• MINUTES: PUBLIC HEARING HELD April 26 1973 - 2.00 P M
This Public Hearing was called for the purpose of acting on recommendations of
the Highland Beach Planning & Zoning Board's recommendations set forth in their
letter-addressed to the Mayor and Town Commission of Highland Beach. Appropriate
notice was given of the hearing to be held in the St Lucy Church's Auditorium,
it was advertised on April 9 and April 20, in the Sun-Sentinel and the Palm Beach
Post Times.
Subjects for this hearing were:
1. Request by Healy, et al, to rezone Byrd Beach lots 1, 2, 3, 4, and la, 2a,
3a, 4a (Highland Beach lots 137 E, and W., 136 E. and W,, 135 E. and W., and
134 E, and W.) from RS 1 Single Family to RM 40 Multi Family,
2. Request by Mr. Faust, representing Spinnaker, Inc. to rezone lot 106a from
present RS 1 Single Family to RM 40 Multi Family.
3, Proposal to change minimum ground acreage required for RPUD zoning in all
RM Districts to eight (8) acres.
4. Proposal to change the LUI figure for RPUD zoning in RM 30 Districts to
LUI-59.
Present were all the Commissioners, the Town Administrator, Healy representatives,
• Messrs. Roy Simon, Architect, Wesley Carey, Attorney, Richard Mowry, Town Attorney
and several interested persons.
At the regular meeting of the .Town Commission held March 6, the above subjects
were discussed, representatives of the S. A. Healy Co. were present, they had
come from Chicago to present their views, and the actions taken at such meeting
were rescinded at the regular meeting of April 3, 1973, because due public notice
was not published.
With respect to item (1)., above, Attorney Wesley Carey gave a short presentation.
Roy Simon spoke briefly about this matter. Attorney Larry Alexander who was
representing Mr. William Baker, a property owner immediately south of the Healy
properties, also spoke briefly in support of the single family zoning in Byrd
Beach,
Commissioner Gilday moved the Town Commission uphold action taken by the Planning
Board and retain RS 1 Single Family Zoning in Byrd Beach. Commissioner Joy seconded
the motion, and the following voted yes: Mayor Horton, Vice Mayor Dent and
Commissioners Gilday, Joy and Mumford.
The petition to rezone lot 106a, which is owned by Spinnaker, Inc. was withdrawn,
Mayor Horton read correspondence from and to their Attorney, H, David Faust. These
letters dated April 17 and 19 requested the Town Commission to cancel the hearing
of their petition,
The proposal to change th_e minimtn round acreage, item (3), above,. was read and
,~ discussion followed. yor Horto moved to reverse the Planning Board action and
• offered the motion to re ain - /2 acres for RPUD zoning in all RM Districts.
Commissioner Mumford seconded and the following voted aye: Mayor Horton, Vice
Mayor Dent and-Commissioners Gilday, Joy .and Mumford.

• It was the unanimous judgement of the Town Commission that a developer should have
a chance to try a development of 2-1/2 acres in the Town,
With respect to item (4), to change the LUI figure for RPUD zoning in RM 30
Districts from 62 to 59, Commissioner Joy moved to deny the action of the
Planning Board and retain the LUI of 62 in RM 30 for RPUD zoning and Vice
Mayor Dent seconded, and the following voted yes: Mayor Horton, Vice Mayor
Dent and Commissioners Gilday, Joy and Mumford.
Discussion relative to this proposal and the action taken had the consensus of the
Town Commission that the LUI figure as stated in the Comprehensive Plan., should
be tried and no change be made at this time.
The hearing adjoured at 3:05 P.M.
