GENERAL INFORMATION: HIGHLAND BEACH BUILDING DEPARTMENT 3614 S. Ocean Boulevard Highland Beach, FL 33487 Ph: (561) 278-4540 Fx: (561) 265-3582 Page 303 Request and Analysis: The Applicant is proposing to install a 20,000 pound capacity elevator style boat lift at the property located 4318 South Ocean Boulevard. According to the Applicant’s survey, there is an existing wood dock which will remain. The Applicant has obtained Florida Department of Environmental Protection approval (No. 50- 353668-003-EE). According to the Applicant’s FDEP approval, the proposed request does not require a separate permit or authorization from the US Army Corps of Engineers. Section 30-68(g)(6)d.2. of the Town Code states that accessory marine facilities (which includes boat lifts) located in Multifamily Residential zoning districts shall be exempt from side yard setback requirements. Section 30-131 of the Town Code provides the following definition of “boat lift:” Boat lifts means the bottom of the keel of any boat shall not be hoisted greater than one foot above the minimum seawall elevation. In no case shall the lift be higher than the superstructure of the boat when lifted. The proposed request is in compliance with the definition of boat lift. According to sheet DTL-1 provided by the Applicant, the top of the lift equipment measures seven (7) feet three (3) inches from the existing wood dock while the superstructure of the boat when lifted measures eight (8) feet eight (8) inches from the existing wood dock. Section 30-68(h)(1)a. of the Town Code, states that the installation of a boat lift shall be subject to special exception approval by the Planning Board at an advertised public hearing. Section 30-36(a) of the Town code states that if the Planning Board is the final authority on the special exception, then it shall approve, approve with conditions, or deny the application. Staff has reviewed the Applicant’s proposed request and finds that the project is consistent with the Town’s Code requirements and Comprehensive Plan. Staff recommends approval of the installation of the proposed 20,000 pound capacity boat lift subject to the following conditions and based on the plans date stamped received by the Building Department on July 27, 2020: 1. Following approval by the Planning Board and prior to initiation of construction, the Applicant will be required to obtain a building permit from the Town of Highland Beach Building Department. 2. Pursuant to Section 30-21(g) of the Town Code, commencement of construction shall be initiated within two (2) years following the date of approval by the Planning Board. Completion of all conditions of approval shall occur within two (2) years following the date of approval by the Planning Board. II.
