CALL TO ORDER Chairperson Burnich called the meeting to order at 2:00 PM 2. PLEDGE OF ALLEGIANCE The members of the Code Enforcement Board led the Pledge of Allegiance. 4. APPROVAL OF THE AGENDA Chairperson Burnich requested to move Item 8A—Violation Hearing Case #2019-06, 3822 S. Ocean Blvd., Golden City Highland Beach, LLC (Samuel Swerdlow) after Item 6A, Approval of Minutes MOTION: Chairperson Burnich moved to move the Item 8A after Item 6A. Vice Chairperson Resnick seconded the motion, which passed unanimously. 5. PUBLIC COMMENTS AND REQUESTS Harry Adwar provided comments regarding a large amount of seaweed on the beach. He invited residents to come to Bramear Isles on Sunday for a drink and watch the activity along the Intracoastal. He also commented about the sea walls, which he believed were in poor shape. Diane Matthewman of Bel Air Drive, commented there had been illegal parking along Bel Air Drive. She stated people were using the location for free parking to avoid the parking meters on Spanish River Boulevard, to gain access to the beach. She cited safety and security concerns. She stated parking on the street is under Highland Beach Ordinance 16-2, which adopts the Florida Uniform Traffic Code, as well as Ordinance 16-3, which prohibits parking on a public street. May 14, 2019, Regular Meeting MOTION: Vice Chairperson Resnick moved to approve the May 14, 2019 Regular Minutes. Member Schlam seconded the motion, which passed unanimously. B. VIOLATION HEARING CASE #2019-06, 3822 S. Ocean Blvd, Golden City Highland Beach LLC (Samuel Swerdlow) Code Section: 30-122(A) Description: Observed unauthorized fill of protected wetland area. Legal: 4-47-43, SLY 300 FT OF NLY 1350 FT OF GOV LTS 1, 2 & 3 LYG W OF A-1-A & SLY 300 FT OF TRS DEED 20339 LYG WITHIN A/K/A PT OF CITY LTS 59 & 60 PCN: 24-43-47-04-00-001-0030 Code Compliance Officer Jason Manko introduced this item. Town Attorney Rubin explained that there is a request to extend the case. Attorney Adams Weaver, Law Firm of Jones Foster, representing Golden City Highland Beach, LLC and Mr. Swerdlow, remarked this is an outgrowth of the damage created by Hurricane Irma in September of 2017. He stated his client was not properly served with regard to the hearing. He remarked that they had requested a continuance until the next Code Enforcement Board (CEB) meeting. He stated their due process rights would be violated if they were not allowed to present their case in a cogent fashion with the appropriate experts,and that they wanted to be fully protected under their legal rights and requested they be granted a continuance until the next CEB meeting. Member Paul Resnick remarked that having looked at the exhibit packet, there was nothing of any great urgency, and made a motion to allow a continuance of one month. There being no second to the motion, the hearing moved forward. Code Enforcement Officer (CEO) Jason Manko submitted evidence, proof of service, supporting documents, and photos taken of the property that fairly and accurately represent what was observed during an inspection on March 14, 2019, the initial inspection date, and May 28, 2019, the most recent inspection date. On March 14, 2019, the property was inspected and the following violation was observed: Unauthorized fill of protected wetland area without permit, in violation of Town Ordinance 30-122(A). On June 21,2019, a Notice of Violation,Notice of Hearing was sent to the owner listed on the Palm Beach County Property Appraiser Tax Roll, Golden City Highland Beach LLC, and the registered agent Samuel Swerdlow. Service was obtained by posting to the property address on July 5, 2019. In addition, a copy of the notice was also posted at Town Hall. The property was inspected on July 101 2019, and the violation remains. He recommended 30 days to bring the property into compliance, with a fine of$250 per day per violation, and $100 for the cost of prosecution. Code Enforcement Board Meeting Minutes Page 3 of 7 July 23, 2019 Member Schlam stated he perused the exhibits and inquired about the pink stakes on some of the photographs. CEO Manko explained the stakes were South Florida Water Management District's markings of unapproved fill that were brought into the mangrove wetland area and that there was no building permit requested nor approval to fill the area. Member Perlow asked for clarification of when the fines would be imposed. CEO Manko stated the clock would start 30 days from today (which is his recommendation) if the Board decided there was a violation. He reiterated that the goal was to get the property in compliance. Attorney Adams Weaver cross-examined CEO Manko. CEO Manko stated that Mr. Swerdlow must apply for a permit to remove the fill and restore the wetland area. Attorney James Gavigan, Law Firm of Jones Foster, stated the firm had requested the continuance on July 18, 2019. He stated that Tom Baird, a Certified Land Planner and an expert in Land Use and Environmental Permitting, was to testify today in regards to jurisdictional issues. However, because of his absences an being unavailable to testify on behalf of their client, the client is prejudiced and will not be able to lay forth the facts for the Board to make its decision. Therefore, Mr. Gavigan requested a continuance and presented Exhibits 1 through 6 into the record. Building Official Jeff Massie commented they were not attempting to assert jurisdiction over the South Florida Water Management District; they were only asserting procedural process, that they have the jurisdictional right to issue a permit. AttorneX Adams Weaver reiterated that had there been no Hurricane Irma,this issue would not have occurred; it was only compliance with the Town after a problem created by the hurricane that brought them here today. He stated that this is not a precedent-setting issue. Town Manager Labadie read an e-mail, dated January 8,2018, from Gregory Vazquez of the South Florida Water Management District to Mr. Swerdlow, into the record as Exhibit 7. In the e-mail, Mr. Vazquez stated that no representative from the South Florida Water Management District, the Town of Highland Beach Code Enforcement Board, or the Florida Department of Environmental Protection requested or authorized Mr. Swerdlow to clear and place fill on the property. Discussion ensued among the Board members and Mr. Labadie. Attorney James Gavigan restated the arguments he had made previously regarding applying for and obtaining a permit for removing the fill. He reiterated that the permit is what is being sought and that they object to it on a number of bases, including due process. CEO Jason Manko stated that if Mr. Swerdlow applied for a permit within the 30 days, they would grant an extension upon submittal of the application. Chairperson Burnich opened the floor for public comment. Ilene Mendelson commented that she observed two trees falling half on a fence and half on Toscana property on a Thursday or Friday. She remarked that they only sought the removal of the trees from the Toscana property. She stated that on Saturday morning,trucks arrived with the fill,and workers cut down brush that was not on the fence line and cut into an area and filled it. MOTION: Member Perlow moved to find Golden City Highland Beach LLC (Samuel Swerdlow) in violation of not obtaining a permit. AMENDED MOTION: Vice Chairperson Resnick moved to find Golden City Highland Beach LLC (Samuel Swerdlow) in violation of not obtaining a permit; to provide Golden City Highland Beach LLC (Samuel Swerdlow)to come into compliance and apply for a permit within 30 days; and to assess a fine of$250 per day beyond the 30 days. PROPOSED ORDINANCE ESTABLISHING CRIMINAL AND CIVIL CITATION SYSTEM(NO CRIMINAL PENALTIES 3.15.19) AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING CHAPTER 1 "GENERAL PROVISIONS" SECTION 1-9 "GENERAL PENALTY" BY PROVIDING FOR CRIMINAL PENALTIES FOR VIOLATIONS OF THE CODE; AMENDING CHAPTER 2 "ADMINISTRATION", ARTICLE V "BOARDS AND COMMITTEES", BY ENACTING DIVISION 5 "SUPPLEMENTAL CODE COMPLIANCE PROCEDURES", TO PROVIDE A CODE CITATION PROCESS; PROVIDING FOR THE REPEAL OF LAWS IN CONFLICT; PROVIDING FOR CODIFICATION AND SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Chairperson Burnich referred this item to the Highland Beach Police Department. Police Lieutenant Jay Szesnat stated he reviewed the administrative section of the item and everything seems to be in order. Town Attorney Leonard Rubin provided an overview of the citation process whereby the fine can be paid immediately; or the citation can be contested and it would come before the Board; or the fine is not paid and it would come before the Board for an order finding them in violation, for waiving their rights to contest it. PROPOSED ORDINANCE AMENDING PARKING REGULATIONS AN ORDINANCE OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA,AMENDING CHAPTER 16"MOTOR VEHICLES AND TRAFFIC",ARTICLE I"IN GENERAL", BY MODIFYING THE CURRENT REGULATIONS AND REMOVING OUTDATED PROVISIONS AND TO ALLOW FOR ON STREET PARKING IN CERTAIN SITUATIONS; PROVIDING FOR THE REPEAL OF LAWS IN CONFLICT; PROVIDING FOR CODIFICATION AND SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Police Lieutenant Jay Szesnat stated he reviewed the item and recommended that the Board define "recreational vehicle." Town Attorney Rubin addressed a resident's concern regarding unlawful parking in that parking was allowed on the street, but not allowed for the purpose of beach access. Police Lieutenant Jay Szesnat stated from an operational standpoint, law enforcement would ascertain why a person would be parked on the street. He remarked that the intent would be to curb behavior, and formal citations might not necessarily be issued all the time but would be addressed on an incident-by-incident basis. Vice Chairperson Resnick inquired if Lieutenant Szesnat was recommending a section on the definition of a recreational vehicle, pursuant to Florida State Statutes. Lieutenant Szesnat confirmed that that was his recommendation. Chairperson Burnich opened the floor for public comment. Diane Matthewman stated there is no way to determine why a person is parking on the street. She suggested parking passes be issued. Chairperson Burnich suggested she bring her statement before the Town Commission. NEW BUSINESS A. ADVISORY BOARD & COMMITTEES APPOINTMENT PROCESS (JUNE 11, 2019 DRAFT) Chairperson Burnich introduced this item. Member Schlam commented he reviewed the item and did not notice any major differences from how the process always was. He said he was in agreement. Member Gehman commented that if a person volunteers for a board, it is their time and talent they are offering. He stated that unless there is no other occupant, an applicant should present their qualifications and be approved for the board,without the need for the board chairperson's consent. Member Perlow agreed with Mr. Gehman. Member Schlam concurred. Vice Chairperson Resnick stated that the chairman of a board should not be interviewing an applicant separately and giving their opinion of the applicant. MOTION: Vice Chairperson Resnick moved to make the recommendation to approve the procedures, with the exception of the chairperson interviews. Member Gehman seconded the motion. Mr. Baird's practice focuses on the representation of municipalities, land use and zoning law and litigation, including code enforcement, eminent domain, property rights, takings and constitutional law matters. He has represented counties, municipalities, and developers in these types of legal matters in state and federal courts, and in administrative law proceedings. Mr. Baird serves as the Code Enforcement Special Magistrate for the Village of North Palm Beach and the City of Stuart. He formerly served as a Code Enforcement Magistrate for Palm Beach County, the Village of Palm Springs and the Cities of Boca Raton and Pahokee. Golden City Highland Beach, LLC Subject: Code Enforcement Hearing July 23rd, 2019 official communication. Dear Code Enforcement Board Members, On September 10th, 2017, Hurricane Irma uprooted a number of Australian Pines and Brazilian Peppers on a small portion of my property located at 3822 S. Ocean Blvd., Highland Beach ("Property"), creating an immediate danger to the residents of the Toscana South. The uprooted trees and vegetation also altered the topography of the Property, exposing soils that consisted of construction debris from the 1970s. At the Town of Highland Beach's ("Town") request and authorization, Golden City Highland Beach ("Golden City") cleared and regraded the area of dead vegetation to remove the danger to the Toscana South and maintain the aesthetics of the Property for the Town. On July 16, 2019 (almost two years later), it came to my attention that the Town scheduled a hearing on thea authorized remedial measures. I object to both the timing of the hearing and substance of the violation for the following reasons. 1. First, there are fundamental due process concerns with the hearing as scheduled. I will be prejudiced if this hearing goes forward because my expert, Tom Baird, is currently on vacation and unable to provide expert testimony on my behalf. Mr. Baird is an expert in land use and environmental permitting, a certified Planner by the American Institute of Certified Planners (AICP) and certified by the Florida Bar as a specialist in City, County and Local Government. On July 18, 2019, Mr. Baird sent a letter to Jason Manko, the Town Code Compliance Officer, requesting a continuance on the basis that he will be on out of the state on vacation and unable to attend the hearing. However, the Town was unwilling to grant a continuance to allow Mr. Baird the opportunity to testify on my behalf. Likewise, I am unable to attend the hearing as scheduled, and did not receive adequate certified mail notice before the hearing. Without Mr. Baird's testimony or my testimony, the board will not have all the necessary facts and information to make a decision. 2. Will Carbonell, the building official for the Town at that time, requested and authorized Golden City to perform all remedial actions to the Property after Hurricane Irma. The doctrines of laches and estoppel bar enforcement of an ordinance applied retroactively applied when Town officials induced Golden City's actions. 3. In September 2017, Mr. Carbonell conducted two full on-site inspections and three drive by inspections. I exchanged five phone calls with Mr. Carbonell and provided advance notice before any work began at his request and authorization (see attached event log). I relied on Mr. Carbonell's representations that Golden City's remedial actions did not require a Town permit. While Town delay alone does not preclude enforcement proceedings, GOLDEN CITY HIGHLAND BEACH LLC 20725 NE 16`h AVE STE Al MIAMI,FL 33179 the affirmative actions of Town Building Department officials together with a substantial delay rebuts the alleged violation that it was "unauthorized." 4. The timing of the March 14, 2019 inspection—approximately a year and six months after Golden City performed its remedial actions and coinciding with other permitting activities on the Property— is suspect. It is evident that the Town was aware that Golden City had applied for permits with State and Federal government entities that regulate activities on the property. 5. Jason Manko's statement in the March 14, 2019 Notice that he "observed unauthorized fill" on March 14, 2019 is misleading. The Town was aware of the remedial actions to the Property since September 2017. At a October 4, 2017 Town Commission Meeting, former Town Manager Valerie Oakes gave public reports of having knowledge that the Town knew of all activities on the Property. The late mayor, Mr. Feldman, also affirmed knowledge of the activities in various comments. 6. On October 4, 2017, Ms. Oakes confirmed that the Town received a complaint and sent it to the Florida Department of Environmental Protection ("FDEP"), thereby accepting FDEP jurisdiction. If the Town contends that the activity required its own jurisdiction, a code inspection report and a violation notice should have been issued immediately after the complaint made by Mrs. Mendelson in September 2017. 7. The Violation contends that a building permit will be required and constitutes a violation of code 30-122(A). However, since there is no construction ongoing on the Property, the proposed actions to correct an alleged violation of the Code are invalid and premature. 8. The actions required to correct the Violation ("apply for, and obtain permit for removal of unauthorized fill of protective wetlands"), would exacerbate rather than remedy the situation. As stated above, Hurricane Irma uprooted vegetation and altered the topography of the Property, exposing soils that consisted of construction debris from the 1970s. Golden City cleared and regraded the area of dead vegetation to remove the danger to the Toscana South and maintain the aesthetics of the Property for the Town. The Town is requesting that Golden City apply for and obtain a permit to remove the fill. However, what happens after the fill is removed? Presumably the Toscana residents will not appreciate an unearthed area of soils consisting of construction debris, which will create blight and a saftety hazard. Will the Town require Golden City to obtain an additional permit to refill and regrade the area? These are issues that should be addressed before the Town makes any determination on this Violation Notice. 9. The Town lacks jurisdiction to require restoration both under Florida \and Federal law. The Town is attempting to regulate the same activity on the same 0.1 acres of alleged mangrove wetlands fill ("Mangrove Wetlands Area") covered by the SFWMD Notice of Violation and subsequent consent order. However, under the Mangrove Trimming and Preservation Act, the State preempts the regulation and licensing of mangrove trimming and gr GOLI)EN CITY HIGHLAND BEACH nir-rc NE, PI"' i-I:s'i i .fit MCAT!!.E 111-0 removal, unless the local government is delegated the department's authority under the act. Fla. Stat §403 9321-403.9334. Since the Town has not been delegated the authority by the State of Florida to regulate and enforce the trimming and removal of mangroves, the Town has no authority to regulate or require permits over the Mangrove Wetlands Area. 1 is. If the Town contends that the activity was 'unauthorized."the Town should have recommended a remedy to regulate the activity under it's code. The Town's failure to recommend a fair and measurable regulatory standard contributes to the fact that the Town is actively pursuing discriminatory and selective enforcement against Golden City. 11 The Town definition of the violation is unclear, ambiguous and vague. The Town contends it 'observed unauthorized fill..."as the basis of the violation. To invoke a violation ;1 under 30-122(A) a notice of violation should have stated something like "work was performed t without a permit." yet the notice of violation falls shod of making this claim as all activities were permitted by Town officials. 12. On January 22, 2018, the SFWMD issued a Notice of Violation, a copy of which is enclosed herein as Exhibit A, in which-SFWMD asserted jurisdiction to address what it identified as: 1. The filling of approximately 0.1 acres of mangrove wetlands near the northeastern corner of the above reference property. 2. The removal of mangrove vegetation from the 0.1 acre of mangrove wetlands that were filled during the above referenced activity. Paragraphs 5 and 6 of the Consent Order set forth SFWMD's jurisdiction for ordering Golden City to remove fill and regrade the 0.1 acres of -mangrove wetlands ("Mangrove Wetlands Area")to the proper elevation: 5. The District has jurisdiction overRespondent, the Property, any stormwater management system, and all works, and maintenance activities conducted on the property. Sections 373.06 9(2)(e), 373.413, 373.414 and 373.416, Florida Statutes. 6. The District has been delegated the authority to regulate mangrove trimming and alterations pursuant to Section 403.9324, Florida Statutes, as outlined in the District's Order of Delegation dated January 29, 1996 attached and incorporated as Exhibit B. 2. The Town Was Aware of and Authorized Golden City's Emergency Activities to the Subject Property in September 2017 In its Violation Letter,the Town asserts that it"[o]bserved unauthorized fill of protected wetland area" when it conducted an inspection of the Subject Property on March 14, 2019. However, the Town had been aware-of the emergency remedial measures carried out by Golden City since September 2017, when Hurricane Irma uprooted Australian Pines and threatened the Toscana Property. In fact,the Town authorized Golden City to perform emergency remedial measures to the damaged portion of the Subject Property in order to prevent additional trees from falling and further endangering the Toscana Property. April 5,2019 Page 3 The emergency remedial actions taken by Golden City were necessaryto-addressthe damage caused to the Subject Property by Hurricane Irma When the Australian Pines were uprooted from the Subject Property by Hurricane Irma, it impacted the surrounding mangroves and wetland area. Specifically, when the Australian pines fell, they damaged adjacent mangrove trees and altered the topographic features-ofthe area due to the wind uprooting and unearthing the pines vast lateral root system. Since most of the upland soils were construction debris dating back to the 1970s, once the soils were unearthed by Hurricane Irma, they rolled towards the lower elevations due to gravity, creating topographical anomalies on the Subject Property which had to be remedied. Golden City initiated the emergency remedial measures within ten days of Hurricane Irma making landfall at the request of the Town. Town officials inspected the Subject Property on multiple occasions and were in daily communication with representatives of Golden City throughout this process. At no point did any Town officials object to any of Golden City's emergency remedial activities or demand that Golden City obtain a permit prior to removing the damaged trees and vegetation or remediating the damaged area with fill. 3. The Town's Violation Letter Obstructs Golden City's Ability to Comply-with SFWMD's Consent Order Aside from lacking jurisdiction, the suspicious timing_of the Town's Violation Notice unduly prejudices Golden City.As detailed above,the Town was aware of the purported violation to the Subject Property since September 2017, yet waited more than a year and a_half — until after SFWMD issued its Notice of Violation and after SFWMD and Golden City entered into a Consent Order—before issuing the Notice of Violation. The Town's delay in issuing its Violation Notice effectively thwarts Golden City's ability to comply with the Consent Order.Specifically,the Consent Order requires-Golden City to remove all fill and regrade the Mangrove Wetlands Area within 30 days-of SFWMD's approval of the staked wetland line. The SFWMD approved the staked wetland line on March 21, 2019. Thus, in order to comply with the terms of the Consent Order, Golden City must remove ail fill and regrade the Mangrove Wetlands Area by April 20, 2019. However, Golden City cannot meet this deadline if it must first apply for and obtain a permit from the Town. Accordingly, the Town's Violation Letter obstructs Golden City's ability to comply with the terms of the Consent Order. Because the Town was fully aw-are of the emergency remedial actions taken by Golden City, but never objected to Golden City's actions or demanded that Golden City obtain a building permit prior to carrying out the emergency remedial actions,the Town is estopped from now asserting these purported violations more than a year and a half later, especially since Golden City is prejudiced by the Town's delay in asserting these violations. LLC, Respondent, CONSENT ORDER This Consent Order is entered into between the Complainant, South Florida Water Management District( District'),and the Respondent, Golden City Highland-Beach, LLC. ("Respondent") by=mutual consent, who agree as follows: FINDINGS OF FACT 1. Respondent neither admits nor denies, but for purposes of this agreement does not contest, the following facts stipulated to by the District and Respondent: The District, a government entity created under Chapter 373, Florida Statutes, is a multipurpose water management district with its principal office located at 3301 Gun Club Road, West Palm Beach, Florida 33406. 2. Respondent is a person within the meaning of Section 373.019(15), Florida Statutes. Respondent's mailing address is 20725 NE 16th Avenue, Suite Al, Miami, FL 33179. 3. Respondent owns property-with Parcel Identification Number 24-43-47-04- 00-001-0030; located in Section 04, Township 47 South, Range 43 East; Palm Beach County, Florida-("Property"). The Property is shown on-the location map attached and incorporated as Exhibit A._ 5. The District has jurisdiction over Respondent,the Property, any stormwater management-system, and all works, and maintenance activities conducted on the properly. Sections 373.069(2)(e),373.413, 373.414-and 373.416, Florida Statutes. -6. The District has been delegated the authority to regulate mangrove trimming and alterations pursuant to Section 403.9324, Florida Statutes, as-outlined in the Districts' Order of Delegation dated January 29, 1996 attached and incorporated as Exhibit B. 7. On February 20, 2014, Respondent applied for a Formal Wetland Delineation pf the Property. On October 14, 2014, the District issued Formal Wetland Delineation 50-00012-F, attached and incorporated as Exhibit C. August 23,2018 Page 2 of 18—COST CODE 11203 Long Form Consent Order(7119117) 8. On December 12, 2017,an inspection by District staff identified unpermitted clearing and filling of approximately 0.1-acre of mangrove wetlands near the northeastern corner of the Property, within the area previously delineated-as a_wetland in Exhibit C. 9. On January 22, 2018, a Notice of Violation ("NOV") was issued to the Respondent for the-activities described in Paragraph 8 above. 10. Respondent ceased-the activities described in the violation. 11. On March 21, 2018. Respondent submitted Environmental Resource Permit Application Number 180321-409 addressing the violations described in Paragraph 8.. 12. By entering into this Consent Order, Respondent provided the District with reasonable assurances of good faith and the District.agrees,at this time,not to initiate an enforcement action forthe violations described above. Respondent agrees that all factual and legal claims, providing sufficient legal basis for this Consent Order, including all terms, provisions and matters referred to in the "Findings of Face and "Conclusions of Law" sections,must not be contested in any subsequent legal proceeding which may-be brought to enforce the terms of this Consent Order. CONCLUSIONS OF LAW 13. As provided in Rule 62-330.020, Florida Administrative Code, and Sections 373.413, 373.416, and 403-9321 —403.9333, Florida Statutes, the District is authorized to require permits for the construction,alteration,operation,or maintenance of stormwater management systems or works including activities that impact wetlands and trimming & alteration of mangroves. When issuing Environmental Resource Permits, the District is authorized to impose reasonable conditions necessary to assure that the activities will- August illAugust 23,2018 Page 3 of 18—COST CODE 11203 Long Folin Consent Order(7/19117) comply with the provisions of Part IV of Chapter 373, Sections 403.9321 — 403.9333 Florida Statutes, and its-corresponding rules. The activity must-also not be harmful to-the water resources of the District. 14. The District finds that Respondent violated Sections 373.413, 373.416, and 373.430(1)(b), 403.161(1)(b), and 403.9328(1), Florida Statutes, and the corresponding rules by not obtaining an Environmental Resource Permit prior to the construction or alteration of any stormwater management system, dam,-impoundment, reservoir, appurtenant work, or works and a Mangrove Alteration Permit to authorize the mangrove alteration. 15_ The-District is authorized to initiate and maintain legal action to enforce its rules, permits, and-orders, or to protect and preserve the water resources of the state as provided in Section373.129,_Florida Statutes.The District may recover a-civil penalty for each offense in an amount not to exceed $10,000.00 per offense. Each additional day during which such-a violation occurs will constitute a separate offense. The District may further recover investigative costs, court costs,and reasonable attorney's fees. 1.6. Section 373.083, Florida Statutes, authorizes the District to enter into agreements. THEREFORE, having reached resolution of this matter, the District and Respondent mutually agree, and it is ordered: ORDER 17. Within 14 days of the effective date of this Consent Order,Respondent must pay the District a total of $14,200.00 in civil penalties and-costs for settlement of the allegations made in this Consent Order. Within 90 days-of the effective date of this Consent Order, Respondent shall have a Professional Surveyor stake the portion of the wetland line ("Jurisdictional Determination of Wetland Delineation"), as depicted in Exhibit C, Page 11 of 13, that exists on the northern and eastern sides of the Wetland Restoration Area, as shown in the-Wetland Restoration Area Map,attached and incorporated as Exhibit 0, Respondent shall notify the District once the wetland line-tins been staked: to schedule a site: visit of the Property by contacting Gregory Vazquez, Environmental Analyst-4 by phone at 561- 826053 or via email at pvazduezatsfwmd.00v, District staff must review the staked- -wetland line to determine if the-staked line accurately represents the wetland line shown in Exhibit C,Page 11 of 13. Respondent must correct any deficiencies,as noted by District staff, in the staked wetland during the site visit. After the District determines the staked wetland line is acceptable,the District will-provide written approval of the staked wetland lure to the Respondent The wetland line stakes must remain in their surveyed locations until all activities noted in Paragraphs 19 - 23 have been complated and approved by District staff. August 23, 2018 Page 5 am--COST CODE 11203 Long Form-Consent Order(7/19/17) 19. Within 30 days of the District's approval of the staked wetland line, Respondent must remove alt fill from the Wetland Restoration Area and regrade the Wetland Restoration Area to its previous elevation noted in Exhibit C, Page 11 of 13. 20, After all fill has been removed and the Wetland Restoration Area has been regraded to the proper elevation, Respondent must submit an as-built survey to the District contact_listed-in Paragraph 18, signed and sealed by a Professional Surveyor. The as-built survey must show the final elevations of the Wetland Restoration Area within 60 days of the District's approval of the staked wetland line. All elevations in the survey shall be based-on North American Vertical Datum 1988(NAVD-88). 21. After all activities in Paragraphs 19 and 20 have been completed, Respondent must schedule a-site visit with the District by-contacting-the District staff member-listed in Paragraph 1-8. The purpose of the site visit is to inspect the Wetland Restoration Area to determine if all fill has been removed and if the correct elevations have been achieved. If deficiencies are noted by District staff, Respondent shall have 80 days to correct any deficiencies prior to re-inspection of the Wetland Restoration Area by District staff. After the District determines that aii fill has been removed and that the- Wetland Restoration Area has been graded to the proper elevation, the District will provide written approval of the fill removal and regrading activities to the Respondent. 22. Mangrove vegetation existed within and- adjacent to the Wetland Restoration Area. Mangrove vegetation is protected by the Mangrove Trimming and Presentation Act.Sections 403.9321 -403.9333, Fla. Sta. Mangrove vegetation must not be impacted during the fill removal or regrading activities listed in Paragraph 19. Any impacts to mangrove vegetation will constitute a violation of this-Consent Order and/or August 23,2018 Fam Conserv{�rdes(7t19f'7} Page 6 of 16—COST CODE 112113 Long the Mangrove Trimming--and Preservation Act. Mechanized equipment must not operate in wetland areas outside of the Wetland Restoration Area. 23. Within 5 days of the District's concurrence that alt fill has been removed from the Wetland Restoration Area and the correct elevations have been achieved, Respondent must stabilize all upland areas, adjacent to the Wetland Restoration Area. with sod to prevent erosion. 24. Within 30 days of the District's concurrence that all fiB has been.removed from the Wetland Restoration Area and the correct elevations have been achieved, Respondent shall submit-a Time-Zero monitoring report to the District. The Time-Zero monitoring report must be submitted via U.S. Mail to Gregory Vazquez, Environmental Analyst 4, Environmental Resource-Bureau,3301 Gun Club Road,West-Palm_Beach; FL 33406. Respondent shall includethefollowing information in the Time Zero monitoring report: a) Project Name:Golden City-Highland Beach,Code Number 11203; b) Title of the report:Time-Zero Monitoring Report; c) Name of property owner, address,county, and Parcel Control Number, d) A narrative explaining-how and when all activities listed in Paragraphs 19 and 23 were completed; e) Color photographs from fixed reference points as identified on-Exhibit D which accurately depict site conditions; 25. After the wetland restoration activities listed in Paragraph 18-24 have been completed, Respondent must conduct maintenance and monitoring within the Wetland Restoration Area for a period of 5 years. During the 5-year maintenance and monitoring August 23,2018 Page 7 of 18—COST CODE 11203 Long Form Consent Order(7119'17) period, Respondent must treat all exotic vegetation listed in the Florida Exotic Pest Plant Council 2017 List of Invasive Plant Species, attached and incorporated as Exhibit E, in the Wetland Restoration Area with an herbicide approved tobe used in wetland environments.The Wetland Restoration Area must have 0% cover of exotic vegetation after each maintenance event Exotic and nuisance vegetation must not exceed 5%cover between maintenance events- The Respondent must also remove all manmade debris and garbage from theWetlandRestoration Area as part of this site's regularly scheduled maintenance events. Respondent must conduct at least 1 maintenance event that includes exotic/nuisance vegetation treatment and debris removal before each monitoring report is due.The 5-year monitoring period is further described in-Paragraph 26. 26. The purpose of the-monitoring reports is to document_the maintenance activities conducted in the Wetland Restoration Afea and to- record the percent coverage of native, desirable wetland (obligate and facultative wet) vegetation naturally recruited or planted in the Wetland Restoration Area, During the first 2 years of the maintenance and monitoring period, Respondent shall submit semi-annual monitoring reports (a total of 4 reports) to the District. During the final 3 years of the maintenance and monitoring period, Respondent must submit annual monitoring reports (a total of 3 reports). All potential jurisdictional areas were reviewed in accordance with Rule 62-340 F.A.C. The parcel is dominated by mangrove wetlands contiguous with mangrove wetlands extending offsite to the north and south.A narrow upland strip extends from the northeastern comer of the property and along the eastern boundary to the extreme southeastern corner of the parcel A very small upland fill pile dominated by seagrape and Australian pine is located along the north central property boundary. The westernmost portion of the property is open tidal waters adjacent to the Atlantic Intracoastal Waterway. A previous application submitted in 2007 for a Formal Wetland Determination on the subject property (Application No.070824-11)was withdrawn in 2009. Wetland Description: The wetland system that includes the subject parcel and the adjoining wetlands is a remaining portion of the historic mangrove forest that bordered the Atlantic Intracoastal Waterway (AICW) in this vicinity. The parcel is almost entirely mangrove swamp wetlands, characterized by a dense canopy of mature red mangroves (Rhizophora mangle) and black mangroves (Avicennia ger limns), with scattered seaside mahoe trees (Thespesia populnea), an invasive exotic. A narrow fringe.of uplands occurs on suped higher elevations associated with SR AMA road. right-of-way development and historic fill piles, dominated by Hawaiian half-flower (Sceevola taccada), Brazilian pepper (Schinus terebinthifotius), Australian pine (Casuarina sp.)and cabbage palm(Sabal palmetto)along the northeastern and eastern boundary,and extreme southeastern corner of the property. Soils on the site consist primarily of Wulfert and Durbin muck, tidal, (hydric)with the easternmost soils identified as Palm Beach-Urban land complex, 0 to 8 percent slopes. The-wetlands receive regular tidal flushing throughout the system, although topographic irregularities due to the historic ditching are present. Evidence of inundation and wetland hydrology, even in the slightly higher elevations, Include the presence of standing water, rafted debris; red and black mangrove seedlings, pneumatophores, abundant fiddler crab burrows and water stains at the base of trees consistent with tidal elevations. The wetland determination was established by the identification of a mangrove swamp in accordance with the definition in Subsection 62-340.200 (19), and the boundary at the uplands beyond the wetland was established by higher elevation,dominance by Hawaiian ha -flower, abundant burrows of land crabs (Cardisoma guarthumi) and absence of wetland vegetation and hydrologic indicators. Other surface waters are boated west of the western boundary of the wetlands.The other surface waters are open tidal waters adjacent to the Atlantic Intracoastal Waterway. Within 30 days of the District's approval of the staked wetland line, Respondent must remove all fill from the Wetland Restoration Area and regrade the Wetland Restoration Area to its previous-elevation noted-in Exhibit C, Page 11 of 13. 20. After all fill has been removed and the Wetland Restoration Area has been regraded-to the proper elevation, Respondent must submit an as-built -survey to the District contact listed in Paragraph 18, signed and sealed by a Professional Surveyor. [he as-built survey must show,the final elevations of the Wetland Restoration Area within 60 days-of the District's approval of the staked wetland line. All elevations in the survey shall be based on North American Vertical Datums 988 (NAVD-88). While SFWMD certainly has the authority to require Golden City LLC to remove the illegally placed fill in the wetland area,this area is in our jurisdiction and, as such, development review and permit issuance by the Town of Highland Beach is required prior to removal of the fill. The conclusions of this staff review must be presented before the Town Commission for consideration prior to permit issuance. Naturally,this process takes some time. I am curious as to where Golden City LLC lies in the timeline regarding your order. Have they received SFWMD approval of the staked line? And if so,what would be the consequence if Golden City LLC failed to remove the fill prior to the 30 day restriction? I can tell you that the placement of the fill was accomplished without review and permit issuance by Highland Beach, and there will be penalties from the Town concerning the same. And, if Golden City LLC removes the illegal fill without a permit issued by Highland Beach,the penalties for unpermitted development in this case will be severe. it is-not my intention to levy severe penalties, but my duty regarding the ordinance does not allow me to ignore the requirement. 1 I need to know that we can cooperate in this effort so that SFWMID is satisfied that the wetlands are restored according to District standards, and that our interests as a Town are served simultaneously. None of the representatives of these agencies told me that they authorized or requested you to clear and place fill on your property.The following is a summary of those conversations: • The Town of Highland Beach told me that they requested you to cut back the Australian pine trees that fell over the fence onto the property to the north of yours.They did not request the filling or the clearing of vegetation on your property. After they became aware of your intended plans, they asked you about the legality of placing the fill in the wetlands on your property. • The Florida Department of Environmental Protection's (FDEP) involvement was limited to a complaint inspection and the issuance a Warning Letter which was later rescinded after FDEP realized your property falls under the jurisdiction of the SFWMD. • Trisha Stone's email that was referenced in your letter was sent to all environmental consultants she has previously worked with.This email was sent for informational purposes and was only meant to let environmental consultants know of the existence of the Emergency Order.This email did not authorize the work performed on your property;Trisha Stone was not familiar with the recent clearing and filling activities on this property nor coordinated with anyone from your property regarding these recent activities. • Caroline Hanes was the SFWMD permitting staff member that met with you and your consultant at your property on October 11, 2017. It was during this meeting that Caroline observed the unpermitted activities and later reported them to SFWMD compliance & enforcement staff. I have also had the chance to look at the emergency order again. I did not find anything in the Environmental Resource - No Notice Required section (C2a) that authorizes mangrove alteration or dredging& filling of wetlands by non-government entities.There are provisions in the Emergency Order that allow mangrove 1 r alterations and wetland dredge &fill activities to occur for specific reasons listed in section C2b(1) of the Emergency Order.These provisions require a Field Authorization be issued prior to these activities commencing. I looked in our records and the FDEP's records to see if a Field Authorization was issued authorizing the mangrove alterations or the wetland filling activities; I was not able to find any Field Authorizations for this property.The recent activities on your property also appear to exceed the scope of the Emergency Order and would not have qualified for a Field Authorization if one was requested. For the above reasons, the SFWMD intends to issue a Notice of Violation (NOV) to Golden City Highland Beach, LLC for the unpermitted filling of wetlands and the unauthorized mangrove alterations.This NOV will be sent via U.S. Mail and email.The NOV is being issued based on the information currently available to us. If additional information can be provided to the SFWMD showing a violation has not occurred, we would be more than happy to review it. Respondent failed to comply with the Code requirement by the date indicated in the Notice of Violation (May 16, 2019), and the Town issued a Notice to Appear—Notice of Hearing dated June 21, 2019. 4. Respondent was not in attendance but was represented by legal counsel. 5. All required notices were served in compliance with Section 162.12,Florida Statutes,and Section 2-106 of the Town Code of Ordinances. 6. The testimony and evidence presented at the hearing demonstrated that the violation remained on the Property as of the date of the hearing. CONCLUSIONS OF LAW 1. By reason of the foregoing, Respondent is in violation of Section 30-122(a) of the Town Code of Ordinances and is therefore subject to the provisions of Article V, Chapter 2, of the Code of 1 Ordinances of the Town of Highland Beach, under the authority of Chapter 162 of the Florida Statutes, as both may be amended from time to time. 2. Respondent remains in violation of the Code section cited above. COMPLIANCE 1. IT IS HEREBY ORDERED that Respondent shall comply with the above section of the Town of Highland Beach's Code of Ordinances as follows: a. Respondent shall apply for a building permit within thirty (30) days of the date of this Order. Upon compliance, Respondent shall notify the Town's Code Compliance Officer. b. Should Respondent fail to bring the Property into compliance by the date specified above, a fine in the amount of$250.00 shall be assessed against Respondent for each day the Property remains in violation past the date set for compliance. c. Should Respondent violate the same code section cited herein, such reoccurrence may subject the Respondent to a repeat violator fine of up to $500.00 per day for every day of violation, plus administrative costs in enforcing the action, pursuant to Chapter 162, Florida Statutes. 3. Respondent may submit a written request for a hearing to challenge this Order prior to its recordation as a Lien provided the Respondent does so within thirty(30)days from the date of this Order. If Respondent fails to comply with the Town Code within specified deadline and timely request such a hearing in writing to the Town,the Town may record a certified copy of such Order in the Public Records of Palm Beach County, Florida, and thereafter the Order shall constitute a Lien against the real and/or personal property owned by Respondent.
