1975.04.18_TC_Minutes_Special • MINUTES: Special Meeting of the Town Commission - April 18, 1975 At 9:40 A.M., Mayor Gilday called the meeting to order. Present were: Mayor Gilday, Vice Mayor Joy and Commissioners Mumford, Clark and Bauer. Also present were: Town Manager, Elaine W. Roberts and Town Attorney, Thomas E. Sliney. Mayor Gilday read the notice, attachment "A" which advises the purposes for the special meeting which was called by him. Mayor Gilday advised the members of the Town Commission that as he was preparing to sign the re-typed version of the Letter of Intent (which proposes changes for RPUD time limitations), pursuant to the authorization of April 15, 1975, he noticed incorrect wording in the second paragraph of the undertaking. Attachment "B"copy of the Letter of Intent, reflects the correction suggested for paragraph two. Discussion of the proposed changes then took place. (The attachment also shows the final accepted changes in the paragraph and when re-typed will be signed by the • Mayor.) Commissioner Bauer offered the motion to approve the changes of the wording in paragraph two, Commissioner Mumford seconded. The roll call vote shows Aye votes cast by Commissioners Clark and Mumford, Mayor Gilday, Commissioner Bauer and Vice Mayor Joy. The Mayor then requested Attorney Sliney to summarize the four points of the Radice Stipulation, attachment "C". The attorney advised: (1) that the building permit was extended to August 19, 1975; (2) on or before that date all fees are due and payable; (3) if the building permit is not received by Radice (with payment therefor), the land-use of the property will revert to the zoning classification in effect on that date, or thereafter; and (4)that the Court has deemed this stipulation to be the final disposition. Discussion followed as to whether Radice could secure further relief in the Courts. Attorney Sliney requested the members of the Town Commission to formally approve the Stipulation for the record. Commissioner Clark offered the motion to accept the ratification of the Stipulation. Commissioner Bauer seconded. This motion was • Special Meeting of the Town Commission - April 18, 1975 - Paae -2- • amended to include, "also ratifying and confirming all that the Attorney has done to date in procuring this Stipulation and the order of the Court." The amended motion, acceptable to both Commis- sioner Clark and Commissioner Bauer then was subject to the roll call vote. The record will show Aye votes cast by Vice Mayor Joy, Commissioners Mumford, Clark and Bauer and Mayor Gilday. No bills were presented for payment. The meeting was adjourned at 9:55 A.M.
