1978.10.31_TC_Minutes_Workshop r1 L_J TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission Workshop Meeting • October 31, 1978 9:30 A.M. Mayor Horton called the Workshop Meeting to order at 9:30 A. M. In attendance were: Mayor Horton, Vice Mayor Mumford, Commis~~ioners Bauer, Genovese and Storm. Also in attendance were the Town Manager, Mrs. Elaine W. Roberts, the Town Attorney, Thomas E. Sliney and Jane E. Barker, Town Clerk. There were many Town residents in the audience. Mayor Horton called for comments regarding the Urbanek law suit (Item No. 73.47 on the Agenda) from the audience and there were several resi- dents who spoke: former Mayor Gilday, Evelyn Houck, Robert Myers, Col. Hauck of the Civic League, Mr. Dent and Mrs. Louise Johnson. Also commenting were Attorney Sliney, Vice Mayor Mumford, Commissioner Storm and Mayor Horton who commended the Town Commission for the great amount of time they have devoted to this matter, stating that they have all worked hard to arrive at a fair and just decision. Mayor Horton outlined three alternatives regarding a decision and it was decided that a Special Meeting would be held on Friday, November 3, 1978 at 2:00 P.M. for a decision regarding the Urbanek proposal. 78.28 Highland Beach Utilities Company Mayor Horton explained that when the new Regional Treatment Plant goes into operation in a few months, the Highland Beach Utilities Company will be losing revenues of $200.00 per dwelling unit, due to the fact that the package treatment plant north of the Church will be closed. It was Mayor Norton's suggestion that this fee be raised to one similar to our neighboring communities. The sooner the Highland Beach Utilities Company recovers their cost, the sooner the Town will receive these tap-in fees. Mayor Horton thought that a $500.00 tap-in fee should be put into effect as soon as the Area Treatment Plant goes into operation. This would be for all new construction. • The Town Attorney was requested to draw up a new Ordinance covering this so that it could be considered at the December ~~egular Meeting. Minutes Highland Beach Town Commission • Workshop Meeting October 31, 1978 78.47 Urbanek Law Suit This matter was covered above. 78.65 Vacancies on Town Boards Page 2 of 6 (a) Board of Adjustment - Mrs. Roberts stated that all members of the Board of Adjustment except Lloyd Brotzman and Royce Frederick are up for reappointment. None of these members have been contacted as yet regarding their reappointments. (b) Community Appearance Board - Two members - Norman Hile and Amelie Leng - were appointed to serve out expiring terms, and these have now expired. If these two members were appointed, they would be considered as new members to the Board. Betty Jean Stewart's term expires - she has been contacted and is willing to serve. She is an original • member of this Board. (c) Police Committee - Mayor Horton read for the record his memo of October 16, 1978, to the Town Commission, regarding the disbanding of the Police Committee. There was dis- cussion regarding this Committee and also the matter of limiting terms of service for all the Boards and Committees. It was felt that by limiting the terms of office that more and more people in Town could become involved. This will be considered further at the Regular Meeting on November 8, 1978. 78.69 Proposed Ordinance No. 343 This Ordinance would amend Ordinance No. 331, which amended Sections of Chapter 19 of the Code of Ordinances entitled "Plumbing Code". This had a first reading on October 3, 1978 and will come up for second reading and possible adoption on November 8, 1978 at the Regular Meeting. 78.70 Water Management District Mayor Horton stated that he had attended a meeting on October 20, • 1978 with Mr. John Roberts and Mr. Tom Prickett of Ross, Saarinen when they met with Dr. Pat Gleason, Mr. Bruce Adams and Mr. Lauren Minutes Highland Beach Town Commission • Workshop Meeting October 31, 1978 Page 3 of 6 Howard of the Water Management District. The purpose of the meeting was twofold: l.) to review the additional information which WMD required on various applications for water use; and 2.) to discuss our immediate needs for additional water and our estimate of long range requirements. Mayor Horton stated that the meeting was most encouraging. It will be necessary that the Town plan for expansion of the water plant in order to accommodate the new people who will be moving into Town. The new tap-in fees will take care of some of this, however, it will be necessary to float a bond issue. This will be discussed further at future meetings. Mrs. Roberts discussed then the catalyst sand area and the high service pump check valve. Regional water was discussed and Mayor Horton stated that there were communities in Palm Beach County which did not have good water. He thought regional water would be used to • supply these municipalities and would not override present systems which do have good water. 78.71 Emergency Medical Equipment Commissioner Bauer reported that last Friday night, the entire. Police Department and he took the CPR course which lasted three hours. He further reported that figures for ambulance service are extremely high. The ambulance service for Highland Beach is the Atlantic Palm Beach Ambulance. 78.72 Proposal to purchase commercial type mower for path area Mrs. Roberts stated that the grass and the area around the bike path has been a source of complaint for a long time. She has had Michael Coppola look at mowers inasmuch as a heavy piece of equipment is badly needed. She recommended to the Commission that $2,339.96 from the unexpended Federal Revenue Sharing Money be spent to buy the Yazoo mower. There was considerable dis- cussion regarding this, and that led Mayor Horton to state that this matter might possibly come under his area of interest. • He had previously discussed "areas of interest" with each Commissioner being assigned to certain areas. Vice Mayor Minutes Highland Beach Town Commission • Workshop Meeting October 31, 1978 Page 4 of Mumford's would be Building and Zoning; Commissioner Bauer - Health and the Birthday celebration; Commissioner Storm - Personnel and Finance; Commissioner Genovese - Legal and Police, while Mayor Horton would do Executive Committee work plus Public Service. This matter regarding the mower would fall into his category and he stated that he would look into this and have a recommendation next week. Commissioner Storm suggested that we decide just what equipment we would need and then request that bids be submitted to us. 78..73 Correspondence Mrs. Roberts stated the reports that had been received from U.S.G.S. had been put on the Clipboard and been given to John Roberts and Jesse Arney. She also reminded U.S.G.S. that the present Cooperative Agreement that we have with them expired on September 30, 1978. This will be offered for renewal retro- • active to October 1, 1978, by the U.S.G.S. shortly. Mrs. Roberts then reported that we had received a letter from the Insurance Adjusters - Gay and Taylor - regarding the damage to the Police car. Inasmuch as the damage was only $50...00, it was the consensus to drop the matter. The next letter was from the Department of Natural Resources regarding the F.I.N.D. piece of land that is enclosed within the Hoffmann R.P.U.D. limits. The next piece of correspondence was from Municipal Code Corpor- ation giving us a cost estimate for enclosing our Zoning Ordin- ance in booklet form. The cost for 100 copies would be $450.00 or $4.50 for each booklet. This was discussed and will be formalized at the Regular Meeting t°iext week. A telegram received from Hyden Insurance Company covered the liability insurance for the Police Department, which expires November 1, 1978. It has been recommended that the Town go for the higher deductible of $2,500. The Town can be covered by a binder through a telephone call this afternoon. Town Manager - Reports Mrs. Roberts informed the Commission that Dr. Boss has been complaining about the erosion in front of his property for some • three years. Mrs. Roberts has informed Dr. Boss that this is his own problem because, through a poll taken several years ago, I Minutes Highland Beach Town Commission Workshop Meeting October 31, 1978 ~ j ' t { ~i Page 5 of 6 the people along the beach did not want Federal funds because they did not want beach access every 1300 feet. Mrs. Roberts received a notice of a Public Hearing by the Board of Adjustment from the City of Boca Raton concerning a variance for 142 feet depth on property located one block away from our Water Plant. This is no problem for Highland Beach. The Town Commission opined. Mrs. Roberts reported that there had been a temporarily leak in the water line on Bel Air Drive that had been fixed by Foster Olmstead. It is necessary that a water meter be in- stalled near this water line, which is in very bad condition, and Mrs. Roberts is requesting Commission approval to have this water line replaced at the same time the meter is being installed. Mrs. Roberts further reported that Mr. Lyle Gibson paid in full all of his delinquent sewage treatment plant monthly charges. The Town Commission concurred that the law suit against him be dismissed. Col. Fran Johnson's wife's death this past week was mentioned. Carl Howard called Mrs. Roberts over the weekend stating there was an emergency at Lift Station No. 1. Mrs. Roberts feels that a monitoring system should be discussed more fully. Boca Hi has requested that the Planning Commission hold Work- shop Meetings on the Braemer Isle Building. This will be done at their meeting next Wednesday night. Two Town Residents spoke re: the possibility of developing a fund for purchasing emergency medical equipment with monies that taxpayers could divert to the Town because of a recent State Supreme Court decision that Counties cannot levy taxes in Municipalities for service not directly benefitting them and the police committee.
