1978.09.26_TC_Minutes_Special TOWN OF HIGHLAND BEACH, FLORIDA • Minutes of Meeting of Town Commission Public Hearing and Special Meeting September 26, 1978 9.30 A M Mayor Horton called the Public Hearing and Special Meeting to order at 9:32 A.M. Those in attendance were: Mayor Horton, Vice Mayor Mumford, and Commissioners Bauer and Storm. Also in attendance were: Mrs. Elaine W. Roberts, Town Manager, Kenneth Jones, Chief of Police, and Mrs. Jane E. Barker, Acting Town Clerk. Mayor Horton announced that the first item on the agenda concerned the proposed use of Federal Revenue Sharing Funds. Several suggestions have been submitted in the past and it is part of the Federal Program that Public Hearings be held concerning this matter which was adver- tised in the Boca Raton News on September 8, 1978. Mr. Dent, a Town Resident, stated that the south parking lot in the rear of the Town Hall property should be paved. Mayor Horton informed him that this had been discussed • before and is in the program for our Capitol Improvements. Mrs. Blankenship, another Town Resident, stated that she thought Commissioner Bauer's idea of purchasing emergency medical equipment was an excellent one. Commissioner Bauer said that his other suggestion was to buy an emergency generator for the Police Department's use in case of a power failure. The total amount of money involved under Federal Revenue Sharing is $6,482.00. Mayor Horton stated that the above matters are all planned for this year. Vice Mayor Mumford would like to see the maintenance of the bike/hike path upgraded. Mrs. Roberts reported that the DOT is supposed to be on a 5 week schedule to mow throughout the Town, however, it is more like a 10 to 15 week schedule. Our maintenance man is extremely busy and is in need of some help in order to maintain the bike/hike path as it should be. The Public Hearing ADJOURNED at 9:40 A.M. The Special Meeting began immediately. • Mayor Horton asked if anyoQe in the audience cared to address themselves to any item on the agenda. One Town Resident made a few remarks. Minutes Highland Beach Town Commission Public Hearing and September 26, 1978 Special Meeting Page 2 of 5 ORDINANCES - Second and Final Reading Ordinance No. 339 - Amending the Retirement Plan Ordinance No. 340 - Amending the 1977-78 Budget Ordinance No. 341 - Appropriating Funds for the Fiscal Year 1978-79 Ordinance No. 342 - Effecting a Tax Levy These Ordinances were read in full by the Acting Town Clerk. The Town Manager explained in Ordinance No. 339 - Article II, Paragraph 1, the addition of two entry dates for employees to join the Plan October 1 and April 1. She stated that the Town Attorney had advised her that the Plan should be passed today and, if necessary, changes could be made at a later date. MOTION by Commissioner Bauer/Vice Mayor Mumford that Ordinance No. 339 be approved as read by the Acting Town Clerk with the exception • that Article II, Paragraph 1 will include a statement concerning two entry dates into the Plan. In polling the Commission, the vote was unanimous. MOTION by Commissioner Storm/Vice Mayor Mumford that Ordinance No. 340 be approved as read. In polling the Commission, the vote was unanimous in adopting this Ordinance. MOTION by Commissioner Bauer/Commissioner Storm that Ordinance No. 341 be approved. In polling the Commission, the vote was unanimous. MOTION by Commissioner Storm/Vice Mayor Mumford that Ordinance No. 342 be adopted. In polling the Commission, the Ordinance was adopted unanimously. Resolution To Fill Vacancy On Town Commission The next item on the agenda was a Resolution to fill the vacancy on the Town Commission. Mayor Horton read for the record a letter received from Gertrude Blankenship, a candidate for the Town Commission. Mrs. Blankenship then addressed the Commission. Mr. Peter J. Genovese then sub- • mitted his name for consideration, and gave a brief resume of his career. Mr. M. H. W. Dent also offered his name for consideration. • Minutes Highland Beach Town Commission Public Hearing and Special Meeting September 26, 1978 Page 3 of 5 Mayor Horton asked if any others wished to submit their name for the vacancy. Being none, he explained that, as in the past, the Commission has voted by ballot to fill the Town Commission seat. Prior to the voting, it was stated that it would be necessary that Mr. Genovese resign from his position as Police Commissioner and Chairman of the Police Committee, which he did orally and will follow up with a written letter of resignation. MOTION by Commissioner Bauer/Vice Mayor Mumford that Mr. Genovese's resignation from the Police Committee be accepted as stated above. The voice vote was unanimous. A vote was then taken by ballot and Mr. Peter J. Genovese was unanimously elected as Town Commissioner. • The Acting Town Clerk then read the Resolution naming Mr. Genovese to the Town Commission effective as of September 26, 1978. (Resolution No. 357) MOTION by Commissioner Bauer/Vice Mayor Mumford that the above Resolution (No. 357) be adopted. In polling the Commission, the vote was unanimous in favor of naming Mr. Peter J. Genovese as Town Commissioner. The Acting Town Clerk then administered the Oath of Office to Commissioner Genovese. (Oath was re-administered on September 29, 1978 at 2:55 P.M.) Appointment to fill vacancy on Retirement Board Next item on the agenda, as announced by Mayor Horton, was an appointment to fill the vacancy on the Board of Trustees, Reti rement Plan. MOTION by Mayor Horton/Commissioner Bauer to appoint Commissioner Storm to fill this vacancy. By voice vote the appointment was unanimous. • • Minutes Highland Beach Town Commission Public Hearing and September 26, 1978 Special Meeting Page 4 of 5 Resolution To Appoint Town Clerk Mayor Horton then read Resolution No. 358 appointing Jane E. Barker as Town Clerk, effective October 1, 1978. MOTION by Vice Mayor Mumford and seconded by Commissioner Storm to appoint Jane E. Barker as Town Clerk. Voice vote was unanimous. Ross, Saarinen, Bolton & Wilder Proposal - Aquifer Performance Test • Mayor Horton announced that the Town has been working with the water Management District for an increase in our water allocation. They have requested that we prov ide them with information concerning an Aquifer Performance Test. The Town has requested that our engineers, Ross, Saarinen, Bolton & Wilder, give us this information and they have submitted the attached proposal. Mayor Horton then read into the record Commissioner Bauer's letter of September 20, 1978, containing comments on the proposal. After considerable discussion regarding this matter, it was the consensus of the Commission that they would accept the $7,860. proposal from Ross, Saarinen, Bolton & Wilder to perform this test, providing they would work closely with the U.S.G.S., in order to obtain any information, data, statistics and/or assistance, so as to keep the cost some- what under the approved amount. • MOTION by Commissioner Bauer/Vice Mayor Mumford that we proceed with the Aquifer Performance Test at a cost of $7,860.00 with the understanding that if the U.S.G.S. is able to give information to the engineers that will lower this cost, the engineers will pro- ceed on that basis. In polling the Commission, the vote was unanimous. Mayor Horton then summarized, for the benefit of all, the water conservation plans. He has included a supplement in the current Bulletin, stating different means of conserving water, and has sent letters to the Presidents of the various Condominium Associations, suggesting to them that it might • Minutes Highland Beach Town Commission Public Hearing and Special Meeting September 26, 1978 Page 5 of 5 be desirable for them and their Board to visit. the Water Resource Center in Pompano to get the complete story of water conservation. Bills for Approval Maree Birkbeck, Finance Director, presented the bills for approval. There was some discussion regarding the unemploy- ment compensation being paid to Mr. Dr~sal.
