Gilday, Mayor, at 7:35 P.M. PRESENT WERE: Morton E. Gilday, Mayor Leslie W. Joy, Vice Mayor Commissioner Ruth E. Mumford Commissioner Harry Bauer Commissioner Robert D. Clark Also present: Town Manager, Elaine W. Roberts Town Attorney, Thomas Sliney Building Official, John O'Grady Electrical Inspector, Bud Triano • Town Clerk, Kathryn M. Borgemenke Approximately 15 citizens in the audience. PLEDGE OF ALLEGIANCE Public Requests as called for by Mayor Gilday None Approval of Minutes, as written: Meetings of May 6, 1975 - Regular Meeting 16 - Special Meeting 27 - Special Meeting 27 - Workshop 30 -.Special Meeting The Town Clerk gave a brief synopsis of the Minutes for the month of May. MOTION by Vice Mayor Joy/Commissioner Mumford move the Minutes be approved as read. ROLL CALL on the Motion Carried Unanimously. Minutes Highland Beach • Town Commission Regular Meeting June 3, 1975 Page 2 of 10 Mayor Gilday took this time to read a letter from The Ambassadors One Condominium Association commending the Town officials and in particular Mr. John O'Grady, the Building Official. REPORTS OF VARIOUS AGENCIES OF THE TOWN • Board of Adjustment - Louis Y. Horton, Chairman Mr. Horton stated that the Board of Adjustment has held two Public Hearings and another meeting. At the frist Public Hearing the Board reviewed petitions from two petitioners: Aberdeen Arm development at Boca Hi, asking for some means of identification for their building; this petition was approved. At the same Public Hearing a petition from Ocean Pines was heard. The request was for an extension of the temporary signf the Board of Adjustment was unable to reach a decision at that Public Hearing and an additional meeting a week later was held. This request was unanimously turned down. Mr. Horton referred to a letter to the Commission suggesting that-the sign ordinance be reviewed. A Public Hearing was held for .the developers of Sindo Investments requesting a Variance :from the Zoning Ordinance. Mr. Horton referred to another letter to the Commission requesting that the Zoning Ordinance might be modified. Mayor Gilday read the referenced letters for the record and noted that statting tomorrow he and Mrs. Roberts will be studying the Sign Ordinance. • Minutes Highland Beach • Town Commission Regular Meeting June 3, 1975 Page 3 of 10 Community Appearance Board - Betty Jean Stewart, Chairman Mayor Gilday read a letter of resignation from Markin Johnson to Mrs. Stewart. He noted that there was a letter from the CAB suggesting the appointment of Harold Storm, an alternate to replace the vacancy created by the resignation of Mr. Johnson. Mr. Storm will serve from now to August 6, 1975, which is the date Mr. Johnson's term will expire and there- after continue to serve the full term of two years from August 6, 1975 to 1977. MOTION by Commissioner Bauer/Commissioner Mumford move to nominate Harold C. Storm, who is now an alternate on the CAB, with a term • expiring on June 4, 1975, to become a regular member to fill out the balance of the term of Martin Johnson which expires August 6, 1975 and to thereafter succeed him as a regular for a two year term. Mayor Gilday called for any other nominations. There were none. ROLL CALL on the Motion Carried Unanimously. Mrs. Betty Jean Stewart reported on the CAB meeting. Housing Board of Adjustment and Appeals - Judge Robert V. Santangelo, Chairman Judge Santangelo stated that he had no report to make. He thanked Mr. John O'Grady for the help he has been to this Board. Planning Commission - Joseph Boscove, Chairman Mayor Gilday announced that he had received a letter from the Planning Commission Members and read it for the tecord. The Mayor noted that there would be two ordinances this evening for first reading relative to these recommendations. Mr. Boscove stated that he had no further report on behalf of the Planning Commission. Police Commissioner - Senator William S. Hults Senator Hults reported that everything was going along very smoothly. Mayor Gilday announced that the Finance Department has • hired a bookkeeper, Mr. Phillip Statnick. REPORTS AND/OR RECOMMENDATIONS OF TOWN MANAGER, MRS. ELAINE W. ROBERTS Mrs. Roberts gave a brief report on the following items: Certification - Comprehensive Land Use Plan, Capital Improvements Plan, rearrangement of offices, new Post Office employee, Sam Allen; meetings relative to Charter form of government for Palm Beach County, Bike Path erosion DOT - drainage for AIA, letter from Guthrie, Jacobs & Eubanks, P.A.; Newspaper item on Bulkhead lines and new law on Fire Safety Funding, P.E.R.C., the Building Department Report, Finance Department - Budget Workshop, Health Department - Clean up, Public Works - approval forms for certification of existing wells, Water Storage Tank, Lauderdale Contracting - meeting, Inspection - Sewerage intemn treatment plant, two easements of Tom property in Boca Raton, letter from Reliance Insurance Company, painting of metal work at Water Plant. Mrs. Roberts took this time to asked for Commission approval to have this work done. MOTION by Vice Mayor Joy/Commissioner Bauer move that $4,000.00 be approved for painting and sandblasting. Gilday Page 5 o f 10 The Mayor noted that affairs in the Town are moving along quite smoothly. He gave a report for the Month of May from the Municipal Court. He noted thak there will be a study of the Ordinances. Vice Mayor Leslie W. Joy Vice Mayor Joy had no report. Commissioner Ruth E. Mumford • Commissioner Mumford stated that she~did attend the CAB meeting on Thursday and answered quite a few questions regarding the appearance of the Town. She noted that the Bike Path should be referred to as theBike and Hike Path. Commissioner Robert D. Clark Commissioner Clark stated that in view of the fact that certain board meetings which have been held in the con- ference room can no longer be held in the conference room, as the rooms have been changed; and in order to comply completely with both the intent and the spirit of the Florida Sunshine Law he requested to make the following motion . MOTION by Commissioner Clark/Commissioner Bauer move that an order be issued to all the Town Boards directing them to hold all of their meetings in this room (Commission Chambers) whenever this room is available. • Minutes Highland Beach • Town Commission Regular Meeting June 3, 1975 Page 6 of 10 Mayor Gilday recognized Mr. Joseph Boscove who suggested including the provisions for recording the meetings also. AMENDMENT TO MOTION that all Board hold meetings in Chambers and that all of the meetings be taped as well. Commissioners Clark and Bauer agreed to the Amendment. ROLL CALL on the Motion Carried Unanimously. Commissioner Harry Bauer Commissioner Bauer had no report. SECOND READING AND PUBLIC HEARING OF ORDINANCES AND/OR APPROVE FOR ADOPTION Ordinance No. 278 - AMENDING CHAPTER 3 OF THE CODE OF • ORDINANCE, TITLED "AIR CONDITIONING CODE". Ordinance No. 278 was read in its entirety by the Mayor. MOTION by Commissioner Bauer/Commissioner .Clark move that we adopt. this Ordinance. ROLL CALL on the Motion Carried Unanimously. Mrs. Roberts requested the published date. Proof of Publication - May 11,1975. Ordinance No .. 279 - AMENDING CHAPTER 24, OF THE CODE OF ORDINANCES TITLED "STREETS AND SIDEWALKS AND/OR BICYCLE PATH". Ordinance No. 279 was read in its entirety by the Mayor. MOTION by Vice Mayor Joy/Commissioner Mumford move to adopt Ordinance. Mayor Gilday stated that the effective date on all of these ordinances will be as of today. Ordinance No. 280 - AMENDING CHAPTER 27 OF THE CODE OF ORDINANCE, TITLED "TRAFFIC AND MOTOR VEHICLES". Ordinance No. 280 was read in its entirety by the Mayor. MOTION by Commissioner Mumford/Commissioner Clark move that this ordinance be adopted. ROLL CALL on the Motion Carried Unanimously. Mayor Gilday stated that with the agreement of the members • of the Commission he would like to skip from the Second Reading of Ordinance - Electrical Code - to item No. 9. Vice Mayor Joy stated that he was going to suggest this. FIRST READING OF ORDINANCES "RELATING TO RPUD-l, RPUD-2 AND RPUD-3" This ordinance was read-in its entirety by the Town Manager. Mayor Gilday stated that this proposed Ordinance was in accordance with the approval of the letter of intent by the Planning Commission. Mrs. Roberts read from the Code of Ordinances relative to a Public Hearing Date. It was the unanima~ consensus of the Commission that the Public H®a.ring Date should be Tuesday, June 24, 1975, at 10:00 A.M. Discussion relative to this Ordinance followed among Mr. Boscove, Mr. Sliney, Mayor Gilday and Mr. Dent. n LJ Minutes Highland Beach Town Commission • Regular Meeting June 3, 1975 Page 8 of 10 Mayor Gilday noted for the benefit of the audience that this was only the First Reading and that there would be ample opportunity to discuss this at length at the Public Hearing and Workshop meetings. Mayor Gilday called for a Motion that a Public Hearing be held on June 24, 1975 at 10:00 in the morning. MOTION by Commissioner Bauer/Commissioner Clark: "I'll make that Motion." ROLL CALL on the Motion Carried Unanimously. Mrs. Roberts asked if both Ordinances should be discussed on the date of the Public Hearing? Mayor Gilday stated that Mr. Sliney felt that this would be correct. • "AMENDING THE SEWER FRANCHISE" This ordinance was read in its entirety by the Town Attorney. It was the unamious consensus of opinion that both of these Ordinances be discussed on June 24, 1975. MOTION by Vice Mayor Joy/Bauer move that this Public Hearing be set for the 24th of June on the Sewer Franchise. ROLL CALL on the Motion Carried Unanimously. Mrs. Roberts noted that the Charter called for this Ordinance be posted in full for a period of ten (10) days at the front door of Town Hall and that will be done tomorrow. The Mayor announced that the Commission would now return to item No. 8 (d) - "Electrical Code". • Minutes Highland Beach Town Commission Regular Meeting June 3, 1975 Page 9 of 10 After a great deal of discussion regarding this Ordinance Mayor Gilday asked the Town Attorney if this meeting may be recessed at this time. The Town Attorney replied in the affirmative and it was noted that readvertisement was not necessary. Mayor Gilday called for a Motion to recess this meeting at this point to next Tuesday at 10:00 A.M. MOTION by Vice Mayor Joy/Commissioner Bauer: "So moved." ROLL CALL on the Motion Carried Unanimously. Vice Mayor Joy noted that the rest of the business should be considered and that only this part of the meeting be recessed. Vice Mayor Joy withdrew his Motion and the second~Commissioner • Bauer withdrew the second. The Mayor stated that the Commission would noi~t go on with the meeting. UNFINISHED BUSINESS None PRESENTATION OF BILLS FOR APPROVAL Mrs. Roberts presented the bills for approval to the Commission. Each Commissioner approved the bi]]s by placing their initials on each. MOTION by Vice Mayor Joy/Commissioner Bauer move to recess the meeting of June 3, 1975 until June 10, at 10:00 A.M. ROLL CALL on the Motion Carried Unanimously.
