1978.09.05_TC_Minutes_Regular• TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission Public Hearing Regular Meeting September 5, 1978 1:30 P.M. Mayor Horton called the Regular Meeting-Public Hearing to order at 1:30 P.M. Those in attendance were: Mayor Horton, Vice Mayor Mumford, Commissioners Bauer and Storm. Also in attendance were Mrs. Elaine W. Roberts, Town Manager, Thomas E. Sliney, Town Attorney, Kenneth Jones, Chief of Police, and Jane E, Barker, Acting Town Clerk. Commissioner Clark was absent. PLEDGE OF ALLEGIANCE Public Requests and Comments None • Item No. 4 on the agenda called for a Public Hearing, as advertised in the Boca News August 16, 1978 for Federal Revenue Sharing and General Operating Budget for Fiscal Year 1978-79. Mayor Horton called for suggestions from the audience as to ways the Federal Revenue Sharing money should be spent. Mrs. Louise Johnson, a Town Resident, suggested that some of this money be spent for mowing the properties along A-1-A. Mrs. Johnson also questioned the model which is still located south of Seagate of Highland and a trailer, on the Ambassadors South property, which has been there for two years. Mayor Horton asked if there were any more suggestions con- cerning the Federal Revenue Sharing money and Commissioner Bauer stated that he wished to change a statement that he had made at the Workshop Meeting last week. At that meeting, he felt that the Federal Revenue Sharing money should be used to purchase an emergency generator for the Police Department and Town Hall should the electricity be off in the Town due to a disaster. • Minutes Highland Beach Town Commission • Public Hearing-Regular Meeting September 5, 1978 Page 2 of 8 Since that time, Commissioner Bauer has revised his theory and due to the death of a close neighbor, Commissioner Bauer feels that emergency medical equipment for cardiac patients should be purchased instead. The two most necessary items would be a resuscitator and a defibrillator. Commissioner Bauer further stated that he would contact Fire Chief Frye and check this matter out further. Draft No. 2 of the General Operating Budget was discussed next and Mrs. Roberts requested the Commission's advice regarding the legal fees and the contingent fees for the upcoming Fiscal Year. She also stated that it was felt. that the cost of Sgt. Cecere's transportation to the F.B.I. Academy could be covered by the Police Budget. Mrs. Roberts suggested that the Commission call another Public Hearing for the same day that they pass the Ordinance setting the millage rate and adopting the Budget, which would be September 26, 1978. It was the consensus of the Town • Commission that a Public Hearing, a Special Meeting and the regular Workshop Meeting be held on September 26, 1978, starting at 9:30 A.M. Mayor Horton questioned Attorney Sliney regarding legal fees for the coming year. After some discussion, it was the con- sensus that the legal fees be held as is. In polling Commission, the vote was unanimous. Mayor Horton then announced that the Commission would have thirty days to fill this vacancy. However, if a suitable • Commissioner would apply and be chosen before that time, a swearing in could take place at the Special Meeting to be held on September 26, 1978. Minutes Highland Beach Town Commission • Public Hearing-Regular Meeting September 5, 1978 Page 3 of 8 Mayor Horton stated that the Drexel case has been dismissed by the Judge on motion of our counsel. Mayor Horton then announced that, as of this morning, there was an agreement between our counsel and the counsel for Mr. Urbanek to continue this case until December 18, 1978. An old truck bed, which was found on the former Guala prop- erty, has been removed by the Police Department. Mayor Horton stated that this is now located behind the Town garage and an effort is being made to find the owner. Mayor Horton then discussed the matter of water usage at great length. He was specifically speaking of the case where a tenant had a huge water bill and was not aware that the water had been used. He asked that the Commission give some thought to the idea of having a base figure for differ- ent meter sizes, with a sliding scale. He also stated that he hoped to have something for the Commission's consideration • by the next Workshop Meeting. (b) Vice Mayor Mumford - No report. (c) Commissioner Bauer - Commissioner Bauer stated that he had spent the Holiday weekend catching up on an enormous amount of reading and as a result of this, he definitely supports the Town in the Urbanek case. (d) Commissioner Storm - No report. Reports of Various Agencies of the Town (a) Board of Adjustment - Mrs. Roberts reported that the Board of Adjustment has a Public Hearing scheduled for Monday, September 18, 1978 to hear two cases. (b) Community Appearance Board - William Atkinson was selected as the new Chairman of the CAB, and James Schubert is the Vice-Chairman. (c) Housing Board of Adjustment and Appeals - Their next • meeting will be held on Wednesday, September 13, 1978 at 7:30 P.M. Their next meeting will be September 13, 1978 at 7:30 P.M. (e) Police Committee - The next meeting of the Police Committee will be September 19, 1978 at 10:00 A.M. Resolution No. 356 Resolution No. 356 - honoring former Mayor Hackman - was read in full by the Acting Town Clerk. .~ MOTION by Vice Mayor Mumford and seconded by Commissioner Storm ,,~''` that the Resolution as read and amended be adopted. In polling the Commission, the vote was unanimously in favor of adopting tie Resolution. Ordinance(s) • Ordinance No. 338 - An Ordinance amending Chapter 29 of the Code of Ordinances - entitled "water System", was read in full by the Acting Town Clerk. MOTION by Commissioner Storm/Vice Mayor Mumford that the Ordinance as read be adopted. The vote was unanimous. Mrs. Barker then read by title only the following Ordinances: An Ordinance amending the following articles of Ordinance No. 252, which established a Pension and Retirement System, namely: Articles I, II, IV, V, VIII, X and XV, Mayor Horton questioned Article VIII, Paragraph 2 and asked that Mrs. Roberts check this out in time for the Workshop Meeting. An Ordinance amending Ordinance No. 322 which appropriated funds for the Fiscal Year 1977-78, which began October 1, 1977 and ended September 30, 1978. An Ordinance appropriating funds for the Fiscal Year 1978-79, • beginning October 1, 1978 and ending September 30, 1979. Mayor Horton announced that these proposed Ordinances would be discussed and voted on at the Special Meeting on September 26, 1978 - this being the first reading. Request from Hi-Riser Realty, Inc. for relief of Section 23.7 Mayor Horton read for the record a letter dated August 23, 1978 from Hi-Riser Realty, Inc. Mayor Horton stated that the intenb~ of this Ordinance originally had been to stop speculative selling. Inasmuch as this letter was from a ~ ~ real estate company, Mayor Horton recommended that a letter::-'`f be written to Hi-Riser Realty, requesting the name of th~- owner of this property and precisely what their plans are. Sgt. Cecere's application to FBI School Mayor Horton read a letter to the Town Commission from the Police Committee dated August 9, 1978 concerning Sgt. Cecere's application to FBI School and a recommendation that Sgt. Cecere's application be approved by the Town ,'r `s Commission. -~+' The costs involved in this would be two round trip tickets from Fort Lauderdale to Washington. Commissioner StorrQ suggested that Sgt. Cecere arrange to attend this school during the slack season in Florida - a Spring or Summer session. MOTION by Commissioner Bauer/Vice Mayor Mumford that Sgt. Cecere's application be approved with the expenditure of two round trip tickets and urging that attendance be in an off-season quarter. In polling the Commission, the vote was unanimous to approve this application. Reports - Town Manager Mrs. Roberts reported that the Palm Beach County Municipal League would be meeting September 8; read a letter from Frank Kohl, City Manager of Boynton Beach regarding Emily Jackson, the new President of the Palm Beach County Munic- ipal League; the Treasure Coast Regional Planning Council Minutes Highland Beach Town Commission • Public Hearing-Regular Meeting September 5, 1978 Page 6 of 8 meeting in Stuart on September 14th; the South Florida Water Management District public hearing on September 26th in the Resource Center in Pompano: the Florida Shore & Beach Preser- vation Society annual beach seminar October 4th thru 7th at Captiva Island. She stated that an invitation had been received from the Palm Beach County Taxing District Library Advisory Board to the dedication of the library headquarters extension on Sunday, September 17, 1978 at 2:00 P.M. Correspondence was received from the Department of Transpor- -~' tation and a thank you from Mrs. Krauss. Mrs. Roberts told the Commission that she was going to insert an ad in the paper for a "floater-type" person to help the Acting Town Clerk and also to help out in the Finance Depart- ment. This is provided for in the budget. • The Building Department issued several occupational licenses and several building permits this month. They have also had a large mailing for the occupational licenses for the coming year. The Finance Department has been busy. Mrs. Roberts reported that on the 8th of August a Franchise check was received from Florida Power & Light in the amount of $58,824.89 for the year ending July 7th. This figure has been increasing approx- imately $6,000.00 a year for the last five years. We also received $134.71 for investment earnings on the taxes. Mrs. Roberts further reported that under the Health & Main- tenance Department we received ten more Malayan Palms from the State Division of Forestry. Diana Kerher will be leaving on September 15th. Police Department - Mrs. Roberts noted that there have been some larcenies lately, which seems to happen whenever new building is started. A letter of commendation was received from a Mrs. John Abbott and a Mrs. Joseph Moore, thanking a patrolman for his kind assistance on August 20, 1978. They • did not know the name of the police officer but it was de- termined that it was Sgt. Cecere and this information has been passed along to all parties concerned. Minutes Highland Beach Town Commission • Public Hearing-Regular Meeting September 5, 1978 Page 7 of 8 Mayor Horton made two announcements concerning the police; one regarding the manager of one of the apartment-motels in Town renting to people with undesirable friends, who staged a rather wild party. She called the Police Department and the two men on duty were Sgt. Cecere and Officer Blonder who took care of the situation very quietly and efficiently. Another friend of Mayor Horton's, who lives in Admiral's Walk, feels that he has double protection inasmuch as the Highland Beach police seem to "keep their eyes opened" for anything unusual around that area and he conveyed his thanks to Mayor Horton. Mrs. Roberts made note of the fact that there is a list of local disaster shelters posted on the Bulletin Board. Mrs. Roberts gave the 8-months' total of water consumption - on the raw water meter, the total for 8 months is 188,698,000 • and on the treated water it is 191,560,000. Discussion took place regarding treated and untreated water. She is still investigating re: the emergency generator. She stated that she has been meeting quite oftea~-with the Engineers, Ross, Saarinen, Bolton & Wilder. Mrs. Roberts further stated that the monthly report from the sewage system operator is on the clipboard, the cut in Bel Lido Drive has been repaired by Hardrives and copies of the final zoning ordinance have been distributed. Unfinished Business Mayor Horton questioned Mr. Sliney regarding the status of the "drug bust boat". Mr. Sliney will look into this. New Business Commissioner Storm asked if a Resolution could be presented to former Commissioner Clark.
