MINUTES: SPECIAL MEETING OF THE TOWN COMMISSION, May 24, 1974
• At 10:05 A.M., Mayor Gilday called the special meeting to order.
Present were: Mayor Gilday and Commissioners ,,
Mumford, Joy and Clark.
(Vice Mayor Dent had resigned and this position is unfilled).
Mayor Gilday read the notice calling for the special meeting, see
Attachment "A'', which states the various purposes for consideration
and/or action(s).
Commissioner Mumford offered the motion to nominate Leslie W. Joy to
the office of Vice Mayor, stating his fine decisions and his serving
faithfully indicates this Commissioner spends a great deal of time on
the job and she felt he would be an excellent choice; Commissioner Clark
enthusiastically seconded the motion. Mayor Gilday and Commissioners
Mumford and Clark unanimously approved Commissioner Joy to fill the
unexpired term of the office of Vice Mayor and he was subsequently sworn
in.

• Mayor Gilday requested that the new Vice Mayor resign from the position
of Commissioner, (to which he was elected on May. 7, for a three year
term). Vice Mayor Joy formally resigned as Commissioner, this was
approved on the motion offered by Commissioner Mumford, seconded by
Commissioner Clark and all members of the Commission (excluding Vice
Mayor Joy) gave their approval.
For the Record: At this point due to a malfunction in the tape deck,
all of these matters and motions were repeated and taped, then the meeting
continued.
Recommendations of the Planning Board were read by Mr. Kemery. See
letters dated May 16, 21, and 23, 1974, marked Attachments "B", "C",
and "D", copies attached.
Mr. Kemery stated that there are approximately 50 amendments to the
Zoning Ordinance. The proposal creates a reduction in the density
figure to have a lower density, and there are important legal factors
involved in the density. "It is", he said, "a complete and professional
job".
Mayor Gilday and the Commission paid tribute to Mr. Kemery and to the
members of the Planning Board for the time spent in this difficult task.

Attorney Sliney suggested that in lieu of the zoning ordinance and
comprehensive plan being considered by the Commission it should be subject
to re-codification and the Planning Board also consider the ocean set
back. It was counsel's opinion that a Public Hearing(s) be held by the
Planning Board for such revision(s).
Vice Mayor Joy offered the motion to have the matter re-codified by
the Planning Board and that it hold public hearing(s) for this purpose,
Commissioner Mumford seconded, and Mayor Gilday, Vice Mayor Joy and
Commissioners Mumford and Clark all voted: Aye.
Chairman Kemery said he would be glad to cooperate, stating that, "When
you're in Zoning you lose all your friends and find all your enemies".
He expressed his thanks to Messrs. Wilcox and Boscove and to Ms. Roberts
for their efforts in this work.
The Acting Town Manager read excerpts from the Datagram and she will
further advise which items have not had personal opinion Telex messages -
tabled.
Commission advised of hospitalization insurance coverage, to be pursued.
• Ms. Roberts presented and explained bills to be approved and paid; and
she certified said bills were correct and proper.

At this point, Commissioner Mumford advised that the third building of
the Ambassadors is close to the seawall, balconies extending beyond sea-
wall. Matter discussed at length. It was the consensus of the Commission
that this matter be reviewed by Town Attorney, to ensure developer abides
with court order and laws in effect at such time (1971). Mr. Foster is
to give imput data to counsel for his opinion and fact findings. Ms.
Roberts read a memo from Mr. Joe deGange into the record concerning this
matter. See Attachment "E".
Discussion also took place as to Lot 109, filling required, due to removal
of vegetation. Mr. Totz advised he cannot do anything until seawall is
required--probably will correct this within 6 months.
Acting Town Manager advised that ads have been placed in various pro-
fessional publications to advertise for applications - Town Manager.
Ads have been placed in the Florida Municipal Record, Wall Street Journal,
New York Times, Sun Sentinal, Palm Beach Post and Miami Herald, etc.
The meeting adjourned at 11:00 A.M.
