MINUTES: SPECIAL MEETING - TOWN COMMISSION - JANUARY 24, 1975.
• Mayor Gilday called the Special Meeting to order at approximately 1:40 P.M.
attachment "A" (original and amendment thereto dated January 9 and
22, 1975.). The notice advises the purposes for the meeting and that
it was the decision of the Commission to hold a special meeting, see
minutes of January 17th.
Present were: Mayor Gilday, Vice Mayor Joy and
Commissioners Mumford, Bauer, and
Clark.
In attendance were: Mrs. Roberts, Town Manager, Mr. O'Grady, Building
Official, and Mr. Sliney, Town Counsel.
Pursuant to a request, see attachment "B", letter of January 20, 1975,
the Mayor recognized Mr. Charles F. Radice an officer and director of
3200 Development Corp. who wished to address the Commission regarding
the denial by the Building Official to an extension of their Building
Permit Application for "Highland Beach Towers". At the present time,
he stated that, unless they picked up the Building Permit on .February
5, 1975, with payment of fees amounting to $76,572.679, they would
lose their current "rights". He gave a detailed explanation for their
request, citing that economic conditions do not warrant their beginning
• construction within the six-month period, and that it was their opinion
that the settlement was not a "Time of the Essence settlement''. He
stated that the settlement should be considered as an agreed matter,
giving flexibility to the provisions thereof. He requested the Town
Commission to over-rule the decision of the Building Official.
Following a lengthy discussion and statements from the Town Attorney,
Town Manager and several members of the Commission, a motion was offered
by Commissioner Clark to uphold the decision of the Building Official
and to deny the requested extension. Vice Mayor Joy seconded the motion.
The canvassing of the Commission shows five aye votes were cast by
Mayor Gilday, Vice Mayor Joy, and Commissioners Clark, Mumford and Bauer.
ORDINANCE - In lieu of having a second reading for the proposed amend-
ment to Ordinance No. 255 re: Chapter 13-1/2, Interim Services and Fac-
ilities, after a lengthy discussion, and the suggestion of the Town
Counsel, by a motion of the Commission, it was deemed desirable to post-
pone this matter. Consideration and/or adoption thereof to be added to
the February 4th Agenda.
The President of the Highland Beach Civic League, Mr. Tom Losee, then
addressed the Commission, he read his letter of January 9 (attachment
"C") which states in part "that the sum of $2,500.00 was material
• evidence of the League's support to the Town in defense of the Comprehen-
sive Plan and Zoning Ordinances."

• The Boca News reporter took pictures of the check presentation. Mayor
Gilday thanked the Highland Beach Civic League thru Mr. Losee. He
stated "This is just one more evidence of the value, which I have main-
tained at every opportunity, a League, such as the Highland Beach Civic
League, has in a Town such as this. They have demonstrated at all
times an interest in the welfare of all the citizens of the Town and
we are most appreciative".
The Town Manager was requested to confirm the Mayor's remarks to the
Civic League.
ORDINANCE NO. 266 - Further amends the Fiscal Year Budget. After the
second reading, Commissioner Mumford offered the motion for adoption,
Commissioner Bauer seconded. Voting aye were: Commissioners Clark,
Mumford, Mayor Gilday, Commissioner Bauer, and Vice or Joy.
