1974.11.04_TC_Minutes_Special • • r ~ U MINUTES: PUBLIC HEARING (Special Meeting - TOWN COMMISSION November 4, 1974. Mayor Gilday called the meeting to order at 1:00 P.M., for the record he advised that all members of the Commission: Mayor Gilday, Vice Mayor Joy and Commissioners Mumford, Clark and Bauer were present as well as the Town Manager, Town Clerk and the Town Attorney. Mayor Gilday requested the Proof of Publication and the Town Clerk's Affidavit, see attachments hereto which are an integral part of the record. He then advised the reading in full of the proposed Zoning Ordinance would begin, however, before such reading began, Col. H. A. Hauck, Secretary of the Highland Beach. Civic League, Inc. addressed the Commission and requested that his letter be read into the record. Mayor Gilday read into the record the contents of Attachment "F", the Civic League's letter of November 2, 1974. • Before the reading of the proposed Zoning Ordinance took place, Commissioner Clark asked the Town Attorney if the Index Pages had to be read in their entirety since the pages would not be the same when the ordinance is adop- ted and printed. It was pointed out that the ordinance to be read, in final form includes changes which had been discussed at the workshop meetings. A summary of the proposed changes which altered the text from the first reading which took place on October 15, 1974, are attached. In addition thereto, the following corrections were made in the final reading before adoption; note, these are listed in the order of page sequence rather than when the correction was noted in the reading of the text: The cover page to read: Town of Highland Beach, Highland Beach, Florida Zoning Ordinance. Page (b): Under 5.13 add, "(c) Requirements for Municipal Services- Page 23." Page (c): In the title of this section, line two, after, "RM",add, "RA". Page 2 paragraph 3, line two, the last word "matter" should be plural. Page 3(a), a suggestion of Mrs. Stewart was considered and approved as part of the changes; viz., in: 1, R5, line one thereof, amended to read, in part: "These districts are intended to include lands used or intended to be used only by single familes de- veloped.." Page 3(d), in section RM, sub paragraph (b) also eliminated the words, "the 2nd paragraph" and"`(a)" (See attachment "G") Page 4, insert, "the" before lot area which appears in 3.2 (d). Page 6, Under 5.5, sub paragraph "(d)" needs to be renumbered as "(1)" Page 7, The reference "5.5.c which appears opposite "(2) is incorrect, remove same. Page 9, In section 5.7, the "period" thereof is amended as follows: "Change period to a comma and add:"whenever practicable." In section 6.1, line three the "and" between needs a period at the end thereof. Page 18, in sub-paragraph (e), correct line 5 thereof to: the Zoning Administrative Official". Page 23, in numbered paragraph 6, delete line 3, the words, "on the beach". Also added in (c), sub-paragraph "1", line one thereof, the words, "or leased" between "acquired" and "by". Page 27, The sentence following the title of 5.17, needs "RA" to be Page 31, Page 35, Page 42, Page 45, Page 49, Page 52, • U and "amendment" should be "an". Page -2- the words, "plans" In section 2 (b), line 5, insert, "as of" after the word, "ser- vice" In the title, which appears in "(c)', make districts, singular. Line 5, the word, "case" should be plural. Insert, "as" after the words, "personal service". In section 14.5, deleted, "by the Building Official", the last four words in paragraph 1 thereof. In lieu thereof, inserted, "and/or upon such condition as may be set by the Zoning Adminis- trative Official." The definition of 15.11, Easterly Survey Line was completely revised to read: "The Easterley Survey Line is defined as a line adopted under that designation by the Town of Highland Beach by Ordinance No. 150 in 1969, and is shown upon a map on file in the Town Hall." In 15.12 the third line, word, "family" changed to "group". Page 53. In 15.19, changed the last sentence thereof to read, in part, "transients on a daily charge or rate." There was additional discussion as to having the Official Zoning Map ready if the ordinance is adopted. Vice Mayor Joy and Commissioner Mumford voiced their displeasure with several unchanged provisions which the Mayor advised should be part of the on-going study of the Comprehensive Plan and the Zoning Ordinance. A discussion then took place if a Resolution should be prepared for the consideration and/or approval of the Commission, it was then decided that the Town Attorney prepare a motion for consideration. He offered the following: "Be it Moved that the proposed Zoning Ordinance, as read into the Public Record, at the Public Hearing held commencing at 1:00 o'clock P.M., November 4, 1974, is hereby adopted as the Comprehensive Zoning Ordinance of the Town of Highland Beach Florida. Further:, moved that where the Public Record shows that the Planning Commission's final zoning report has been altered or amended, in any way, the Town Clerk is hereby authorized to incorporate such alterations and amendments along with any typographical corrections into the published version of this Ordinance which shall and the same is hereby made a part of the Code of Ordinances of the Town of Highland Bead., Florida. 1 ti page -3- MINUTES: PUBLIC HEARING (Special Meeting) - TOWN COMMISSION November 4, 1974. "Be it further moved that this Zoning Ordinance is adopted this 4th day of November 1974, to be effective November 15, 1974." Commissioner Clark offered to make the motion as proposed by Mr. Sliney (hereinabove) and Commissioner Bauer seconded the motion. In response to a polling of the Commissioner,each cast their voice vote and the record will show: Aye votes by Commisioners Clark and Mumford, Mayor Gilday, Commissioner Bauer and Vice Mayor Joy. The Mayor then signed the Official Zoning Map, Zoning Ordinance, page 55 as read into the r~ also attached, respectively as Attachments "; The meeting was adjourned at 6:30 P.M.
