. Mayor Gilday called the Special Meeting to order at 1:45 P.M.
Present were: Mayor Gilday, Vice Mayor Joy and
Commissioners Mumford, Clark and Bauer.
Also present were: Town Manager, Elaine W. Roberts, Attorney Thomas E.
Sliney, and at her request, the Plumbing Inspector, Harold Pearson was
also in attendance.
On behalf of the Highland Beach Utilities Co., Messrs. August Urbanek
and Earl Totz were also in attendance for the purposes of the meeting
This meeting was arranged to discuss with Mr. Urbanek various matters
pertaining to the Sewer Project, the Sewage Interim Treatment Plant
and various agreements which are pending--but, to date have not been
executed between the Town and the Highland Beach Utilities Co., and/or
other parties.
Mayor Gilday read, in full, the purposes of the meeting as shown in the
Agenda, Attachment "A".
The Town Manager was requested to inform the Town Commission of the
discussions held at an informal meeting on February 11th with Mr.
Urbanek, Vice Mayor Joy, and Attorney Sliney. Mrs. Roberts advised
• that delays were constantly being encountered in completing the sewer
system and the installation of laterals.
Mr. Urbanek responded to her remarks, and a long discussion followed.
A problem existing at the Sunny Surf Motel was then brought up: the
need for a lateral to be able to convert to the sewer system. Mr. Harold
Pearson cited the facts in this matter and he stressed that the existing
septic tank conditions at th~.t site requires prompt attention as to con-
necting to the sewer system. Mrs. Roberts also spoke on this matter and
stated that assurances had been given to Mrs. Rhinehardt of Sunny Surf
that this matter would be attended to, but since November 1974, nothing
has been done. She further pointed out that it was her understanding
that, at the meeting of February 11th with Mr. Urbanek, laterals would
not be put in for a period of time.
Mr. Urbanek then advised that the contract would be for all laterals
proposed for the system and they were ready to start Monday, February 17,
1975. He stated that the plans showing 1'ateral installations have been
submitted to the Town. He explained the various delays in getting the
plans for System #1 due to a change in the gravity line for units north
of the Sewage Interim Treatment Plant, and changing locations for laterals
of the system. Mr. Urbanek advised that his company was awarding the con-
• tract for System #1 to Pipe Unlimited Inc. and desired the Town Commission's
approval of the contract which states completion would be in 175 days

which would exceed the May 20, 1975 completion date as specified in the
Sewer Franchise Ordinance Amendment. They would want an additional 30
days for contingencies. The laterals (separate contract) to be completed
in 45 days. A long discussion followed as to why Highland Beach Utilit-
ies Co. required the Town Commission to approve the Utilities Company's
proposed contract with Pipe Unlimited Inc. Mr. Urbanek contended that
the first contract to Lyons Construction Co. had been approved by the
then Mayor at the time it was awarded.
Attorney Sliney pointed out that the matter was not one requiring the
Town's approval and he questioned Mr. Urbanek as to the payment bond
required under the Sewer Ordinance. He stated modifications would be
needed and that it was his opinion that the Town should not execute
any documents or approve any undertakings at this time pending further
review of these matters.
Comments were also made as to corrections needed at the foundation of
the treatment plant and Vice Mayor Joy offered several suggestions.
Mayor Gilday suggested that Vice Mayor Joy should confer with represent-
atives of the Utilities Co. and report to the Town Commission as to
what remedial actions are planned.
Mrs. Roberts and Mr. Urbanek then discussed a letter dated February 6,
• 1975, (Attachment "B") from Russell & Axon relative to the number of
connections that can be served by the plant. Mr. Urbanek informed the
Town Commission that he will be appealing the 1800 connections, as a
correct figure.
The odor problem existing at Lift Station No. 3 was also discussed.
Due to Mr. Urbanek's departure, it was the consensus of the Commission
to recess this meeting. Attorney Sliney to review pending agreements
and secure whatever modifications he deems appropriate. Before leaving,
Mr. Urbanek assured the Town Commission that while he was stepping down
as the Executive Officer of the Highland Beach Utilities Co. and the
Highland Beach Ambassadors Corp. he proposes to increase his holdings
in the stock of the latter company.
The meeting continued after Mr. Urbanek left and speaking for the
Utilities Company, Mr. Totz stated that unless an extension was granted
for the completion date of the sewer system, Mr. Urbanek did not want
construction to start.
Speaking for the Town Commission, Mayor Gilday stated that it would be
an evidence of good faith if the installation of laterals was begun.
The review of the lateral plans to be made as soon as possible by Mrs.

Mayor Gilday announced that the special meeting was recessed to
February 25, 1975,at 1:00 P.M.
Bills were presented for approval.
Delays in the completion of the Bicycle. path were discussed and
Commissioner Bauer was advised of assurances received for the repairs
required at the Bel Lido entrance.
At approximately 3:45 P.M., the meeting was
