• Minutes of Meeting of Town Commission
Special Meeting
January 23, 1978 2:00 P.M.
Mayor Horton called the Special Meeting to order at 2:00 P.M.
Present were: the Mayor, Vice Mayor Mumford, Commissioners
Clark, Joy and Storm. Also present were Mr. Walter Engdahl,
Attorney and Deputy Town Clerk, Bette Barker. The Town Manager
entered the meeting at 3:25 P.M. Mrs. Roberts had been attending
a meeting in Delray Beach with the Town Attorney, Thomas E. Sliney,
and the Building Official, Wally E. Schott.
Review of the Giordano law suit
Mr. Engdahl informed the Commission that this trial was
scheduled for a two week docket commencing January 30,
1978. Commissioner Storm asked that Mr. Engdahl review
the case. Discussion followed relative to the amount of
settlement and the portion covered under the Town's
insurance.
Mr. Engdahl reported that the attorney for Mr. Giordano
indicated that perhaps this case might be settled for
$7,500.00. He also noted that the insurance company
might not contribute any amount toward the settlement.
He then placed a call to the insurance company.
Mayor Horton took this time to report that the two police
officers working this week-end delivered memos to the Town's
residents informing them that a cut back in water
consumption would be necessary while the work at the water
plant was under way. He read the memo for the record.
The Mayor noted that arrangements had been made with Boca
Raton to supply the Town with water, on an emergency basis
only, should our supply become inadequate during this time.
Mayor Horton read a report from the Town Manager relative
to the work on the water plant filters.
Mayor Horton read a letter from Mr. Marvin Kemery dated
January 14, 1978 (see letter attached). The letter offered
the Town a small tract of land 20' in width, north of the
• Stewart property, for the amount of $20,000. It was the
consensus of the Commission that the Town Manager reply to

this letter, stating that the Commission discussed the
matter and were not interested in purchasing this property.
A Town resident suggested that should the Town purchase
the lot next to the Town Hall, an easement on the east
side of AIA should also be obtained for beach access
with necessary parking lot in rear of Town Hall and
issue stickers as in the case of Boca.
Mr. Engdahl returned to the chambers and reported on the
following: any judgment to the mental anguish of the
case shall be borne by the Town and not by the carrier.
The carrier does acknowledge that they are responsible
for the other element (the actual economical loss).
The carrier suggested that the Town take into consideration
some sort of settlement that should be along the lines
that the carrier would be willing to pay one-third of
any such settlement proposal and the Town would be
responsible for the remaining two-thirds.
• Discussion relative to the amount of settlement followed.
MOTION by Commissioner Storm/Vice Mayor Mumford to instruct the
attorney to make every attempt to settle this matter at a cost
not to exceed $6,000. (total) with an attempt to be made to hold
the cost to $4,800.
Discussion on ths.s Motion followed.
MOTION by Mayor Horton/Vice Mayor Mumford to amend main Motion by
striking out the $6,000. figure and stating that the Town is willing
to settle suit for $4,800.
ROLL CALL on the Motion to Amend carried unanimously.
ROLL CALL on the Main Motion as Amended carried unanimously.
