1975.03.18_TC_Minutes_SpecialMINUTES: Special Meeting of the Town Commission - March 18, 1975 • At 2:00 P.M., Mayor Gilday called the meeting to order. Present were: Mayor Gilday, Vice Mayor Joy and Commissioners Mumford, Clark and Bauer. Also present were: The Town Manager, Elaine W. Roberts, Town Attorney, Thomas E. Sliney, and Building Official John P. O'Grady. The Agenda, attachment "A" shows the purposes for the special meeting that was called by the Mayor and this notice was read by the Mayor. Mayor Gilday reported to the members of the Town Commission and persons in the audience that litigation of Paul W. Hoffmann, et al, vs. the Town has been turned over to the Town's Attorneys: Tylander, de Claire, Becker and Van Kleec}c. At the present time, he advised that it would not be prudent to discuss the litigation pending advice of counsel. The suit requires response within twenty (20) days and most of the Summonsk,~ were served on March 11, 1975. Attachment "B", letter of March 12, 1975, submitted by the Town Clerk, advising of her resignation effective May 2, 1975, was read by the Mayor. • After hearing several persons express their regrets, a motion was offered by Commissioner Mumford to accept the resignation, and Commissioner Bauer seconded. All members of the Town Commission voiced their concurrence, with regrets. The Town Manager presented bills for approval. A lengthy discussion took place regarding legal costs and budgeting thereof. It was deemed desirable to remit only a portion, at this time, of the amount billed re: Legal costs. Commissioner Clark registered a complaint of certain Monterey residents regarding the Bicycle-walking path. At approximately 2:30 P.M., the purposes of the special meeting were completed. The members of the Town Commission then heard a report of the Town Manager regarding her meeting on March 17th with Mr. August Urbanek relative to installations of Sewer Service Laterals. She and Vice Mayor Joy met with Mr. Urbanek and the Town's Consulting Engineers, Russell & Axon were represented by Messrs. John H. Klinck and Don J. Garbrick at the meeting. Mrs. Roberts informed the members of the Town Commission that each of them had received a copy of the Engineer's recommendation in this matter, see attachment "C", Mr. Klinck's letter dated August 19, 1975. Special Meeting of the Town Commission - March 18, 1975, pace -2- A long discussion took place, Vice Mayor Joy, the Attorney, Thomas E. Sliney, and the Mayor offered opinions. The Attorney was instructed to inform Mr. Urbanek that the Town Commission may require the Public Service Commission to review the sewer installations, etc. This matter to be pursued at the Workshop Meeting on Tuesday, Math 25th, and ~.
