MOTION by Commissioner Clark/Commissioner Joy that the Minutes be
approved as read - carried 4 - 0 on a voice vote.
Public Requests and Comments
None
Request to be heard re: Town Lots 13 east and west owned by
Jaek Parker Construction, a/k/a Highland Beach Properties, Inc.
Mr. Flack stated that he would await the decision of the Town
Commission relative to his letter dated December 28, 1977.
Discussion regarding "vested rights" followed. After a great
deal of discussion, a MOTION was made by Commissioner Clark
and seconded by Vice Mayor Mumford that the reissuance of
the building permits as requested by Jack Parker Construction
a/k/a Highland Beach Properties, Inc., be denied. Roll call
vote carried 4 - 0.

(a) Mayor Louis Y. Horton - No report.
(b) Vice Mayor Ruth E. Mumford - No report.
(c) Commissioner Harold C. Storm - Absent.
(d) Commissioner Leslie W. Joy - No report.
• (e) Commissioner Robert D. Clark noted that he continues to
attend the "208" meetings in West. Pa lm Beach and to this
date nothing relative to Highland Beach has come up. He stated
that there will be a field trip at the end of the month.

(a) Planning Commission - Mr. Nick Johnson reported that a
Planning Commission Public Hearing, recessed from March
6th, would take place on Monday, March 13, 1978.
(b) Board of Adjustment - Mr. Lloyd Brotzman reported on a
meeting held on February 7, 1978. (See Board of
Adjustment Minutes - not attached)
(c) Housing Board of Adjustment and Appeals - Judge Santangelo
had no report but expressed his gratitude to the Town
Commission for the honorarium, that they had approved for the
Boards.
(d) Community Appearance Board - No report.
(e) Police Committee - Mr. Peter Genovese stated that all was
• very well with the Police. Department. Mayor Horton noted
that the new man will be reporting for duty approximately
March 20, 1978 and the new car on order. is to be delivered
shortly.
RESOLUTION (S )
Resolution No. 348 - "Petitioning the Board of County Commissioners
of Palm Beach County, Pursuant to Section 125.01(6)(a), Florida
Statutes, to develop an appropriate means of financing services
rendered specially for unincorporated areas" was read in its
entirety by the Town Clerk. MOTION by Vice Mayor Mumford and
seconded by Commissioner Clark that this Resolution be adopted
carried 4 - 0 on a Roll Call vote.
Proposal - Committee to study the division of Palm Beach County.
Resolution No. 349 - "Indicating the desire of the Town Commission
to study the feasibility of creating a new county in what is now
southern Palm Beach County" was read in its entirety by the
Town Clerk. MOTION by Commissioner Clark seconded by Vice Mayor
Mumford that this Resolution be adopted. Mayor Horton noted
that Section 3 "That the Town Clerk is directed to mail copies
• of this Resolution to all Municipalities named in Section 1 of
this Resolution" be added as an amendment.

MOTION to amend the original Resolution made by Commissioner
Clark and seconded by Vice Mayor Mumford carried 4 - 0
on a roll call vote.
MOTION to adopt Resolution as amended carried 4 - 0 on a roll
call vote.
Proposal - Delray Beach Library System - Ad hoc committee
Mayor Horton noted that this item had been discussed at the
Workshop Meeting and that an ad hoc committee had contacted
the Delray Beach Library. The Delray Beach Library would be
agreeable to serving the Town of Highland Beach at a cost
of $5.00 per person (population as stated on January 1, T978 -
approximately 2400). Discussion relative to total cost
followed. MOTION by Vice Mayor Mumford and seconded by
Commissioner Clark that the ad hoc committee further discuss
negotiations and reach a compromise with the Delray Beach
• Library and report back to the Town Commission - carried
4 - 0 on a voice vote.
Reports, Correspondence and Continuing Reports, Elaine W.
Roberts, Town Mana er
The Palm Beach County Municipal League for February was held
in Boynton Beach. David Bbudworth, State Attorney, addressed
the meeting. Mrs. Roberts stated that the State Attorney
indicated that the legislators might set up a process which
would enable Municipalities to hold court by virtue of a
"Hearing Officer". The March meeting is scheduled for Friday,
March 10, 1978.
The Treasure Coast Regional Planning Council will be meeting
on March 9, 1978.
The Solid Waste Committee is meeting March 8, 1978 in West
Palm Beach.
Mrs. Roberts announced that donations in the amount of $250.00
to the Del Trail Fire District for the "Jaws of Life" have
been received from Highland Beach residents.

Mr. Carberry, representative to the Water District Management
meetings relative to a Public Hearing held on March 1, 1978.

BUILDING DEPARTMENT REPORT
A C.O. was issued to one of the Wunderlich's four-plexes located
on AIA on February 23, 1978. During the month of February
permits were issued in the value of $315,000.00.
FINANCE DEPARTMENT
An additional amount of $13,209.00 in tax monies has been
received.
POLICE DEPARTMENT
Mrs. Roberts reported that Police Officer Donald Kasten will
• be reporting to work on March 20, 1978. She noted that the
monthly report is available for anyone to look it over.
TOWN CLERK'S DEPARTMENT
Most of the work has been in the area of the new election laws
and answering questions relative to the election. The Town
Manager and Town Clerk worked together in mailing legal notices
to property owners in Town with the exception of the two
subdivisions. (These instructions per Town Attorney) This was
in relation to the Public Hearings for the Comprehensive Plan.
PUBLIC WORKS AND WATER
The total water treated for the month of February was 23,277,000
gallons. Mrs. Roberts stated that this was about the same as
the month of January. She noted that the gap in the measured
water from the east side of the Intracoastal to the west side
has narrowed.
Mrs. Roberts noted that the monthly report from Carl Howard
is available.
• The next Public Hearing of the Planning Commission relative to
Zoning will be held on Monday, March 13, 1978 at 7:00 P.M.
This was recessed from Monday, March 6, 1978.

The Mayor noted that the consideration of the Comprehensive
Plan would be the business at hand at this time and he
called on Commissioner Clark for his comments.
There was a great deal of discussion among the Town Manager,
Mayor and Commissioner Clark. After the discussion, the
MOTION was made by Commissioner Clark, seconded by
Commissioner Joy, that the Comprehensive Plan as read at the
Public Hearings and as incorporating the corrections noted
during the Public Hearings, including the map and the future
development plan, be approved. The MOTION carried on a roll
call vote 3 - 1. .Mayor Horton voted No. By a 3-- 1 vote
• the matter was carried, the Comprehensive Plan was adopted.
Two citizens in the audience spoke on the adoption of the
Comprehensive Plan.
NEW BUSINESS
Mayor Horton recognized Mr. Charles Danto, representative for
Mr. Catsman. Mr. Danto asked to go on record to state he had
not been able to discuss the specific inconsistencies in the
Comprehensive Plan re: Lots 92, 93 and 94 as designated by
the Town of Highland Beach.
Mr. Sliney commented on the matter of notices for the Public
Hearings and the adoption of the Comprehensive Plan at the
Regular Meeting.
