1974.01.18_TC_Minutes_Special • MINUTES: SPECIAL MEETING OF THE TOWN COMMISSION -_ January. 18,,_ 1974 Mayor .Horton, with all members of the Commission in attendance, called the meeting to order at 4:30 P.M. The meeting. was .called by Mayor Horton, Vice Mayor Dent and Commissioner Gilday. Mayor Horton stated that the purpose for the Special Meeting was to .consider and/or take any necessary action in regard to a Certificate of Occupancy (C~.) for the Highland Beach Ambassadors' recreation building across from the existing model, next to Seagate; and to also consider the non-performance by the Highland Beach Utility Company relative to the Sewer Franchise. 'Attached,~as part of these minutes, is a copy of Mr. Urbanek's letter ~1 dated January 17, 1974, which requests a C`O. and reasons therefor. Portions of this letter was read into the record by Mayor Horton and contents were discussed by the Commission and Mr. Totz, who was in attendance as representing Mr. Urbanek's interests. Mr. Totz stated their letter should have been more specific in stating that their intent was to trade use of facilities--new recreation building instead of existing model. • It was the opinion of the Commission that this matter be subject to further study. Commissioner Gilday offered the motion, seconded by Commissioner Joy that, motion, as amended, the request for a certificate of occupancy be tabled at~7, until such time as further information is gathered the existing`~line which is available for use (at the recreation building) be plugged. (This line has not been approved for usage by the appropriate parties.) Mr. Totz was advised that at this time there was no official sanction by the Commission for any usage for the recreation building. sewer) On January 18, Commissioner Joy stated, a meeting was held with the Town's Attorney, Mr. Sliney, Ms. Roberts and John Klinck of Russell & Axon. A visual inspection was made of the se~xer, system and a review of the Town's copy of the sewer plans. Attorney Sliney, in audience, advised the Commission that he had received a phone request to have a meeting with Mr. Urbanek with his legal counsel, David Faust, Esq., to discuss, on an informal basis, the performances required under the Sewer Franchise. • The general consensus was that the omission of laterals in the sewer system does not appear to be justified.
