Minutes of Meeting of Town Commission
Special Meeting
September 18, 1975 2:00 P.M.
Mayor Morton E. Gilday called the meeting to order at 2:05 P.M.
He announced that this meting was being held to make a decision
in the matter of Lauderdale-Webb.
Present were:
Morton E. Gilday, Mayor
Leslie W. Joy, Vice Mayor
Commissioner Ruth E. Mumford
Commissioner Harry Bauer
Commissioner Robert D. Clark

Town Manager, Elaine W. Roberts

LAUDERDALE-WEBB MATTER
Mayor Gilday stated that N,Irs. Roberts, Mr. Sliney, Mr.
Klinck had a meeting earlier in the week and as a result
of this conference recommendations for the Town Commission
would be heard at this meeting.
Mr. Sliney spoke in regard to pay estimate #9, (revised) and
pay estimate #10 (the lower figures). He noted that Mr.
Klinck has supplied the Town with a letter (9/4/75) stating
that $7,125.45 could be certified under pay estimate #9.
In addition there is a letter from the General Contrzctor
stating that if that figure is approved by the Town the
funds will be made payable on tzhe joint-payee basis to
Lauderdale Contracting Corp. and the following companies:
Nutting Engineers, Tom Totz Trucking, Houdaille, Duval and
Wright; Dixie Asphalt Co., East Coast Asphalt Corporation.

Mr. Sliney recommended that the Town pay those suppliers
as delineated in the letter of September 11, 1975, written
by Mr. Mark Sapino. He noted that there was an extra
$200.72 remaining and Mr. Sliney suggested that it be held
and applied against any other work certified by Mr. Klinck
on that estimate.
Mayor Gilday called for a motion to make this disbursement.
MOTION by Vice Mayor Joy/Commissioner Bauer: "I'll make the motion
that pay estimate #9 be paid to the extent of $6,924.73 and that
$200.00 and some cents be withheld until a decision is made on
how that should be paid off."
ROLL CALL on the Motion Carried Unanimously.
Mr. Sliney stated that periodic pay estimate #10, the one
based on the amount of $73,494.79 should be paid jointly to
• Lauderdale and Webb. This amount has been certified to by the
consulting engineer.
Mayor Gilday called for a motion that the lower pay estimate of
$73,494.79, pay estimate #10, be approved and paid.
MOTION by Vice Mayor Joy/Commissioner Mumford: "I'll make that
motion."
Vice Mayor Joy asked if a release had been presentedr Mr.
Klinck answered in the affirmative.
Mayor Gilday requested an amendment to the motion, if
agreeable to the maker of the motion and the second;
to include the words "this being the estimate that has
been approved by Russell & Axon." Both agreed.
Mrs. Roberts read the release of lien aloud for the
benefit of the Commission.
Mayor Gilday noted that included in the motion a statement
should be made to the effect that a check is to be drawn
• to the joint orders of Lauderdale and Webb and to be
delivered to Webb. The Mayor asked the consent of the
maker of the motion and the second. Both consented.

MOTION complete: "That the lower pay estimate of $73,494.79, pay
estimate #10, be approved and paid; this being the estimate that
has been approved by Russell and Axon and that a check is to be
drawn to the joint order of Lauderdale and Webb and to be delivered
to Webb."
ROLL CALL on the Motion Carried Unanimously.
Mr. Sliney addressed the Commission on the matter of
the price differential on the subcontract. Discussion
on this matter followed. Mr. Sliney took this time
to refer to a letter from Mr. Klinck dated September
18, 1975. This letter sets forth certain recommendations.
Mr. Klinck read the letter for the benefit of the Commission.
Mayor Gilday called for a motion to the effect that Mr.
Klinck be authorized to give the notices contemplated
• under the terms of his letter dated September 18, 1975
to the parties named therein. Discussion followed
pertaining to this letter and authorization.
Mr. Sliney suggested a motion should be offered in support
of Mr. Klinck's letter of this date and the contents therein.
Mr. Sliney further suggested that the motion should include:
the Commission should direct Mr. Klinck to contact the
Webb people and tell them the Town wants the report by
tomorrow (9/19/75) and that the completion schedule shall
be adhered to or the Town shall take the options in the
letter. Time frames will be set after a completion
schedule is obtained.
Mayor Gilday called for a motion that this be done in
accordance with Mr. Sliney's language.
MOTION by Commissioner Bauer/Vice Mayor Joy: "I'll make a motion
that we do that."

BILLS FOR APPROVAL
Mrs. Roberts read a list of bills for approval, for
the benefit of the Commission.
MOTION by Commissioner Bauer/Vice Mayor Joy: "I'll make the motion
that these bills be approved and paid."
Being no further business to come before the Commission the meeting
ADJOURNED at 3:50 P.M.
