Mayor Horton called the workshop meeting to order at 7:35 p.m., and
all members of the Commission were present.
Mayor Horton suggested that the first item for discussion be the
consideration of proposed ordinance to amend Chapter 10, Fire Code,
and Ms. Roberts and Assistant Fire Marshall, Mr. de Clerq had been
requested to secure additional data for guidance of the Commission
prior to a final reading of the ordinance.
Ms. Roberts advised that information secured from Delray Beach for
similar requirements proposed in the ordinance were:
For item (a) 14' - vertical clearance, and
item (b) 24' - road width for fire traffic.
A lengthy discussion took place and various segments will be further
reviewed.
Mr. Baccari of Wiedersum Properties and Messrs. Shaw and Zebarth
were also in attendance and they jointly requested that the Town
Commission consider and give formal approval to their adjoining
for their seawalls, to the existing seawalls of Highland Tower
• and Penthouse Towers. It was understood that the Commission's
approval could only be given at .a regular meeting; however, they
would appreciate the consideration of this matter. A lengthy
discussion followed and it was pointed out that when the Seawall
ordinance was written, a situation of this nature was forseen and
it could be considered reasonable to approve such a request.
The Vice Mayor informed the Commission that a new public hearing
has been called for the consideration of the Wiedersum petition
being considered by the Board of Adjustment (December 27, 1973)
in order that interested residents be properly notified.
Mayor Horton then informed the Commission that Col Fran Johnson of
the Planning Board advised that pursuant to Legislature, Chapter
163.03 County Organization (under sub-paragraph 163.225 (2) (e)
thereof), stipulates that the Board of Adjustment shall confer with
the Planning Commission in all cases involving requests for special.
exceptions. It appears that the Zoning Code of the Town requires
correction to be consistent with this requirement. Ms. Roberts to
take appropriate steps to have the foregoing reviewed and corrected.
In the interim, the Vice Mayor will insure that the Planning Board
meets with the Board of Adjustment.
• Mayor Horton requested Ms. Roberts to present her findings as to the
areas of the Town which have no existing seawalls and that such
parcels are uncommitted. It was determined that approximately 3800'

of ocean-front property was in this category. After a lenghty
discussion, it was concluded that Dr. McAllister be invited to
• meet with the Commission and that the Commission further consider
the matter and the securing of an expert's opinion.
The members of the Commission requested information as to the present
expiration date of the Building Moratorium; i.e., December 16, 1973,
and it was the general opinion that this matter be pursued after
the receipt of and discussion of the Final Leary Report.
Mayor Horton discussed his letter to Mr. Walton as Chairman of the
Planning and Zoning Board which requests that committee to consider
the feasibility of purchasing property south of the Town Hall for
a Municipal Beach. When the decision of the Planning Board is received,'
the Commission will be apprised of the recommendations and consider ~
and/or take action in this matter.
Vice Mayor Dent responded to the request of the Mayor and gave a
dissertation of how he determined the gross population figures based
on present building plans of developers. The variance between
the Vice Mayor's computations and those of the Land Planner, Mr.
Leary, were summarized and the degree of difference is a small number.
The Commission then began discussion of proposed ordinances, all of
which have had a first reading (including the proposed amendment to
• the Fire Ordinance which was discussed earlier). They considered
the ordinance to designate Specimen and/or Historic Trees, an
amendment to Ordinance 213, and an amendment proposed for Seavaalls,
bulkheads and retaining walls.
It was determined that the lot owners of the Ficus and Coconut: Palm
Cluster should be advised of the pending ordinance prior to final
passage.
Discussion of the dedication ceremonies took place and the Commission
agreed to have the affair indoors and this matter will be so advised
to the residents.
Mayor Horton reviewed with the Commission salient points of his
conversation with John Klinck as to laterals of the sewer system
and informed the members of the Commission that Section I of the job
had no laterals. Section II, for which there was no bidding, did
provide for laterals. It was determined that the Commission may
meet again with Mr. Urbanek in the near future, matter not resolved.
