• MINUTES: PUBLIC HEARING OF THE TOWN COMMISSION - January 17, 1974
Due Notice was given in the Boca Raton News on January 2, and January
11, 1974, that a Public Hearing would be held on January 17, at 9:30 a.m.
by the Town Commission of the Town of Highland Beach, such hearing
for the Commission to consider and/or take action deemed appropriate
or necessary regarding petitions of Oliver Hoffmann Corporation and
Boca-Hi, Inc. for Residential planned unit developments (RPUD).
At 9:40a.m., Mayor Horton called the meeting to order.
Present were: Mayor Horton, Vice Mayor Dent, and Commissioners Gilday,
Joy and Mumford.
The Mayor read into the record a letter dated January 16, 1974, a dopy
of which is attached as a part of these minutes, signed by Mr. Richard
B. Rodgers, President of Boca-Hi, Inc. In essence the letter was
submitted to serve as Boca-His guarantee .and surety. A letter from
Boca-Hi's attorneys, Scott & Dickinson dated January 15, also attached,
described the surety being offered.
The Mayor introduced Mr. Rodgers, who presented Boca-Hi's petition to
• the members of the Commission and to residents in attendance. He gave
a brief summary of Boca-H is history, changes in plans, and stated that
they felt their development met the "intent" of RPUD, reading into the
record, section 6.1 of the Town's Zoning Code, Chapter 30. Discussion
followed.
Mayor Horton read the Planning Board's Memorandum dated January 4, 1974,

The Mayor invited comments from residents in attendance. The record
will show several persons spoke for and against the project. Mr. Losee,
informed the Commission that he was speaking as President of the Highland
Beach Civic League and that 3 of the trustees of that organization were
in favor while 16 others were against. One of the trustees who had
voted against the proposal, in the audience, advised the Commission that
his objection was based on an incorrect concept of Section 5.5(e) of the.
Zoning Code.
Mayor Horton asked the Commission as to what action they preferred,
and it was the consensus that action be taken now.
Vice Mayor Dent offered the motion to approve the.. plans of Boca-Hi
• being considered, and Commissioner Joy seconded the motion.

Mayor Horton suggested that in voting, each Commissioner be polled
as to their vote. Voting in the following sequence, the record will
show a vote of approval by Commissioner Joy, Vice Mayor Dent, Commissioner
Mumford, Commissioner Gilday and the Mayor. Boca-Hi's RPUD plans "A"
Modified was unanimously approved by the Commission. The Mayor then
suggested a short recess.
When the hearing resumed at 10:45 a.m., in the Mayor's absence, the
Vice Mayor continued the Public Hearing and all other Commissioners
were in attendance.
Vice Mayor Dent read into the record, the recommendations of the
Planning Board regarding the proposed RPUD plans of Oliver-Hoffmann
Corporation for their project called the Ocean Harbour Club, such
recommendations are set forth in a Memorandum to the Commission dated
December 4, 1973, a copy of which is attached as a part of these
minutes of the hearing.
Mr. Paul Hoffmann summarized the various meetings held by the petitioners
with the Planning Board, the review of their plans by a Land Planner,
• brought in by the Planning Board to give his opinion and ensure that all
RPUD requirements were met, Mr. Smoot of Smoot Associates of Boynton
Beach and other boards of the Town. Mr. Hoffman stated that there will
be five highrises and one building-Tower to have three stories, plus
42 townhouses or a total of 846 units plus the utilization of 150 feet of
ocean property which will be ultimately be used by the condomin~.im owners
as a beach house. This structure will be erected to serve as a~model
and offices and later changed to the beach house. Mr. Hoffmann advised
that they are prepared to consider the sale of a 20ft. easement to adjoin-
ing property owners and such property will not be part of the condominum
complex. Such sale or other disposition of this easement is to be recorded
in the records as a definitive undertaking of the Oliver-Hoffmann Corp.
and Camille and Paul W. Hoffman., individually and/or severally pursuant to
Mr. Hoffmann's suggestion. Discussion followed the presentation given by
Mr. Hoffmann.
Commissioner Gilday offered the motion to approve this project pursuant to
the recommendations of the Planning Board which was subject to the
conditions enumerated and correctly stated in Oliver-Hoffmann's letter__of ~
November 9, 1973, copy of which signed by Paul W. Hoffmann s_.attached_
to these minutes, and that this approval also include all undertakings
made by Mr. Hoffmann in his presentation for approval. The motion was
seconded by Commissioner Mumford.
Before the vote was taken, Mr. Hoffmann assumed the members of the
Commission that requirements stipulated in section 6.4 (a) of the ,Q/
Town's zoning code and l~i.gal documents would be submitted. ~ ~i'

• It was suggested that the individual members of the Commission again
be polled as to their vote. The record will show that the following
voted Aye: Commissioner Mumford, Gilday, Joy and Vice Mayor Dent.
The meeting was adjourned at approximately 12:30 p.m.
