1973.02.03_TC_Minutes_WorkshopMINUTES: WORKSHOP MEETING OF THE TOWN COMMISSION - Februar 3, 1973 The workshop meeting of the Town Commission was called to order by Mayor Hort Saturday, February 3, 1973, at 9:45 A,M, In attendance were Mayor lIorton, ViEe Mayor Dent, Commissioners Gilday, Mumford and Town Administrator, Mrs. Roberts. Mayor Horton read a request from the Chairman of the Community Appearance Board, Mrs. Stewart, to approve the forms that will be given out to developers. These were discussed, The consensus was to study them further and invite Chairman Mrs. Stewart to a future workshop meeting. The Mayor also .read a letter from Vice Chairman, Mr. Tom Walsh, requesting the appointment of Mr. Don Rex as a regular member to replace Mr. Drewes and Mr, Earl Totz an alternate. Official action will be taken at the regular meeting February 6th. o ~.,~~~ Commissioner Gilday read two requests from the Police Chief - one, in regard to sick leave procedure and, the other one, asking for seven paid holidays a year. Suggestions were to further study this matter toward developing a policy with final recommendations. Commissioner Gilday, reporting on the 3200 case, informed the Commission that we have been advised by the Attorney that the Judge ruled against us in the rehearing and that Ordinances 132, 150 and 172 have been ruled invalid. Commissioner Gilday recommended taking an appeal, on the Attorney's advice, and asked that the Commission be prepared to vote on this at the next regular meeting, He further reported the Urbanek case is in limbo, Mayor Horton reported he had talked to Mr. Richard Rogers of Boca-Hi but there was nothing yet to report on the sewer situation, The Town Attorney sent a letter of • notification to the Highland Beach Utilities Company stating the company is in default of their Franchise agreement as of January 27, 1973. Discussion touched on pursuing this matter and taking legal action, a possible compromise, and amending the franchise agreement in the event of a successful negotiation, Regarding the Van Lennep suit, Commissioner Gilday reported the Town Attorney has moved to dismiss the case, He stated he will follow up with the Attorney Monday and report on Tuesday. Mayor Horton stated we haven't as yet received the report from the Planning Board, so will not be able to study it for the regular meeting on Tuesday. Mr. Horton said Mr. MacDonald, 'the Healy representative, had called him and said he will be attending the regular meeting and suggested the Commissioners could ask questions of him. The meeting adjourned at 12:00.
