ti. SPECIAL MEETING
MINUTES: HIGHLAND BEACH TOWN COMMISSION SEPT. 27, 1965 7:OOP. M.
• A meeting called by Mayor Hackman to confer with Town Attorney Donald Reed, Jr.
relative to procedure on the bond issue. All`Commissioners and Town Manager Dailey
were present .
Attorney Reed gave all Commissioners a copy of a prepared resolution #132 captioned;
"A RESOLUTION PROVIDING FOR THE CONSTRUCTION OF ADDITIONS, EXTENSIONS
AND IMPROVEMENTS TO THE WATER SYSTEM OF THE TOWN OF HIGHLAND BEACH.
FLORIDA AND THE REFUNDING OF OUTSTANDING WATER OBLIGATION; PROVIDING FOR
THE PAYMENT OF PART OF THE COST OF ACQUISITION OF THE TOWN HALL; PRCQ1rTlDING
FOR THE ISSUANCE OF GENERAL OBLIGATION BONDS TO FINANCE THE SAME AND ORDER-
ING AND PROVIDING FOR A BOND ELECTION ON THE APPROVAL OF SAID BONDS. "
During a discussion period, Attorney Reed explained, advised, and commented on all
the requirements and legal details .
Resolution #132 was approved and adopted by the unanimous vote of all Commissioners
and is included as a part of these minutes .
Attorney Reed also gave all Commissioners a copy of a prepared. notice captioned:
"NOTICE OF BOND ELECTION IN THE TOWN OF HIGHLAND BEACH, FLORIDA., ON
NOVEMBER 2 , 1965" , which he explained was also a requirement , with the resolution,
• for newspaper publication. This notice is also included in these minutes.
After thanks to Attorney Reed, and a short discussion on carrying out his suggestions
and instructions, the meeting adjourned at 8:45 PM.

A RESOLUTION PROVIDING FOR THE CONSTRUCTION
OF ADDITIONS, EXTENSIONS AND IMPROVEMENTS TO
THE WATER SYSTEM OF THE TOWN OF HIGHLAND
BEACH, FLORIDA, AND THE REFUNDING OF OUT-
STANDING WATER OBLIGATIONS; PROVIDING FOR
THE PAYMENT OF PART OF THE COST OF ACQUI-
S ITION OF THE TOWN HALL; PROVIDING FOR THE
ISSUANCE OF GENERAL OBLIGATION BONDS TO
FINANCE THE SAME, AND ORDERING AND PROVIDING
FOR A BOND ELECTION ON THE APPROVAL OF SAID
BONDS.
WHEREAS, the Town Commission of the Town of Highland Beach,
Florida, finds it expedient and necessary for the general health, welfare,
safety, and convenience of its citizens to construct additions, extensions
and improvements to the existing water system and to refund certain ob li-
gatians heretofore issued to finance the construction of water facilities;
and
WHEREAS, the Town Commission has heretofore acquired a new
Town Hall and has expended certain moneys in connection therewith; and
WHEREAS, the Town Commission contemplates financing such
construction and refinancing and to pay part of the cast of acquiring
said Town Hall by issuing general obligation .bonds of the Town of
Highland Beach, Florida; and
WHEREAS, it is necessary and essential to call a referendum
election submitting the issuance of such bonds to the approval or dis-
approval by the freeholders who are qualified electors and reside within
the Town;
NOW, THEREFORE, be it resolved by the Town Commission of the
Town of Highland Beach, Florida:
Section 1. That there is hereby authorized the construction
of additions, extensions and improvements to the existing water system
to include but not being limited to the construction of a water treatment
plant additions, water. supply additions and water storage and repumping
additions.
Section 2. That the outstanding water revenue bonds
of wY~ich $53,000 is presently outstanding are hereby authorized to be
refunded .
Section 3, That there is hereby authorized the issuance of
full faith and credit general obligation bonds in the aggregate principal
amount of nat to exceed two hundred sixty-nine thousand ($26g,0oo) dollars
to finance the construction of said additions, extensions and improvements
and to refund said outstanding obligations, which bonds shall be retired
by an unlimited ad valorem levy on taxable property located within the
Town of Highland Beach, Florida,
Section ~+. That there is hereby authorized the issuance of
full faith and credit general obligation bonds in the aggregate principal
amount of not exceeding thirty-one thousand 031,000) dollars to pay for
part of the cost of acquisition of the Town Hall and to reimburse said
Town for moneys heretofore paid by said Town for said acquisition,
Section 5. That a bond election is hereby ordered to be held
in the Town of Highland Beach, Florida, on the 2nd day of November ,
1965, to determine whether or not there shall be issued bonds of said.
Town in the aggregate principal amount of not exceeding two hundred sixty-
nine thousand ($268,000) dollars and thirty-one thousand (31,000) dollars,
respectively, bearing interest at such rate or rates, not exceeding the
legal rate, and to mature not later than twenty ( 20) years from the
date of issuance of said bonds, for the purpose of financing the con-
struction of said additions, extensions and improvements, of refunding
said outstanding obligations and for paying part of the cost of acqui-
sition of said Town Hall.
Section 6. The place of voting in said bond election shall be
as follows: Town Hall, Town of Highland Beach, Florida.

The polls will be open at voting places on the date of said bond election
from seven o'clock A.M. until seven o'clock P.M. on the same day. Only
the duly qualified electors residing in said Town who are freeholders will
be permitted to vote in said bond election; provided, however, that any
qualified electors residing in the Town who are freeholders may vote at
said bond election upon complying with the requirements of Section 100.2~F1
(2} (d), Florida Statutes.
Section 7. The Town Commission of the Town of Highland Beach
hereby designates and appoints the following inspectors and cler ks to
serve at said bond election;

Inspector: Mrs. Donald Ross - 4217 South Ocean Boulevard
Highland Beach, Florida
Inspector: Mrs. Sam Roth - 4112 South Ocean Boulevard

Inspector: Peter Guala - 4118 South Ocean Boulevard
Highland Beach, Florida
Inspector: Frank Howell - 4301 South Ocean Boulevard
Highland Beach, Florida
Section 8. If one or more of the above-named election clerks
shall be sick, disabled, or otherwise unable to serve at said bond election,
the person whose name appears as the inspector of such board immediately
following the designation of such clerk shall be and is hereby authorized
to act and serve as clerk, and if an inspector shall be sick, disabled,
or otherwise unable to act as clerk, the next person in order named as
inspector shall serve as clerk, and so on; and the person acting as clerk
of such election board shall be and is hereby authorized and empowered to
appoint from the list of qualified elector freeholders of the Town who
vote at such polling place such person or persons as may be necessary
to act as alternate or substitute inspectors to complete the personnel
of the election board and assure that there are acting one clerk and
three inspectors .of each such election board, the alternates or

substitutes to have the same qualifications as the person whose office
they fill. All other substitutions of election officials that may be
required shall be made by the clerk of the respective election boards
in accordance with the provisions of the laws of Florida, and necessary
action shall be taken to assure that any substituted election officials
shall be duly sworn before assuming the functions of his office.
Section 9. The Town Clerk of the Town of Highland Beach shall
prepare and give notice of the bond election above required by causing a
copy of this resolution, with an appropriate caption, to be published
once a week for four (~) consecutive weeks in the Boca Raton News, Boca
Raton, Florida , the first publication to be not less than thirty
(30) days prior to the date of said band election, The clerk shall
secure from the publisher of said newspaper an appropriate affidavit
of proof that said resolution has been duly published as herein set
forth, and said affidavit shall be made a part of the retard of this
Town Commission, In addition, the Town Clerk shall post a copy of
this resolution, with an appropriate caption, in at least ten (10)
different places in the Town at least thirty (30) days prior to the
date of such bond election, and the Town Clerk shall file in the records
of the Town a certificate showing the date and place of such posting.
Section 10. The vote at said bond election shall be by voting
machine and in each polling place there shall be at least one voting
machine. Paper ballots shall be used for absentee voting. It shall
be the responsibility of the Town Clerk of the Town to have prepared and
furnished to the inspectors for said election voting machines in such
numbers as shall be required to carry out the intent of this resolution,
and to have prepared and approved by the proper authorities and installed
in the voting machines such ballots or other data as shall be necessary
to conduct the election of the qualified electors residing in the Town
who are freeholders of the Town relative to the question whether the
issuance of general obligation bonds in the amount of 269,000 and
$31,000 respectively shall be approved to pay for the construction
of additions, extensions and improvements to the water system to refund

said outstanding obligations and to pay part of the cost of acquisition
of the Town Ha11.
Section 11. The election officials of each election board shall
make returns to this Town Commission as soon after the completion of
the election as is practicable. After said election, this Town Commission
shall hold a meeting for the purpose of canvassing the vote at said election, ~~
and determining, declaring, and certifying the results thereof.
Section 12. That the full faith, credit, and taxing power of
the Town of Highland Beach shall be pledged for the payment of principal
and interest on said general obligation bonds.
Section 13. The ballot to be used in said bond election shall
be in substantially the following form:

Shall the Town of Highland Beach, Florida, issue
general obligation bonds in the aggregate principal
amount of not exceeding $268,000 bearing interest at
such rate or rates not exceeding the legal rate, as
sha11 be determined upon the sale thereof, maturing
not later than twenty (20) years from the date of
said bonds, for the purpose of constructing additions,
extensions and improvements to the Town's water system
and to refund certain outstanding bonds heretofore
issued by the Town, the principal of and interest
on said ~269,00o bonds shall be payable solely from
ad valorem taxes levied on all taxable property in
said Town without limitation as to rate or amount,
all as provided in a resolution adopted by the
Town Commission of the Town of Highland Beach
on September 27 ~ 1965?

such rate or rates, not exceeding the legal rate, as
shall be determined upon the sale thereof, maturing not
later than twenty (20) years from the date of issuance
of said bonds, for the purpose of paying part of the

Florida and to reimburse the Town for moneys hereto-
fore paid for the cost of acquiring said Town Hall,
the principal of and interest on said X31,000 bonds
shall be payable solely from ad valorem taxes levied
on all taxable property in said Town without limitation
as to rate or amount, all as provided in a resolution
adopted by the Town Commission of the Town of Highland
Beach on September 27 , 1965?

Section 1~. That the Supervisor of Registration of Palm Beach
County is hereby requested to furnish to the election officials appointed
and designated by this resolution certified copies of the names of all
qualified electors vaho are freeholders residing within the Town of
Highland Beach for use by said election officials in the holding
and proper administration of said election provided hereby,

Section 15. Said election shall in all other respects be held
and conducted in the manner provided in and by the laws of the State of
Florida.
Section 16. This resolution shall take effect immediately.
