica Mayor Vedder is also in favor and made a motion to reject the bids. Mr. McCook seconded and it was unanimously approved. He made a motion to cooperate with the builders to form a corporation, subject to legal aspects, for building a sewer system the full length of the Town, and subject to review by Russell & Axon. Mr. Hackman seconded, and it was unanimously approved. Mayor Horton stated the Commission has pledged their cooperation and will call a special meeting if needed, but further procedure is up to the developers group. Col. Burnside asked should the donation money be refunded., with proper accounting, since the first agreement with the builders is ~~ cancelled after rejecting the bids. Mayor Horton answered the accounting could take two weeks, meanwhile the money is earning interest. • • MINUTES: WORKSHOP MEETING OF THE TOWN COMMISSION - 9-9-69 Page three Commissioner Hackman added. that a time element is involved here and when the attorneys have resolved. the working procedure, a special meeting could be called according to the Charter. Mayor Horton assured. those present that the Commission will do what is necessary, and a meeting will be called. for Sept. 16th at 7:15 P. M. He further suggested advising the press of these present developments. Commissioner Hackman o~ered his compliments on the spirit of coop- eration shown here tonightand releiving this problem in Town, adding it is a pleasure to have these people here to work with. Attorney Poulton stated. he has not yet filed condemnation proceedings for acquiring the lift station property. Mayor Horton again offered his compliments and thanks.
