A special meeting of the Town Commission was called to order by Vice Mayor
Vedder in Mayor Horton's absence, on Tuesday, April 13, 1971 at 7:30 P. M.
All Commissioners were present except the Mayor. Also in attendance were
the Town attorney, several other attorneys, Townspeople, and a court reporter.
This meeting was called at the request of Vice Mayor Vedder, and Commissioners
Beekman and Jurisch for the purpose of discussing a request for an addition
submitted by J. J. Meadow for his residence at 4111 S. Ocean Blvd. (lot 42).
Mr. Shepard Lesser, an attorney representing Mr. Meadow, presented facts
and his interpretation of the zoning Ordinance. He introduced Mr. Joe Meadow,
presently residing at 1141 S. Ocean Blvd. in Delray Beach, who bought the
Highland Beach property in May, 1970. He also introduced Mr. Pat Lynch, an
architect retained by Mr. Meadow to draw up the plans for the addition.
The building permit was denied on February 24, 1971 at the recommendation
of the zoning committee because the set backs do not meet the zoning regu-
lations; the front set back being 16.52 feet from the AlA right of way, and
the north setback being 9.72 feet and the South setback being 10,01 feet.
Mr. Kemery, a member of the zoning committee recommended denial because the
plans indicate the addition could be used as a rental apartment with an
outside stairway.
Mr. Gavin Letts, an attorney repreS~enting Mr. F. H. Hahn, owner of the house
and property, which adjoins the Meadow house on the south, presented his
• views and imterpretation of the zoning Ordinance. Discussion followed.
The Vice Mayor asked. the Commission for their comments. The Town attorney
offered his advise and interpretation that the proposed addition would be in
violation of existing zoning. Comm. Hackman moved that Mr. Meadow be granted
a variance. .For lack of a second the motion died. Discussion followed.
As a result of the discussion, the meeting was recessed until Wednesday, at
3:30 so Comm. Jurisch could look into this further. Comm, Beekman moved to
~n~,~~ Vii, Comm, Jurisch seconded and the vote was unanimous. When the meeting
resumed on Wed. at 3:35 P. M. Vice Mayor Vedder, and Comm. Beekman and Jurisch
were in attendance. Comm. Jurisch stated he looked at the house and studied
the zoning Ordinance #132 further. As a result of this study, he moved to
deny the variance. Comm. Beekman seconded and the vote was three affirmative.
The meeting was adjourned at 3:45 P. M.
