Gilday at 9:35 A.M. Present were: Mayor Morton E. Gilday Vice Mayor William S. Hults Commissioner Ruth E. Mumford Commissioner Leslie W. Joy Commissioner Robert D. Clark Also present: Elaine W. Roberts, Town Manager Thomas E. Sliney, Town Attorney Anton Drasal, Finance Director John P. O'Grady, Building Official Kathryn M. Borgemenke, Town Clerk • OLD BUSINESS 76.56 Review Proposed Budget Draft #2 - 1976-77 Mayor Gilday called upon Mr. Drasal, Finance Director, to delineate the changes in "Income" and "Expenses"; he did so. The changes requested by Mr. Drasal will bring the proposed tax millage to 4.991 for the fiscal year 1976-77. Discussion followed relative to the C.D.C. and the cost of joining. Vice Mayor Hults questioned the budgeted amount for the Built~ing Department permits. Mrs. Roberts noted that two revenue figures should remain as they are for the time being and be changed before the budget has its first reading: one is the Building Permits and the second is Investment Earnings. Mrs. Roberts also noted that there may be a change in the "Fines and Forfeitures". This figure reflects a budget amount for a three month period only. It was noted that this new budget must be effective October 1, 1976. A public hearing will not be necessary as the millage of the Town over last year will not be increased. Workshop • July 27, 1976 Page 2 of 7 This budget will be passed by Ordinance and not Resolution and this will be scheduled accordingly. It was the consensus that a Special Meeting and/or Workshop be scheduled for Monday, August 16, 1976 at 9:30 A.M. for further consideration of this proposed budget. Mrs. Roberts recommended that the Commission hold off as long as possible to approve the final budget; this will ensure the budget being as accurate as possible. Final assessment value figures are expected in September. 76.38 (a) Job Evaluation and Rating Plan Mrs. Roberts noted that this item has been separated into three packets. She explained that this is a four point program: 1st point of the program was the job descriptions that the Town Commission adopted in 1974, the second point of the program would be the job evaluations (Procedures Job Evaluation Plan). Mrs. Roberts stated that this sets up the rating of the job as compared to the job description • and then it gives the figures of the point system. She gave the Commission an excerpt of the changes in the proposed plan. Commissioner Clark explained this job evaluation for the benefit of all. Mayor Gilday thanked Commissioner Clark for his presentation. Also for the amount of work and time put forth by all on this project. Commissioner Hults expressed his pleasure with this particular pay plan. Mayor Gilday recognized Mr. Dent who expressed his opinion relative to a point system. Mrs. Roberts replied to Mr. Dent's comments. Page 3 of 7 o~ the Commission that this item be of the Regular Meeting, Tuesday, Senator Hults called to the attention of the Commission that he would be on vacation at the next Regular Meeting, August 3, 1976. Mayor Gilday stated that in view of the fact that Vice Mayor Hults has indicated many times that he is totally in favor of this Pay Plan, the rest of the Commission would consider this when voting. Mayor Gilday asked Vice Mayor Hults if he had any additional suggestions and the Vice Mayor stated he had none. He noted that there were no changes of any consequence to alter the original plan first offered to the Commission. Mrs. Mumford stated that she would like to read, study and look this Pay Plan over more carefully before coming to a definite conclusion. This also will be placed on the agenda, August 3, 1976. L~ 76.38 Pay Plan Mrs. Roberts stated that this is the proposed third step in this package and it would be the schedule of salary ranges based on the point system, if adopted. This sets the salary and the range of each specific job. Mayor Gilday questioned the jobs that were to be included in this range. Mrs. Roberts stated that this package had been disseminated to the Commission previously and there are no changes. She noted that this was based on the job descriptions that had previously been approved by the Commission. Mayor Gilday asked Mrs. Roberts to list the positions and their labor grade. She did so for all. Mayor Gilday questioned Administrative Assistant's position. Mrs. Roberts stated that this would mainly be an assistant to the Manager. The Mayor noted that the Town Clerk serves as an assistant to the Manager also. Mrs. Roberts stated that the inspectors that might be included on the payroll at some later date were not included at this time. Commissioner Clark brought to the attention of the Commission that each employee would be entitled to a review of his or her rating. Workshop • July 27, 1976 Page 4 of 7 Mayor Gilday questioned the increase of pay between the initial employment and the maximum salary reached. Mayor Gilday stated that this too should be placed on the agenda for the Regular Meeting, August 3, 1976. The members of the Commission were in full agreement with the Mayor . 76.38 (b) Merit Revieini 'Plan Mrs. Roberts stated that this is the proposed fourth step and it is a review of the actual person who is performing the job. Mayor Gilday suggested, again, that this also be included on the agenda for August 3, 1976 inclusive of a total package relative to personnel. The Commission was in full accord. Mayor Gilday, at this time, put the Commission on notice • that the Town has been served with an amended summons and complaint to bring the Town into the negligence action as a result of an injury to Mrs. Selma Fiener. A lengthy discussion followed relative to this situation. Mayor Gilday read a letter from Mr. John P. O'Grady notifying the Mayor, Commissioners and Town Manager that his employment will officially terminate on Friday, July 30, 1976. Mayor Gilday stated that he had been une~.er the impression that Mr. O'Grady was to remain with the Town a little bit longer. He expressed his regrets and stated that Mr. O'Grady has been an invaluable employee of the Town and has worked very hard. The Mayor then read a letter from Louis Y. Horton, in his capacity as Police Commissioner. It was the recommendation of the Police Committee to the Town Commission that an additional Patrolman be hired. Mayor Gilday reported that the Healy case decision was rendered by Judge Sholts in favor of the Town. • Workshop • July 27, 1976 Page 5 of 7 76.55 Town Manager - Reports, Correspondence and Continuing Reports Mrs. Roberts introduced Mr. Wally Schott the new Building Official to the Commission. Mrs. Roberts presented to the Area Planning Board the Town Commission and Planning Commission comments on the Regional Comprehensive Development Plan. She went on to explain the events of the public hearing held on July 21st in the Area Planning Board Chambers. Because of suggestions offered at that hearing, there will be a continuation on August 18th. Mr. Arthur Roy, President of Penthouse Highlands Association visited with Mrs. Roberts to discuss the alteration of a patio of one of the condominium apartments. A great deal of discussion followed, this with all the Commission members, Town Attorney, Town Manager and Mr. O'Grady joining in. • Mayor Gilday requested that the Town Attorney acquire some legal understanding of whether or not the association owns the outside of the building and to what extent....... Tom Sliney: "I still don't think that is something that the Town should get into". Mayor Gilday: "No, but I think we should know just for the facts, that's all. I don't think it should be that hard to find out". Tom Sliney: "I really think that is an internal thing because I don't think it is quite a simple thing that they own the outside we are talking about porch or something like that. I really think it is an internal matter. The Condominium Association should police their own internal matters". Mrs. Roberts requested some direction as to what the Building Department should do. • Mrs. Roberts stated that her directive to the. Building Department would be in words to the effect of: "in the Workshop • July 27, 1976 ., Page 6 of 7 future do not issue any building permits to any of the condominium residents applying for a building permit: send them back to their respective associations". his opinion: Mr. Sliney: in the interim, at least, on notice of the problem issue any permits unless it is clearly an interior change it better be shot Mayor Gilday suggested that the Town Attorney now give "What I think we ought to do is to put the Building Department we have had and not immediately the Building Official feels that change. If it is an exterior upstairs for awhile". Mrs. Roberts noted that she had received complaints relative to people walking the bike hike path and who had bicyclists come up from behind and with no warning to the walkers and practically knock people down. She suggested signs marking the path - warning and/or caution. Discussion followed regarding the marking along the bike/hike path within the Town. It was the consensus of the Commission that the Town Manager be authorized to spend not over $200.00 for the proper markings along the bike hike path. Mr. Sliney was instructed to draft an ordinance requiring a warning device to be maintained on any bicycle riding through the Town. Discussion followed regarding the enforcement of this type of ordinance. Mrs. Roberts told the Commission that Mary Louise Blosser (Mrs. Raymond) is willing to serve on one of the Boards of the Town. A letter of request from the Department of Environmental Regulations has been received by the Town. Mrs. Roberts asked the Commission if they had anything to offer relative to this letter she would appreciate answering this letter within two weeks. Mrs. Roberts stated that she thought all the Commissioners • Workshop July 27, 1976 Page 7 of 7 had seen the questionnaire that is attached to the August Bulletin. This questionnaire was approved by the Planning Commission and developed by Mr. Smoot. The meeting ADJOURNED at 11:32 A.
