1974.07.11_TC_Minutes_Workshop MINUTES: WORKSHOF MEETING OF THE TOWN COMMISSION - JULY 11, 1974 Following a Special Meeting held today, the Workshop Meeting began at approximately 3:30 P.M. Mayor Gilday, Vice Mayor Joy and Commissioners Clark and Bauer were present to meet and discuss problems of mutual interest and concern with Mr. Urbanek. The Town's attorney Tom Sliney was also in attendance. Ms. Roberts presented a summary of topics for discussion, see Attach- ment "A", copies were furnished to the Commissioners and used as a basis for the meeting. The Acting Town Manager's letter of June 26 to the Highland Beach Utility Company concerning the Bond rendered for the Sewer Franchise was dis- cussed at length. Ms. Roberts read requirements for the bond as stated in paragraph 8 of the Settlement Agreement of March 14, and June 18, 1973; whereas, Mayor Gilday read excerpts from a copy of the bond. A discussion as to whether the bond was a performance and/or payment bond took place. This matter will be subject to the review of councel who will report his findings to the Commission as to whether or not the Utility Company is in default an their contract. Mayor Gilday read into the record the letter of June 27, which was received by the Com- mission from Mr. Carl Krauss, Secretary of the Bel Lido Property Owner's Association. Mr. Urbanek was asked if he would consider enter- ing into a Legal Agreement, as well as giving bond relative to the Highland Beach Ambassador's proposal re; drainage for the run-off water from the Ambassadors South Condominium complex. There was no decision in this discussion, in fact, Mayor Gilday informed Mr. Urbanek that further discussion and/or disposition of this matter should be with benefit of a Public Hearing, the attendance of the Utility Company's Engineers, residents of Bel Lido, Town Counsel and the Commission. Mr. Urbanek asked why the matter of swap-offs was being brought up and this matter was discussed at length. Ms. Roberts read into the record her letter of June 18, which was addressed to the Department of Pollu- tion Control. A lengthy discussion took place as to the number of units (buildings) which could have permits issued for connections to the Interim Treatment Plant and/or the Town's sewer system. Ms. Roberts advised that a study is being made, and she will forward a recapitu- lation of data, showing in detail, existing buildings with the number of units thereof which are now on the system, proposed construction, location of sites, estimates of completion date and aggregate number of treated and/or untreated connections. Mr. Urbanek informed the Commission that if the proposed Delray Sewer System, projected to be available by 1977, is delayed to the degree that appears likely and the Town will need additional sewage treatment facilities, his company would view the matter favorably. Mr. Urbanek was informed of the proposed plans of Holiday Inn; he gave no opinion in the matter. I Page -2- MINUTES: WORKSHOP MEETING OF THE TOWN COMMISSION - JULY 11 1974 In responding to a question raised by Commissioner Clark, it was Mr. Urbanek's contention that with respect to his buildings meeting the requirements of the Southern Standard Building Code, the standards he is expected to meet are those which existed on March 2, 1971, and not any amendments since that time. Mayor Gilday expressed the opinion that the only compliance to the Southern Standard Building Code which was waived, was as to the time which the project had to be completed; and he felt Mr. Urbanek would otherwise be required to observe all requirements of the Southern Standard Building Code as well as any amendments thereto. With respect to the deficiencies advised in the seawalls which are being constructed across from Seagate, Mr. Urbanek assured the Town that he would not accept any shoddy building by the subcontractors. He urged the Commission to take issue with the subcontractors when they do not meet the building code requirements, and to inform him in these matters. Mayor Gilday advised Mr. Urbanek that Mr. Urbanek, had not submitted any definitive and/or consideration relative to the Fran Urbanek advised that he would be in touch could be scheduled in the near future and vised.
