MINUTES: SPECIAL MEETING OF THE TOWN COMMISSION - FEBRUARY 19, 1975.
Vice Mayor Leslie W. Joy, in the absence of the Mayor, called the
• Special Meeting to order at 1:15 P.M.
Present were: Vice Mayor Joy and Commissioners Mumford
and Bauer.
Absent: Mayor Gilday and Commissioner Clark.
The Vice Mayor informed the Commissioners and residents in audience
that the Mayor, Mrs. Roberts, and John O'Grady were accompanying the
Attorney, Tom Sliney, to assist in the Town's presentation: Radice
matter being heard in the Court at West Palm Beach before Judge Lewis
Kapner. (Radice seeking relief as to payment of fees and picking up
their building permit).
Vice Mayor Joy advised the purpose of the meeting was for consideration
and/or approval of ordinances, attachment "A" is the Agenda for the
meeting. He further advised that the proposed ordinances had legal pub-
lication on February 5, in the Boca News (after a first reading on
February 4, 1975). He requested the Town Clerk to read in full the
Ordinance to amend Chapter 13-1/2:
ORDINANCE NO. 272 - An ordinance of the Town of Highland Beach amending
Chapter 13-1,/2 regarding computations of Interim Services and Facili-
ties Fee. Commissioner Ruth E. Mumford offered the motion for approval
and the seconder was Commissioner Harry Bauer.

Vice Mayor Joy explained that this amendment will correct an omission
of Ordinance No. 255. (Ordinance No. 255 revised the date when such
fees would begin and states that fees shall be computed either on the
basis of 2/ of the value of improvements (Building permit) or on a
factor basis, $350.00 for a one inch water meter or multiples thereof.)
This amendment is to stipulate that the method to be used in computing
the fees shall be the "lesser" thereof. Voting their approval were
Commissioner Bauer, Vice. Mayor Joy, and Commissioner Mumford, the three
aye votes adopted this ordinance to be immediately effective.
ORDINANCE NO. 273 - An ordinance of the Town of Highland Beach imposing
Capital Surcharg+a'Fees, and Fees Payable to the Town for Monthly Main-
tenance and Operating Costs in connection with the Sewage Interim Treat-
ment Plant. Citing prior agreements with the Highland Beach Utilities
Company, the ordinance provides for the Town to bill for account of the
Utilities Co. the sum of $200.00 per dwelling unit for properties to be
using the Treatment Plant Facilities and further provides that the Town
receive for their account payment of $3.00 per unit per month for main-
tenance and operational costs.
Vice Mayor Joy advised that the Town Attorney approved this proposed
ordinance without change. If this meets with the approval of the Town
Commission it too will be immediately effective. Commissioner Bauer
offered the motion for approval and Commissioner Mumford seconded.
Voting aye were Vice Mayor Joy, and Commissioners Bauer and Mumford, the
motion carried.
