1974.10.03_TC_Minutes_Workshop MINUTES: WORKSHOP MEETING OF THE TOWN COMMISSION-OCTOBER 3, 1974. Mayor Gilday called the meeting to order at 1:00 P.M. Present were: The matters proposed for discussion are shown in the Agenda, Attach- ment "A". The Town Attorney was in attendance to advise the Commission with respect to the proposed agreements and the proposed Zoning Ordin- ance to be discussed,. The Declaration of Unity of Title, to be recorded, would preclude the sale of any portion of theproperty being covered by this agreement without knowledge of the Town. Members of the Commission suggested that pending construction, Mr. Urbanek be contacted as to securing his agreement to ~h~ve another-clause:inserted' which would require landscaping of areas pending construction. A question was raised as to who were the principals of the Drexel Properties and it was the Attorney's advice that this was Mr. Mangurian. The naming of all parties as shown in the agreement would be so indexed in the Palm Beach County records. With respect to the Agreement of Maintenance, several minor corrections were noted: Muniments was misspelled, and the phrase, "the entire pro- perty including the entire individual apartment units" which appears on page two, in several places, will be revised to read, "entire pro- • perty including all individual apartment units". The signature page is also to be acknowledged, therefore, it will be revised. The Com- mission was informed that the usage of the word, "Muniments" was to cover the issuance of proposed Bills of Sale, as well as customary Warranty Deeds. The signature page of this proposed agreement to also be revised. The Interim Sewage Plant Agreement was discussed at length. It was the opinion of the Commission that this proposed agreement will also require further changes to be negotiated with Mr. Urbanek. It was pointed out by Vice Mayor Joy that .this Agreement should not be effective until the Bonds are received and the Attorney's opinion as to their correctness and language meets all requirements. Copies of the proposed documents which shall be subject to further changes are attached as Attachments "B" thru "F". The Mayor and the Town Manager will be meeting with Mr. Urbanek on Friday, October 4. The Town's Attorney will-pursue changes in these proposed agreements, discuss these with Mr. Urbanek's lawyer, Mr. Gundlach and the Commissioners would receive revised copies at a later date. • , Mayor Gilday invited comments from persons in audience as to the pro- posed zoning changes as set forth in the proposed zoning ordinance. Page -2- MINUTES: WORKSHOP MEETING OF THE TOWN COMMISSION-OCTOBER 3 1974. The Chairman of the Planning Commission and Messrs. Boscove and • N.M. Johnson were in attendance. Chairman Kemery made a statement as to the work which was done in preparation of this proposed ordinance, and that the Town's early zoning of 70 units to an acre has had changes made since the initial review was done by Bair ~ Abernathy Associates. Col. Francis Johnson addressed the Commission as to what actions were taken to the suggestions made by the Civic League; that is, reductions in density, height, set-backs, etc. Further in the meeting, he enu- merated the desired changes: RM-2 be reduced from 20 Units to 15 Units; RM-2A he felt. this was a compromise, RM-3 for lots 118 thru 124 was reduced from 40 Units to 30 Units and should have been re- duced to still lesser density. He stated that ratios for density should have been reduced by 50•x, height limitations from 100 and 125 to 70 and 100, respectively, heights be restricted, without exception, the set-back of 30 feet be 50 feet (page 23, section 5.13 (b) (6) and that with respect to a limitation of RPUD developments, he stated the language should be revised and not be permissive but obligatory, as to period of availability for RPUD approvals. Throughout the meeting, the Mayor reminded persons voicing objections to the provisions in the Zoning Ordinance; that any suggested changes should have specific reasons that would enable the Commission to justify its considerations for adoption of such suggestions. The Town Attorney also gave his opinion • that unless there are good reasons for changes; viz., factual, the Zoning Ordinance which does not appear to please some persons is in his personal opinion, a good ordinance. He added that under Chapter 163, the Town is obligated to a yearly review of its Comprehensive Plan and unless changes are deemed necessary at this point, revisions should be done at the level of the Planning Commission and be referred to them for their subsequent review of the Plan. Commissioner Clark asked if the Easterly Survey Line was changed, that is making a "minor change of a "3" to "5" could such a change be considered minor in view of the impact thereof. It was the Counsel's opinion that the FAU Report was overstated and a prolonged discussion of the Easterly Survey Line with numerous statements being made, took place. It was the opinion of Mr. Boscove of the Planning Commission that the State's 50 foot was syn- onymous with the Town's 30 foot. Attachment "G", a letter from the State of Florida, Department of Natural Resources, dated June 10, 1974, was givan as his source for the stated opinion. Mr. N. M. Johnson, a member of the Planning Commission also gave a summary of changes that he desired and he stated there were other members who also desired the enumerated changes. His stated changes were simi- lar to those included in Col. Johnson's remarks. Mrs. Betty Jean Stewart of the Community Appearance Board addressed the Commission and gave a summary of desired changes and reasons therefor, MINUTES: i~iORKSHOP MEETING OF THE TOWN COMMISSION - October 3, 1974 attachment "H" is a copy of the data she furnished to each member of the Commission. Mrs. Roberts also advised the Commission of changes which she desired them to consider and proposed the proposed zoning ordinance incorporate these corrections and/or additions. The items suggested are listed in attachment "I" Mayor Gilday advised that another workshop meeting be considered for further discussion of the proposed zoning ordinance. The consensus of the Commission was that this would be desirable, the date was set for Tuesday, October 8 at 10:00 A.M. for the workshop. ~.^ The meeting was adjourned at approximately 3x0 P.M.
