1974.10.08_TC_Minutes_Workshop• MINUTES: Workshop Meeting of the Town Commission - October 8, 1974 At 10:00 A.M., Mayor Gilday called the meeting to order. In attendance were Mayor Gilday, Vice Mayor Joy, Commissioners Mumford, Clark and Bauer. Also in attendance were the Town's counsel and Town Manager, interested residents and members of the Highland Beach Civic League and members of the Planning Commission. Mayor Gilday advised of a letter received October 7, 1974, from the Civic League, copy of which is attachment "A", and he proceeded to read this letter to those in audience. After reading the first two paragraphs and their comments regarding the F.A.U. survey, the Mayor explained that the State's recently enacted legislation now requires a 50 foot set-back coastal line. The Mayor read, in its entirety, section 1 of Chapter 161.052 from the Florida Statutes. regarding the Beach and Shore Preservation Act. He also read into the record excerpts of data set forth in the Department . of Natural Resources'letter of June 10, 1974, copy of which is attach- ment "B". The Mayor advised that attached to this letter is a definition, "Definition of 'Vegetation Line'." At the suggestion of several members of the Commission, the definition was read. It was suggested that the Town's attorney be instructed to review and propose appropriate language for the Commission's review and consider- ation for adoption of the State's required setback of 50 feet in .lieu of the 30 foot ~~hich is in the proposed zoning ordinance. The Commission requested that the attorney's findings be available, if possible for the public hearing scheduled for October 15th. Discussion followed as to whether all new building would be required to follow such setback line. Commissioner Mumford read an article which appeared in the Sun-Sentinel on May 22, 1974, copy of which is attachment .. C.. . Chairman Kemeny spoke in justification of the Planning Commission's reasons for not making a change in setback requirements; however, he offered to assist Attorney Sliney in the proposed wording for the//Commission's consideration of a change in the setback line. Torn . The Mayor then continued reading the aforesaid Civic League letter. With respect to other objections regarding zoning, LUI's, etc., he WORKSHOP MEETING of Town Commission~_ October 8, 1974, page -2- ~ requested that these questions be discussed at future meetings of the Planning Commission and that any suggested revisions for zoning be substantiated. The Town's counsel added that their suggested zoning amendments and/or changes to the Comprehensive Plan should be reviewed by the Planning Commission and the Town is obligated to review the Comprehensive Plan, not less frequently than annually as zoning is an on-going study. With respect to a time limitation for RPUD projects, a prolonged discussion took place. While the proposed zoning ordinance gives the Town Commission the necessary mechanism for its determination on a case by-case basis, it was the consensus of the Town Commission that the attorney should also review this area and suggest appropriate language for the Commission's consideration. Mrs. Stewart was recognized and she questioned section 5.8, "Refer to Section 14.4 for a Certificate of Occupancy issuance before said temporary structure becomes occupied." Following a discussion of this point, the attorney was requested to also review this section as to a proposed language change for the Commission's consideration. Mrs. Stewart also questioned references to Private Clubs, definition appears . on page 3(c) and parking provisions therefor on page 13. Messrs. Hauck and Genovese then asked if Boca-Hi had effected substan- tial compliance with respect to building permits for its RPUD project. A prolonged discussion took place. It was the consensus of the Commissioners that this was a gray area that may need revision to provide a time limitation for securing a building permit but allow some discretionary power for developers as to completion of their projects. Matter also under advisement. The Mayor reminded everyone of the Public Hearing - scheduled to begin at 1:00 P.M. on October 15, 174, reading of the proposed Zoning Ordinance.
