MINUTES: REGULAR_MEETING, PUBLIC HEARING OF THE TOWN COMMISSION,
NOVEMBER 6, 1974.
At 7:30 P.M., Mayor Gilday called the meeting to order and the Agenda
thereof is attachment "A".
Present were: Mayor Gilday, Vice Mayor Joy
and Commissioners Bauer, Murn~ford
and Clark
In attendance were Elaine W. Roberts, the Town Manager, John P. O'Grady,
the Zoning Administrative and Building Official, and Chief of Police
Kenneth Jones.
A brief summary was given of actions taken during meetings of October 2,
3, 8, 15, 21 and 29, and November 4, 1974, Commissioner Bauer offered
the motion to approve the Minutes of these meetings, as written. Com-
missioner Mumford seconded, and by roll call voting, all members of the
Commission voted: Aye.
Public Requests - None were received,
Reports of Agencies of the Town:
• Board of Adjustment - No report.
Community Appearance Board - No report.
Mayor Gilday read a letter dated November 4, 1974, submitted by Chairman
Betty Jean Stewart (see Attachment "B") which requested the Commission's
consideration that Mrs. Sylvia Jaffe, be appointed as an alternate to
this board. Commissioner Mumford offered the motion, Commissioner Clark
seconded, and the motion was approved unanimously.
Planning Commission - No report,
Mayor Gilday read Dr. Guelzow's letter of resignation from the Planning
Commission (He was the Vice Chairman, see Attachment "C"), Commissioner
Mumford offered the motion to accept the resignation with an expression
of appreciation, Vice Mayor Joy seconded the motion, there were no
dissents and the motion carried,
Mayor Gilday then read letters received from Messrs. Kemery and. Wilcox,
(the respective Chairman and Secretary of the Planning Commission) see
Attachments "D" and "E". These letters of resignation were accepted
with regrets. Commissioner Clark offered the motion and Vice Mayor Joy
seconded. Discussion following, Voting in favor of the motion were all
members of the Commission,
Mayor Gilday expressed the laudatory sentiments of the Town Commission
for the work performed by these members of the Planning Commission. He

also stated that everyone should continue to work for improvement of
the Town's interests.
Vice Mayor Joy offered the names of the following persons to fill un-
expired terms: Mr. Edward Potere to fill the vacancy of Mr. Kemery,
Mr. Robert B. Myers for Dr. Guelzow, and Admiral Farrin that of Mr.
Wilcox. These nominations were seconded by Commissioner Clark and
unanimously approved by the Commission.
Mayor Gilday suggested that Mr. Joseph Boscove, as Acting Chairman,
call an Organizational Meeting. The Mayor pointed out that members of the
Planning Commission elected their officers (terms are for one year) and
it was his suggestion that such a meeting take place before the regular
monthly meeting of the Planning Commission, scheduled to be held on
November 21, 1974, (Letters of resignation which were prepared and
executed by Mr. Potere and Admiral Farrin, resigning from the Board
of Adjustment, were then read, see Attachments "F" and "G". (These
gentlemen submitted these letters when advised that they would be con-
sidered for the above mentioned appointments). Vice Mayor Joy offered
the motion to approve these resignations from the Board of Adjustment,
Commissioner Mumford seconded, the motion carried without any dissents:

Planning Commission (submitted by Mr. Genovese as he is to be considered
for nomination to another board, see hereunder the Housing Board of
Adjustments and Appeals). Commissioner Bauer offered the motion that
this action be approved, Commissioner Clark seconded and all members
voted their agreement.
Police De artment - The Police Commissioner, Senator Hults, gave a
report of the activity of this department. He advised that the com-
parison of statistics shows the crime rate is down from last year. He
reported the attendance of Mayor Gilday, Chief of Police Jones, Town
Attorney Sliney and Mrs. Ciomei, Municipal Court Clerk, and himself
at the Attorney General's Seminar on Criminal Law on October 11, 1974,
in West Palm Beach. The Police Commissioner commended Sgt. John Ryan
and Officer Giordano for pursuing courses for career development for
Law Enforcement Officers: both having completed an $0-hour advanced
course at Palm Beach Junior College.
Town Manager's Report
Building Department
. Mrs. Elaine W. Roberts advised that.she has hired Mrs. Olga Hulsman
as a full-time employee to replace Mrs. Williams a part-time employee,
who has resigned. Such action will permit Mr. O'Grady to make in-
spections both in the morning and afternoon.

She reported that the Kittel House was demolished and re; the White-
house Property, read a letter dated September 24, 1974, (see Attach-
ment "I") which advises the owner, Mr. Steinhardt that the building is
unsafe and requests removal within 30 days.
Discussion then followed. Commissioner Clark inquired what was the
status of the Radice Corporation's building of "Highland Beach Towers"
(formerly known as 3200 Corp.). Mrs. Roberts read the contents of
correspondence, a letter dated November 1, 1974 (see Attachment "J").
Finance Department - Mrs. Roberts advised. that this department is
working overtime maintaining the old and new systems.
Health Department - She gave information as to the latest treatments
recommended for Yellow Lethal Palm Disease. Informed the Commissioners
that there are unexpended funds amounting to approximately $2500.00
(Duneline Study) which F.A.U. will be returning in about ten days.
She read a letter dated October 25, 1974, received
regarding Coastal Preservation and Restoration of

Public Works - the Town Manager reported on the status of the Water Ex-
pansion program and the corrective work being done on drains in Bel Lido.
Advised. her receipt of correspondence, Russell and Axon letters dated
October 25 and 29, 1974, re: Water Treatment Plant Expansion, these
will be discussed at the workshop meeting scheduled for November 2F~,1974.
Reported that the Interim Treatment Sewage Plant is now operable, and
has been tested for operation.
Commissioner Clark requested that a layman's explanation of how the
Sewer Treatment Plant works be supplied. Mrs. Roberts will request the
Town's Consulting Engineers to furnish this information.
She informed the Commissioners that the City of Boca Raton has submitted
proposed plans for the usage of the Western Well Field if the Town agrees
to the leasing of such property to Boca for recreational purposes. Also
advised that a communication has been received from Seagate complaining
about the condition of Urbanek's adjoining property and stated she would
handle this in a routine manner.

The Town Manager advised that pursuant to requirements of the Zoning •
Ordinance, Leadership Cable Company was informed to request a Public
Hearing before the Planning Commission.
She read a letter from Mr. Roland L. Elliott, Special Assistant to the
President,"The White House" see Attachment "M" regarding phasing-out of
Police Forces of less than 10 men.
Commissioner Clark requested a Financial Report and he was informed that
the Code had been revised with respect thereto.
Report of the Mayor
Mayor Gilday advised that the Town Commission had adopted the Zoning
Ordinance, this tedious matter was completed on November 4, and will be
effective on November 15, 1974.
Reported on his attendance at the Annual Convention of the Florida League of
Cities with his wife which was held in Tampa from October 24 thru October
26, 1974. The Town's resolution objecting to the reduction of police forces
of less than 10 men, was considered by the League and a Resolution incorp-
• orating this stand was approved.
The Mayor gave a summary of the Town's electorate voting on the $50 Milli
Bond Issue: 51 for and 586 against. He thanked the Highland Beach Civic
League for their efforts in informing the Town's residents in such matters.
He pointed out that while the Zoning Ordinance has been adopted the work of
the Planning Commission is not completed and it is hoped that they will con-
sider suggestions relative to changes which will require an updating of the
Comprehensive Plan and/or Zoning Ordinance. Mayor Gilday then advised that
due to the enactment of the Zoning Ordinance, pursuant to State Statutes it
was necessary to re-appoint a Board of Adjustment.
Commissioner Bauer offered the following names for persons to be nominated
to the Board of Adjustment:Messrs. Kemper,Wernecke,Scofield,Whyte and Horton
as Regulars and Messrs.Frederick and West as Alternates. A letter from Mr.
Horton resigning from the Finance Committee was read into the record,~ee
attachment "M". A similar letter from Mr. Stephenson vas also advised, Att-
achment "N", vice Mayor Joy seconded an amended motion that these persons
be nominated as regular and alternates for the terms offered by Commissioner
Bauer and accepted the aforesaid resignations. All members of the Commission
approved these actions.
Mayor Gilday requested Mr. Kemper, in audience, to call an Organizational
Meeting so that they could elect officers. Mr. Kemper suggested the tent
tive date as November 11, and stated he regretted the transferring of Rea
Admiral Farrin to another Board. He pointed out however, that this method
for the educational process was very desirable.

• RESOLUTION NO. 271 (Board of Adjustment) Attachment "O", was read and .
after changes therein, Commissioner Clark offered the motion for its
adoption. Commissioner Mumford seconded his motion. The roll call vote
of Commissioners Clark, Mumford, Bauer and Vice Mayor Joy and Mayor Gilday
were all: Aye.
ORDINANCE NO. 254 - (Had a first reading October 2, 1974, public
notice of intention to consider adoption, October 9, 1974) this ordinance
which would adopt the Southern Standard Housing Code was read in its
entirety.
Commissioner Clark offered the motion for adoption of this ordinance,
and Commissioner Mumford seconded. A roll call vote was taken and
voting Aye were: Mayor Gilday, Vice Mayor Joy and Commissioners Mumford,
Clark and Bauer.
RESOLUTION NO. 272 - Copy attached, "P", provided for a new board,
"Housing Board of Adjustments and Appeals", which is established under
the provisions of Ordinance No. 254. Commissioner Clark nominated as
regular members, Judge Santangelo, Messrs. Genovese, Krauss, Stephenson
and Mrs. Vendeland; for alternates, he offered the names of Messrs.
Jenkins and Kanner. Commissioner Bauer seconded these nominations.
• The record will show the roll call voting of Aye for Vice Mayor Joy, •
Commissioner Bauer, Mayor Gilday and Commissioners Mumford and Clark.
Mayor Gilday requested Judge Santangelo, in audience, to call an
Organizational meeting, it was scheduled for November 12th, members to
be advised.
Discussion then took place as to the scope of the Housing Board of
Adjustments and Appeals. Mayor Gilday answered inquiries relative
thereto.
Commissioner Clark inquired as to the current status of the Healy suit.
Mrs. Roberts advised that she had received telephone information from
the Office of Attorney Becker (the Town's Attorney in this matter) that
a tentative meeting with Healy's Attorneys was being rescheduled for
December 9, after the proposed October 30th meeting was cancelled.
ORDINANCE NO. 255 - Provides for a new Chapter 13-1/2, Interim Services
and Facilities Fees. (First reading and publication on the respective
dates of October 2 and 9, 1974.) The Town Clerk read the ordinance in
full, and following discussion thereof, Commissioner Mumford offered the
motion to adopt the ordinance. Commissioner Clark seconded. Mayor Gilday,
• Vice Mayor Joy and Commissioners Mumford, Clark and Bauer voted Aye.
ORDINANCE NO. 256 - Amends Section 106.3 of the Plumbing Code, Chapter •
19 of the Code of Ordinances. This ordinance with the same first
reading and publication dates as stated above, was read in its entirety.

immediately effective. Commissioner Mumford seconded, voting Aye were:
Commissioners Clark and Mumford, Mayor Gilday, Commissioner Bauer and
Vice Mayor Joy.
RESOLUTION NO. 273 - Appoints Mr. John P. O'Grady as the Zoning
Administrative Official and Building Official (supersedes Resolution
No. 253), Attachment "Q". This resolution was read and changes
were made in the wording and effective date thereof. The resolution,
as amended, was approved on the voting and motion offered by Commissioner
Clark, seconded by Commissioner Mumford, and Aye votes of Mayor Gilday,
Vice Mayor Joy, and Commissioners Mumford, Clark and Bauer.
ORDINANCE NO. 257 - provides for an amendment to the Sewer Franchise;
however, the effective date thereof is subject.. to completion of
certain conditions and an Addendum thereto. This ordinance was
amended during the final reading. (The first reading and intention
to adopt dates; October 15 and 19, 1974.) The ordinance, as amended,
approved on a motion offered by Vice Mayor Joy, seconded by Commissioner
Bauer and a roll call vote. Voting Aye were Mayor Gilday, Vice Mayor
Joy, Commissioners Mumford, Clark and Bauer.
No bills were presented for approval.
Vice Mayor Joy announced the meetings scheduled, at this point in time,
for the month of November. ~?
