MINUTES: REeESSED SPECIAL MEETING OF FEBRUARY 12, 1975, RE5UMED_BY
TOWN COMMISSION, FEBRUARY 25, 1975.
• Mayor Gilday advised that the special meeting with Mr. Urbanek, recessed
on February 12th, was for the purposes shown in the Notice of February 6,
1975 (copy thereof, attachment "A").
Present were: Mayor Gilday; Vice Mayor Joy and
Commissioners Mumford, Clark and Bauer.
In attendance were Elaine W. Roberts, the Town Manager, Thomas E. Sliney,
the Town's Attorney, and Messrs. August Urbanek and Earl Totz.
Discussion took place regarding the status of Agreements and their execu-
tion and the return of the Original of Ordinance No. 257 with execution
by the Highland Beach Utilities Co. Mr. Urbanek was questioned as to the
agreement to restrict the usage of the recreational site across from Sea-
gate. The Town Commission was advised this will be drawn up in the near
future .
A general discussion took place regarding the amendment to the Bond,
reasons for non-delivery thereof: Mr. Urbanek waiting bonding of American
Consolidated, the contractor who is installing the laterals, etc.
Mr. Urbanek insisted that the proposed agreements be readied for~execu-
• tion. It was pointed out that the sewer plant agreement never got to
the final draft, nor were copies of the proposed agreements distributed
to the members of the Town Commission.
The Town Commission discussed the laterals to be installed and then the
availability of the proposed agreements in final form was discussed. The
Town Manager offered to have the proposed Sewage Interim Treatment Plant
Agreement re-typed and the other agreements to be done by Mr. Sherr,Attor-
ney for Mr. Urbanek in the Lauderdale firm of Ruden Barnet, McClosky,
Schuster & Schmerer, and that all re-writes would be available for dis-
tribution to the members of the Commission by 2:00 P.M., February 26th, and it
was proposed that the meeting be adjourned to 9:00 A.M., February 27th.
Mr. Urbanek advised that he was due in Miami at 10:00 A.M., Friday but if
possible he would attend the meeting with his Attorney. Mayor Gilday in-
formed the representatives of the Highland Beach Utilities Co to be certain
to furnish the Town with Corporate Minutes showing Mr. Delaney's authoriz-
ation to sign documents of the company and such authorization be notarized
and have the corporate seal.
Bills were presented for payment.
At 2:45 P.M., the Mayor advised that the meeting was recessed to 9:00 A.M.,
