Minutes of Meeting of Town Commission
Special Meeting
September 29, 1976 10:50 A. M.
Mayor Gilday called the Special Meeting to order at 10:50 A.M, and
annou nced that there would be a number of items to be heard at this
meeting.
Present were:
Mayor Morton E. Gilday
Vice Mayor William S. Hults
Commissioner Ruth E. Mumford
Commissioner Leslie W. Joy
Commissioner Robert D. Clark
Also present:
Elaine W. Roberts, Town Manager
Thomas E. Sliney, Town Attorney
Anton Drawl, Finance Director
Kathryn M. Borgemenke, Town Clerk
ECOSEARCH - DR. WILLIAM WOODMAN - PRIOR REPORT
Mayor Gilday announced that Dr. Woodman previously gave his
presentation at the Workshop meeting held this morning.
Commissioner Clark stated that Dr. Woodman has suggested
a program of poisoning the rats in such a way ao as to not
hurt the bird population, etc. The estimate was in the area
of $100/week and was suggested to be done .for at least four
weeks.
MOTION by Commissioner Clark/Vice Mayor Hults: "I move that we
try this out for an amount not to exceed $00.00 and see what
success we have with that."

Commissioner Mumford recommended that the people that do
live in ®ndominiums should increase interest in getting
rid of pests and rodents on their property.
APPOINTMENT - COMMUNITY APPEARANCE BOARD
Mayor Gilday called for the nomination of Arthur C. Roy,
Alternate Member, term to expire September 1977. The
Mayor then called for any other nominations. There were
none.
Nomination by Commissioner Joy/Commissioner Mumford.
ROLL CALL on the Nomination Carried Unanimously.
APPOINTMENT OF A COMMISSIONER TO_CONFER WITH TOWN MANAGER
STAFF EVALUATION
Mayor Gilday noted that this would be his function with
Commissioner Mumford assisting him and taking over for
him at such time as necessary.
MOTION by Commission Hults/Commissioner Joy: "I move that the Mayor
be appointed as the member of Commission to handle this matter, with
Mrs. Mumford as his alternate; to confer with the Town Manager on
the Staff Evaluation."
ROLL CALL on the Motion Carried Unanimously.
P1~OPOSED ORDINANCES - PUBLIC HEARING AND FINAL READING
Mayor Gilday noted that all of these ordinances were read
by title only at the Regular Meeting of the Town Commission
held on Wednesday, September 8, 1976.
Ordinance No. 298 - Amending Chapter 7 "Buildings" was
read in its entirety by the Town Clerk.

Mayor Gilday called for a motion to adopt this Ordinance
as read with an effective date as of this date.
MOTION by Commissioner Clark/Commissioner Mumford: "Move the
adoption of the Ordinance as read."
Discussion: Mayor Gilday recognized Mr. John O'Grady
who spoke about the fact that this ordinance would create
a hardship and a sizeable fee to the building industry.
He asked the Commission to consider this. Commissioner
Clark noted that the people that get the service should
be the ones that should pay for it. Mr. Dent noted the
increases over the past years for this service. He
stated for the record the ordinances and the amounts of
increase. Mr. Sliney noted that part of this ordinance
appears to be ambiguous and he would like clarification
from the building 6fficial. Mrs. Roberts read a memo
from the Building Official for the record.
It was the pleasure of the commission that this item
be postponed until Mr. Schott the Building Official
returned to the Town Hall.
Ordinance No. 299 - Budget 1976-77 was read in its entirety
by the Town Clerk. 'I'he Mayor noted the effective date of
this Ordinance will be October 1, 1976.
MOTION by Vice Mayor Hults/Commissioner Joy: "I move that we
adopt Ordinance No. 299, as read, effective as of October 1, 1976.
Publication date was September 15, 1976

It was pointed out by Mayor Gilday that the millage rate
of last year was 5.220 as against the new millage rate of
4.991. This is a decrease of 229' mills.
Ordinance No. 300 - Certifying Millage was read in its
entirety by the Town Clerk. This ordinance shall become
effective on October 1, 1976.
Mayor Gilday called for a motion that this ordinance be
adopted and to be effective on October 1, 1976.
MOTION by Commissioner Clark/Vice Mayor Hults: "So move."
ROLL CALL on the Motion Carried Unanimously.
Ordinance No. 301 - Amending Chapter 23 "Signs and
Advertising" was read in its entirety by the Town Attorney.
Mayor Gilday called for a motion to adopt this ordinance
with the effective date being today (September 29, 1976).
MOTION by Commission Clark/Commissioner Joy: "I so move."
ROLL CALL on the Motion Carried Unanimously.
Ordinance No. 302 - Amending Chapter 29 "Water System" was
read in its entirety by the Town Attorney.
MOTION by Vice Mayor Hults/Commissioner Mumford: "I move the
adoption of Ordinance No. 302."
Commissioner Clark noted that this had previously been
a standard operating procedure in the past and this
Ordinance is to clarify the policy established.

TAKE ANY DEFINITE ACTION ON THE ITEMS DISCUSSED AT THE
WORKSHOP OF THIS DATE.
Mrs. Roberts called to the attention of the Commission
to set a workshop meeting to discuss the contract with
the Engineering Firm.
Discussion relative to this subject followed and the
Commission agreed unanimously on Wednesday, October 6,
1976 at 2:00 P.M.
It was the consensus of the Commission at this time due
to the fact that the Building Official was not present
and the Town Attorney stated that he would like justifi-
cation for this ordinance; that this ordinance be post ;
poned and rescheduled for the Regular Meeting to be held
on Tuesday, October 5, 1976 at 1:30 P.M. The ordinance
was TABLED until that date.
• Mrs. Roberts noted that the term of the Chairman of the
Community Appearance Board, Mrs. Betty Jean Stewart, will
expire October'2, 1976. This item will be scheduled for
the Regular Meeting to be held on Tuesday, October 6, 1976.
Commissioner Clark asked that the Commission reaffirm the
previous Resolutions of the Town endorsing the 12th Street
bridge. Discussion followed relative to this subject and
it was decided to send copies of previous resolutions
and a cover letter to Delray City Commission, the Board of
County Commissioners and other interested parties, to re-
affirm the stand of the Commission of the Town of Highland
Beach; to urge prompt construction of said bridge.
MOTION by Commissioner Clark/Commissioner Joy: "I'll so mane that
we adopt the suggestions and send them covering letters and note
that this Commission on this day reaffirmed their previous actions."

Further discussion followed regarding petitions that are
being circulated throughout the town concerning this bridge.
BILLS FOR APPROVAL
The bills for approval were submitted to the Commission by
the Finance Director.

MOTION by Commission Joy/Commissioner Clark: "Approve the Bills."
ROLL CALL on the Motion Carried Unanimously.
Commissioner Mumford spoke on the subject of Florida Power
and Light increasing their rates. It was noted that the
rates have not ~Zet increased but there is an application
before the Public Service Commission. Mayor Gilday
directed the Town Manager to write to Florida. Power and
Light protesting any and all increases including the fuel
adjustment charge.
