MINUTES: PUBLIC HEARING (Special Meeting) - TOWN COMMISSION -
OCTOBER 15, 1974

At 1:05 P.M., the Mayor called the meeting to order.
Present were: Mayor Gilday, Vice Mayor Joy and Commissioners
Mumford, Clark and Bauer.
Mayor Gilday requested the Proof of Publication (due public notice).
(The ad was sent to Boca Raton News on September 24, and requested
publication dates of September 27 and October 8, 1974.) He was
given the Attachments "A thru C" which are respectively the Proof
of Publication of September 27 and October 9, the Town Clerk's
Affidavit of posting of Notices, and a copy of the Notice. The
Commissioners, and those in audience, were advised that these
exhibits would be appendices of these Minutes.
Mayor Gilday advised that reading("first reading") of the proposed
Zoning Ordinance would begin; however, he requested that any questions,
and matters to be discussed, be withheld until the ordinance was
completely read.
After the proposed Zoning Ordinance was read, in its entirety,
questions were directed to the Mayor and the Commission.
• Vice Mayor Joy inquired if and when changes, if any, would be
considered. It was the consensus of the Commission that the Town's
counsel have appropriate language available for consideration at the
Workshop Meeting scheduled for 9:30 A.M., October 29, at which time,
amendments, if any, would be considered.
Col. Hauck of Boca-Hi advised that while the Highland Beach Civic
League was cognizant of the work and efforts of the Planning Commission,
(speaking on behalf of the Civic League) he requested the record
be corrected to show that the Civic League does not approve of the
proposed zoning ordinance in all respects.
Mr. Wutt addressed the Commission on behalf of his client, Mr. Milani,
the owner of Town Lots Nos. 4, 5, 6, 9 and 10. He will summarize
the objections of his client as to the proposed zoning and submit
such findings in a letter to the Commission.
Other persons who addressed the Commission were Messrs. Morrison
and Gibson, and Mrs. Evelyn Houck, a property owner of lots in
Highland Beach Isles.
Mrs. Betty Jean Stewart, Chairman of the Community Appearance Board,
read a statement which proposes changes in the proposed zoning
ordinance, a copy thereof, is Attachment "D".

Col. Francis Johnson, of Penthouse Towers, also addressed the
Commission and requested that the Mayor read into the record the
letter submitted by the Highland Beach Civic League. (In this
letter the Civic League states its objections to certain provisions
of the proposed zoning. ordinance.) (Refer to Attachment "A" of the
Minutes of October 8, 1974 for the aforementioned letter which was
re-read into the record). In reading the letter, the Mayor
commented on certain points and such comments were similar to those
recited in the minutes for the Workshop Meeting of October 8, 1974.
Chairman Kemery of the Planning Commission also addressed the
Commission. He offered to meet with the Town Manager and the Town's
counsel and consult with them as to appropriate language to be
furnished by the Town's counsel to the Commission.
Discussion followed as to Section 2.5 of the proposed zoning ordinance
regarding distances on the official zoning map. Matter will be
reviewed with Town Manager, Town counsel and Mr. Kemery.
The Mayor answered other inquiries and announced that the Commission
would be reviewing the proposed zoning ordinance at the Workshop
• Meeting and persons who had any objections or suggestions should
plan to attend that meeting. He reiterated that these meetings
were being held so that persons could be heard and their viewpoints
expressed for consideration of the Town Commission. He advised that
a Special Meeting would follow this meeting.
