1978.06.06_TC_Minutes_Regular TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission Regular Meeting June 6, 1978 1:30 P.M. Mayor Horton called the Regular Meeting to order at 1:30 P.M. Present were; Mayor Horton, Vice Mayor Mumford, Commissioners Joy, Clark and Storm. Also present: Town Attorney, Town Manager, Chief of Police and Town Clerk. Approval of Minutes, as written: For Meetings of: April 25, 1978 - Special Meeting & Workshop May 2, 1978 - Regular Meeting MOTION by Commissioner Storm/Vice Mayor Mumford that the Minutes be approved carried unanimously on a voice vote. Public Requests and Comments The following people spoke on the subject of the Library: • J. O'Brien, Mrs. N. Johnson, Mrs. Doris Rome and Mrs. Trudy Blankenship. Mayor Horton announced that the Proposed Zoning Ordinance would be discussed at a Public Hearing held for this purpose on Monday, June 12, 1978 at 7:30 P.M. It was brought to the attention of ..the Commission that the Highland Beach Civic League Trustees presented to Sgt. Cecere the amount of $1,000.00 to be applied to a scholarship for his son who will enter college next year. Reports - Tun Commission (a) Mayor Louis Y. Horton. Mayor Horton reported on corre-- spondence between him and Mayor Cudahy, Palm Beach, pertaining to A-1-A state road designation. Mrs. Roberts read from a letter from the DOT, dated May 17, 1978 stating that A-1-~A is minor arterial road and will remain on the highway system and that there will be no functional change to the classification. Mayor Horton reported he had received two replies to his letter of May 12th re: returning the court system to the municipalities. He read his letter for the record. He read the. replies for the record from Rep. John Considine, Chairman, Palm Beach County Legislative Delegation and Representative Don Hazelton. Minutes Highland Beach Town Commission • Regular Meeting June 6, 1978 Page 2 of 7 It was the consensus of the Town Commission that the Mayor answer Mr. Arthur Roy's letter re: beach cleaning and inform him that, at this time, the Town would not engage in this type of activity. Mayor Horton read a letter from the Highland Beach Civic League, David O'Dunne, President, re: Holiday Inn. This item will be scheduled for the Workshop Meeting, June 27, 1978. The Mayor gave a report on Healy vs. Town of Highland Beach. The 4th District Court of Appeals has found for the Town. A letter dated May 10, 1978, from the Planning Commission was read by the Mayor for the record re: acceptance of concept drawings, Boca Highland, RPUD - east side. The dedication of the new facility for the Civil Defense Emergency Operating Center will be held June 21st, 1:00 P.M. • at 3723 Belvedere RB., West Palm Beach. Chief Jones, the Town Civil Defense Coordinator, was requested to represent the Town. At this time it was announced that the Hurricane Lecture will be held on Tuesday, June 13th at 7:30 P.M. in the Town Hall. (b) Vice Mayor Ruth E. Mumford - No report (c) Commissioner Harold E. Storm - No report (d) Commissioner Leslie W. Joy - No report (e) Commissioner Robert D. Clark - No report Reports of Various Agencies of the Town (a) Planning Commission - No report. (b) Board of Adjustment - A letter from the Chairman, re: vacancy of Alternate Member was read by the Mayor. MOTION by Vice Mayor Mumford/Commissioner Clark that Mr. E. E. Aldrich be promoted to 1st Alternate and Mr. Arthur Kiefer be appointed to 2nd Alternate carried unanimously by voice vote. (c) Housing Board of Adjustment and Appeal - No report. (d) Community Appearance Board - No report. • (e) Police Committee - Mr. Peter Genovese referred to a letter to the Mayor from the Committee recommending expenditure of $1,000.00, donation from Mr. J. Meadows. Minutes Highland Beach Town Commission • Regular Meeting June 6, 1978 Page 3 of 7 Mr. Genovese referred to "labor negotiations" held on June 6th. He then lauded the Police Department for its performance in the past month. The Mayor then read the Police Committee's recom- mendations, dated May 18th, re: letter of commendation to Police Department and contribution from Mr. Meadows. Mayor Horton read a letter of recommendation from the Chief of Police for various items to be purchased for the new police car. These would be covered by the donation. MOTION by Commissioner Clark/Vice Mayor Mumford to approve the items as set forth by the Chief in his letter dated May 24th, carried unanimously on a voice vote. RESOLUTION Resolution No. 351 - commending Police Officers was read in its entirety by the Mayor. MOTION by Commissioner Storm/Commissioner Joy to adopt the Resolution carried unanimously on a Roll Call vote. • ORDINANCE Ordinance No. 335 Amending Chapter 134 entitled "Housing" was read in its entirety by the Town Clerk. MOTION by Vice Mayor Mumford/Commissioner Clark that this ordinance be adopted carried unanimously on a Roll Call vote. Sewage System - Call-out Expense Mrs. Roberts stated that the amount of this is $963.66, Mr. Howard is proposing to divide this by 9 and apply $107.07 per month in addition to his regular call-out expense. MOTION by Commissioner Clark/Mayor Horton that these total call-out expenses of $963.66, be approved with the method of payment to be worked out between the Town Manager and Mr. Howard, carried unanimously on a Roll Call vote. Library Mayor Horton gave a report on the May bulletin questionnaire relative to-this subject. He suggested that this item be referred back to the committee for further action. The Commission was in agreement. It was also suggested that a more detailed survey be included in a future bulletin on this subject. U Minutes Highland Beach Town Commission Regular Meeting • June 6, 1978 • Page 4 of 7 Reports, Correspondence and Continuing Reports, Elaine W. Roberts. The Palm Beach County Municipal League Meeting was held in Lantana on May 12, 1978. The Executive Board met on May 26th in Atlantis and the next meeting of the League will be held on June 9th in Delray Beach City Hall 1:45 P.M. The June meeting for the Treasure Coast Regional Planning Council has been cancelled. Mr. Frank Carberry suggested schedulsng a tour of the Water Management District Office on Copans Road the week of June 12th. After discussion among the Commission a date was tentatively set for Thursday, June 15th. Mx's. Roberts noted that there were changes made in the require- ments for the advertising for Federal Revenue Sharing and the solicitation of comments on the expenditures. She reported a requirement for her as Town Manager to call a Public Hearing before budget proceedings, as required by federal law. She informed the Commission that their presence was not required at this particular hearing, but that they were welcome to attend. She noted that the amount of Federal Revenue sharing anticipated for next year was approximately $8,640.00. Notice of Public Meetings received by the Town Manager: Solid Waste, June 7, 1978, 11:00 A.M., West Palm Beach. Letter from Chairman, Palm Beach County, Board of County Commis- sioners acknowledging a Town Resolution re: Municipal Service Taxing District. Meeting for MPO, Planning Organization for the new transportation authority on June 15th. A letter of thanks was received from Senator Lawton Chiles for extending the use of the Commission Chambers for his representative's visit on May 19th. A notification from the DER relative to the dredge and fill application and results of the Administrative Hearings held in Town Hall in November 1977, for Mr. Urbanek's lots 93 and 94. The Secretary, J. Landers, has denied the permit. A draft of the proposed County Charter was received from the County Commission and is available to review. A solar energy meeting will be held on June 7th in West Palm Beach at the Palm Beach County Extension Office on Military Trail . Minutes Highland Beach Town Commission • Regular Meeting June 6, 1978 The Town Manager reported on Town Departments: Page 5 of 7 Building De artment: There were building permits issued, but no Certificates of Occupancy issued in May. The new Building Official, Francis Hamzik, commenced work on Tuesday, May 30, 1978. Finance Department: A public hearing re: Federal Revenue Sharing will be required by the Town Commission. It is tentatively scheduled for July. Work has started on the new accounting system. Money available for investments will be applied toward certificates at an anticipated increased rate, the amount to be determined at the end of the month. Health Department: A recommendation from Tom Virgin will be forthcoming re: continuance of the Lethal Yellow Program. • Mrs. Roberts spoke about the land in Highland Beach that was offered for sale to the County by a Boynton Beach realtor. The meeting regarding this subject was rescheduled from Monday, June 5, 1978 to Monday, June 12, 1978. In view of the fact that a representative will not be available to attend, it was decided that any and all previous material explaining the Town's stand on this matter be related to the County Administrator. It was also noted at this time that this particular property is zoned Multi-Family Residential and not for park or public purposes. Maintenance- Michael Coppola has performed the normal maintenance. The Malayan palm trees purchased from Boca Raton have been planted and ten more seedlings are on order from the Dept. of Agriculture. He has gone to Winter Park today to deliver and pick up pumps for the lift stations. Police Department: Mayor Koch of Gulfstream, the budget hearings representative to • the CDC, requested Mrs. Roberts to look over the proposed CDC budget for the next fiscal year. The Town will be assessed about $5,900.00 for the next fiscal year. Mrs. Roberts gave a breakdown per call for each Municipality. Discussion on this matter followed. The monthly report (May) from the Police Department was distributed. The Building Official reported on the tree removal by Highland Towers for a parking lot. Town Clerk's Department: The bid tabulations for fence relocation around a portion of the water plant, was completed. Vendors were contacted for estimates on emergency generator for Town Hall and Police Station and routine work was done. Public Works and Utilities; Mr. Spencer is continuing the newspaper pickup on Tuesdays. The cul-de-sac issue on Bel Air Drive is not yet resolved. A pre-construction conference will be held on Wednesday, June 7th at 1:30 P.M. re: work at the water plant. The water consumption for the month of May is down a little bit by 1,000,000 gallons. The DOT completed installation of cross- walks and no-passing lanes. Traffic count for the winter of 1977 was 9,535 vehicles and spring of 1978 was 9,087. The DOT has asked for a bridge designation number for the Bel Lido Bridge and sent a form for reporting on the inspection of that bridge, that was performed in 1977. Zoning: Mrs. Roberts reported that she and the Deputy Town Clerk will update the proposed zoning ordinance this week in preparation for the Public Hearing June 12th, by compiling a list of all changes. Mrs. Roberts noted that after a discussion with Dr. Orman the words "and others as permitted by this ordinance" should be added on Pages 5 and 7, Sections 4.4 (c) and Section 4.5 (c) of the proposed zoning ordinance. Unfinished Business: Mayor Horton recognized a taxpaper who explained the fill located on the lot south of Seagate. (Lot 97). Bills for Approval MOTION by Commissioner Clark/Vice Mayor Mumford to approve the bills carried unanimously on a Voice Vote. Meeting ADJOURNED at 3:30 P.M.
