At the request of the Mayor, Commissioner Joy spoke on the water problems
which existed today, April 29, from about 6:30 A.M. to 10:30 A.M.
Commissioner Joy advised that a temporary hook-up tripped a circuit
breaker and this. was at the Water Plant; however, the matter will be
resolved as Summers Electric is making a permanent installation. The
alarm which should have sounded when the water level fell below
four feet did not go off--alarm built into system where the pressure
gauges are maintained (behind police department) in the pump house.
He was advised by Mr. Arney that what would normally have been corrected
within the hour, took about four hours.
Mayor Horton suggested that it would be advantageous that if a similar
problem occurs in the future (Water Tank, not yet operational), the
Town should purchase 100,000 gallons from Boca Raton and get it into
the system thru the clear well at the well site.
• It was the consensus of the Commission that the best immediate solution
was to adopt the suggestion of the Town Administrator that personnel
of the Police Department be instructed to read the pressure chart and
the phone numbers where Jesse Arney can be reached at all times be
posted in the pump house. A letter will be sent to Seagate to have
several persons there advised that the Town Commission would appreciate
their calling Mr. Arney if the Seagate Alarm sounds, due to water pres-
sure problems.

Commission will not pursue matter at this time. The
Town Administrator to meet with Mr. Lanz and arrange

4-25-74 Mr. and Mrs. Frank Scofield, Jr. Their reply to the
Town's letter sent to all property owners in Byrd
Beach. (See Attachment "B"). Ms. Roberts sent
acknowledgement and will arrange to confer with them.
Commissioner Gilday advised that Attorney Klein has filed his reply
to the second Healy suit--to have action dismissed. The first Healy
suit, with three counts, is scheduled for trial in August, 1974.
In discussion, it was deemed advisable that if any parties in Byrd
Beach desire assistance, appointments be made and to include the Town
Attorney and Attorney Klein. The Highland Beach Civic League has
offered their assistance in this matter.
• Mayor Horton discussed a letter of April 25, from Bair & Abernathy
Associates of an unpaid bill for rendered services. The bill is to
be paid, under protest.
The Mayor read a letter from President Bennett of Seagate, they are
protesting the appearance of the Urbanek property south of that complex.
Ms. Roberts to write and see what can be done.
Fill land was discussed, Lift .Station No. 1, Lot 117. Ms. Roberts to
secure data as to what is being proposed by Corps of Engineers and
F.I.N.D, and advise the Commission.
Mayor Horton suggested that in the future, the policy for fill permits
should be revised so that all openings be blocked with plantings before
issuing fill permits.
The Town Administrator gave a report as to the status of Lauderdale
Contracting Corp.'s work (item 2 (b) on Agenda) and this matter was
discussed at length.
Ms. Roberts was requested to check chemical to be added to black-top
of bicycle path to preclude growing of weeds, etc.

Mayor Horton apologized for not calling on Col. H~azck, who addressed
the Commission regarding matters being.. discussed by residents of
Boca-Hi with Boca-H is management and his letter to Congressman Paul
Rodgers. He expressed his dissatisfaction with a letter sent by Mr.
Foster of our Building Department relative to this matter. It was
the consensus of the Commission that the Town Commission must not
get into the realm between buyers and sellers of Condominiums.
A second letter will be sent to Congressman Rodgers and Col. Ha~.uck was
assured that consideration would be given to his recommendation that
the Building Inspector's qualifications should include an Engineering
degree.
Discussion then took place regarding the pending elections and
swearing in ceremonies.
Item 3 of the Agenda, Emergency Moratorium Ordinance to be considered
at a later date.

Counsel advised Attorney Faust of Town's position
relative to .Laterals. (Mayor Horton will submit a report
in this matter in the near future.)
4-18-74 Representative Edmund S. Whitson, Jr., Clearwater, Fla.
Re: CS for HB 2657 and HB 3025. No action required,
matter was discussed.
4-19-74 Mr. G. R. Frost, Town Manager of The Town of Palm Beach
Copies of his letter furnished to all Commissioners,
no action.
Vice Mayor Dent discussed the Moratorium Variance Board Ordinance, as

amended, and suggested that an ordinance be prepared to complete any
unfinished business or building permits not issued for approved plans.
The Commission agreed, in principle, and .the Vice Mayor will pursue
this matter with Counsel.
Commissioner Mumford advised of her attendance to the Area Planning
Board's Recreation Meeting and that they discussed the five large
F.I.N.D. properties in the County.
Commissioner Gilday summarized the itinerary proposed for the meeting
of May 8 and that such meeting will be recessed until the Charter
Changes, adopted by the qualified voters, can be properly filed with
the Secreatry of State.
There was no other business for discussion and the meeting was
adjourned at approximately 10:40 P.M.
