Minutes of Meeting of Town Commission
Workshop Meeting
June 15 1976 10.00 A.M.
Meeting called to order by Mayor Morton E. Gilday at 10:00 A.M.

• Mayor Gilday took time to explain that this Workshop Meeting had
been called by him to enable the members of the Town Commission,
as well as the citizenry present, to be informed of a meeting
held by the Planning Commission on June 8, 1976 relative to an
application from Boca Hi. The Mayor explained that the best
way to inform all would be to play the tape of that particular
meeting.
Mayor Gilday told Mr. Delaney that if after the Commission listens
to the tape and it is the feeling of the Commission that the
action which was taken by the Planning Commission was proper and
within their scope, there may be no particular reason for the
Town Commission to go through any other consideration.
After one hour and fifteen minutes of the Planning Commission tape,
Mayor Gilday felt the question primarily was what authority the
Planning Commission had for itself in this hearing, whether the
changes proposed here represented a change in development, or
whether it represented a change in the R.P.U.D. itelf. Mayor
Gilday then called upon the Town Attorney, Thomas E. Sliney.

tape. He stated that he viewed. this as a change in development
plans under Section 6.4e of the Zoning Ordinance No. 253. In
that section of the Ordinance, if the petitioner and/or developer
wants to change his plans he appears before the Planning Board
for permission to so change. Mr. Sliney went on to say that in
the portion of the tape that was not played, he stated that the
Planning Commission had its alternative and it is important to
point out that this is not starting from ground zero here; we
are starting with a project that has been approved, so this does
limit the alternatives. We can either go with the existing
building, approve this Building, "D", or ask to send the architect
back to the drawing boards and tell him we want something else.
Those are the only real alternatives we have and he views what
was brought in as a change in development plans and not an
amendment to the R.P.U.D. Therefore, he felt it came within
this Section and that is the opinion he gave.
Mayor Gilday asked at what point would they get away

Mr. Sliney stated that he would stick by his original opinion.
Mayor Gilday recognized several residents in attendance. Each
person that spoke expressed their satisfaction with the proposed
building.
At this time each of the Commissioners gave their own personal
opinions:
Mayor Gilday stated that he felt that it was the consensus of the
.Town Commission that it is not necessary for the Town Commission
to take any further action re: the decision of the Planning
Commission.

The architect took this time to explain the proposed development
of this R.P.U.D.
There was no further business. In view of the fact that the
Special Meeting that was called to follow, was to take any
action deemed necessary based on the results of this Workshop,
that Special Meeting was cancelled. ,,.
The meeting adjourned at 12:35 P.M.
