• Mayor Gilday called the meeting to order at 9:30 A.M., in attendance
were:
Mayor Gilday, Vice Mayor Joy, Commissioners Mumford,
Clark and Bauer.
Also present were: Elaine W. Roberts, Town Manager, Thomas E. Sliney,
Town Attorney, John H. Klinck, District Engineer (Town's Project Engin-
eer of Russell & Axon).
The Agenda, attachment "A" shows the proposed subjects for discussion.
Mr. James Pandolph addressed the Commission regarding his company's
(Pittsburgh-DesMoines) request for an extension of the contract for the
water tower (see Attachment"B" - letter November 27, 1974). He read
the contents of his letter of February 24, 1975, attachment "C" which
cites problems of the Company's strike, data as to fabrication of the
elevated tank, etc.
The Town Manager advised the Town Commission of the recommendation of
Russell & Axon to grant the extension to September 29, 1975, see at-
tachment "D", letter dated January 10, 1975, from Mr. John Klinck which
states a determination to be made. At this point, Mr. Klinck addressed
the Town Commission and he validated the reasons given by Mr. Pandolph
and recommended approval of the extension. Discussion followed.
It was the opinion of counsel that a modified performance bond be fur-
nished as a rider to the present bond, to specify the definitive com-
pletion date, not waive damages beyond the September 29th extension
date, and that the erection begin not later than May 1, 1975. The Town
Attorney will provide Mr. Pandolph with the wording required for the
"bond rider" and every effort will be made to have such data in hand
for the Town Commission's formal action at its Regular Meeting of March 4,
1975.
Mr. Sansoterra of Lauderdale Contracting Corp. addressed the Commission
regarding his undertaking to complete the paving of the bicycle path
and assurances to Vice Mayor Joy given last week. This matter was dis-
cussed, at length. The project delays were reviewed, the absence of
required valves to complete installations, etc.
Mr. Klinck advised that approximately 2,000 feet of compaction testing
has been performed and that such tests are being continued until speci-
fications are met so that the paving can begin. In the discussion it
was pointed out that another test would be made at 1:00 P.M., today,
February 25th.

• It was Mr. Sansoterra's contention that the ills would be amended im-
mediately. A new supervisor was being put on the job, more men to be
procured for completion of the work, etc., and that irrespective of costs
to be incurred, they would begin paving and go back to incompleted por-
tions where valves are required.
Mr. Klinck advised that under date of February 14, 1975, he had apprised
the bonding company of Lauderdale Contracting Corp. of the unsatisfactory
progress of the bicycle path and that the Town could invoke termination
of the contract with a seven-day notice to such effect. (Copy of Mr.
Klinck's letter is attachment "E"). Discussion followed.
Mr. Klinck expressed the hope that compaction tests would be met soon
and that if matters do not improve it would require that the "7-day
notice be sent".
It was the consensus of the Town Commission that if Russell & Axon are
not satisfied that there is progress, they authorize Mayor Gilday and
the Town Attorney to .review the matter and if they concurred with such
findings, they would, on behalf of the Town Commission, authorize that
such notice be given to Lauderdale Contracting Corp. and the Bonding Co.
• Mr. Klinck read a portion of the contract dealing with this provision.
The Attorney is to review the contract and matter to be pursued.
The next matter on the Agenda, Mr. Shaw of Ocean Pines, addressed the
Commission regarding the Town's Sign Ordinance.
Mayor Gilday advised that he should make an application to the Building
Official regarding his Temporary Sign and if he denies granting permission
for the sign to be continued when the Certificate of Occupancy is granted,
they should apply to the Board of Adjustment. Such application be made
at this time and not when the building is completed.
The Town Manager advised that consideration had been given to having a
Committee appointed to review the sign ordinance and possible relief to
developers; however, sign ordinances in other nearby communities were
found to be more restrictive than that of the Town.
Mr. Shaw thanked the Commission and will proceed with an application to
the Board of Adjustment if denied relief by the Building Official. A
short recess was then taken.
The Mayor then requested the Town Clerk to read the proposed ordinances
• which have had a first reading and publication of intent to consider
adoption of the Amendment to the Capital Improvements Budget and to
Chapter 7, regarding protective coverings.
Mayor Gilday requested that in the amendment to Chapter 7, the word,
"protected", the last word in section 3, be changed to read, "affected".

The ordinances were discussed, there were no other changes or suggestions
relative thereto.
The Town Manager asked the Town Attorney if he was prepared to discuss
the proposed TV Franchise which was tabled at his suggestion. Matter
discussed at length.
Town
It was agreeable to the Town Commission that the/Attorney consult with
the Attorney for the Cable TV Co.,and our consultant Mr. Blosser, and
that the matter be pursued further.
Mrs. Roberts advised the Town Commission of her efforts regarding ar-
rangements for the dedication of the bicycle path. With respect to
benches to be placed at various sites along the path, it was their
opinion that only a few benches would be needed, she would be contacting
the Presidents of Condominium Associations as to donating funds for the
proposed benches.
The Town Manager also advised that additional data is being secured
regarding painting needed for certain facilities of the Town.
• A long discussion then followed regarding expansion plans for the Water
Treatment Plant, Mrs. Roberts has received the Engineer's Preliminary
plans which are to be reviewed with Vice Mayor Joy and a recommendation
and report will be given to the Commission. The discussion also covered
the necessity of a Bond Issue in 1976, etc.
Mrs. Roberts informed the Commission that she had received a letter of
February 18, 1975, from Boca Raton's Parks and Recreation Director which
transmitted a proposed Lease Agreement to be executed: Between the Town
of Highland Beach and the City of Boca Raton for the Town's reserve Well
Field. A copy of the agreement has also been forwarded to the Attorney
for his review, She recommended that if it meets with the Attorney's
approval that the Town Commission take the necessary steps for signing.
(see Attachment "F" for copy of the proposed lease agreement).
A letter received from Mrs. Betty Jean Stewart, was read. (See copy
thereof, attachment "G"). Mrs. Stewart suggested that residents would
be afforded a better rate with respect to services of a nurseryman for
lethal yellowing and for a single plumber for sewer connections and
asked the Town's assistance.
It was the opinion of the Town Commission that the Town could not direct
• the residents to a single party, but could furnish names of approved
nurserymen and plumbers. The Town Manager also advised that the company

putting in the laterals (American Consolidated) will be contacting
residents and it was further suggested the next news bulletin could
give this information.
Mrs. Stewart addressed the Town Commission and requested the Town Com-
mission to support a Resolution objecting to the stores being proposed
on the west side of A-1-A in Delray (A 7-11 store, etc.).
A discussion of this matter then took place, it was felt that if the
matter is before the Courts the members of the Town Commission could
appear as witnesses, but there would not be anything done by the Town
to inf luence the Court if the matter is in litigation.
Mrs. Roberts advised that the Building Official was away--attending a
seminar in Gainesville and would return to duty on Thursday, February 27th.
