1974.08.07_TC_Minutes_Special (2) MINUTES:S~ C1AL MEETING OF THE TOWN COMMISSION WITH MR. URBANEK - TUESDAY, AUGUST 7, 1974. • Mayor Gilday called the Meeting to order at 1:10 P.M. Present were: Mayor Gilday, Vice Mayor Joy, and Commissioners Bauer and Clark Mayor Gilday announced that this was a hearing called upon the application of the Ambassadors Corporation for providing for a drain to discharge ground water into the finger canals adjoining Bel Lido, see notice ~vr meeting, attachment "A". Attorney Gundlach, representing the Ambassadors Corporation, stated that the application had been filed in November 1973. Residents of Bel Lido, in audience, spoke and v©ieed objections to the proposed water drainage. Attorney Gundlach claimed that this would only be rain water and then Mr. Winton, of the Ambassadors Corporation, explained the course that such drainage would take to the finger canals. Commissioner Clark mentioned the fact that he had attended a Palm Beach County Area Planning Board Meeting where a similar matter was being • discussed and the Area Planning Board and their engineers were not disturbed about drain water going into Lake Wyman or into the Intracoastal. They did, however, question traps and catching the grease. Prolonged discussion took place regarding this subject. It was agreeable to all parties that the Town's Attorney upon return Monday or Tuesday (August 12 or 13, 1974), is to get in touch with Attorney Gundlach to discuss the wording of the Maintenance Agreement for the South sector. (See Attachment "B" for referenced agreement submitted - to be revised) Mayor Gilday suggested a recess and further study of the matter. Vice Mayor Joy stated he had discussed this with the Building Code Enforcement Officer (Mr. John P. O'Grady) who stated to him (the Vice Mayor) that the Engineering was proper. Vice Mayor Joy offered the motion that the drainage system be approved, subject to the approval and execution of the Maintenance Agreement -- the latter to provide an Easement to the Town for the necessary repairs which may be required in the future. Commissioner Clark seconded the motion. The record will show: Mayor Gilday, Vice Mayor Joy and Commissioner Clark voted Aye and Commissioner Bauer voted Naye in response to the question for this motion.
