Mayor Horton called the Workshop Meeting to order at 9:45 A.M. In attendance were: Mayor Horton, Vice Mayor Mumford, Commissioners Bauer, Genovese and Storm. Also in attendance were Elaine W. Roberts, Town Manager, Town Attorney, Thomas E. Sliney, Police Chief Kenneth Jones and Jane E. Barker, Town Clerk. A Town resident addressed the Commission regarding the Ross, Saarinen, Bolton & Wilder proposal. 78.74 Carl Howard - regarding the Sewer System Monitoring Mr. Howard addressed the Commission informing them that the Town needed to do something about a reliable alarm system • for the Sewer System. He offered several alternatives, one being a system which he designed for Delray Beach, another being a battery-operated device, in addition to monitoring devices which can be purchased. After discussion, it was decided that Mr. Howard, Mr. Levine, a resident in Town, Edwards Electric and Mrs. Roberts would meet regarding this matter, to discuss a suitable system which could be presented to the Town Commission. 78.75 Braemer Isle - Boca Hi RPUD Mayor Horton read a letter from Mr. Boscove, Chairman of the Planning Commission, to the Town Commission, dated November 14, 1978, regarding plans for Braemer Isle - Boca Hi RPUD. Mrs. Roberts stated that two analyses has been presented to Boca Hi - dated November 21 and November 27, 1978 which showed prior approvals plus proposed changes. Mr. Thomas Delaney, Mr. Richard Rodgers of Boca Hi and Mr. William Hanser of Schwab & Twitty, Architects, presented the site plan and the changes in the RPUD to the Commission. Mr. Hanser ex- plained-the plan in detail. • ~~, c~ <..~ Minutes Highland Beach Town Commission • Workshop Meeting November 28, 1978 Page 2 of 5 Much discussion took place among the Commissioners, the repre- sentatives from Boca Hi, their architect and Town Attorney. Mentioned also by Mrs. Roberts was the fact that the Fire Marshall would be contacted in regard to this matter. It was the consensus of the Town Attorney that the procedure would be to amend the RPUD Ordinance with another Ordinance with the new plans attached. Mayor Horton requested the Town Attorney to have something drawn up for the Regular Meeting to be held on December 5, 1978. 78.76 Maintenance Man Job Description - Regrade Mrs. Roberts announced that she had given the Commissioners copies of the job description and the job rating sheet concerning the maintenance man. She stated that inasmuch as Michael has been doing a lot of work with the water meters, doing much of the work which would normally call for a plumber, ordering parts for the meters, handling the gasoline for the police cars and Town ve- • hicles, she felt that his job should be upgraded. Commissioner Bauer mentioned a morale problem with the police officers and Chief Jones stated that he had only heard about it this morning. This being a Workshop Meeting, no action would be taken today re the above job description. 78.77 Resolutions (a) Resolution No. 336 - Rescinding Resolution No. 291, which established a Police Committee. (b) Resolution No. 367 - Appointing Francis Hamzik as Building Official of the Town. These two Resolutions will be read in full at the Regular Meeting to be held on Tuesday, December 5, 1978, with possible adoption at that time. 78.78 Water Connection Fees Mayor Horton announced that the Commission had received a memo • from the Town Manager dated November 14, in regard to the Parker Construction connection fees. Upon receipt of this, Mayor Horton Minutes Highland Beach Town Commission • Workshop Meeting November 28, 1978 Page 3 of 5 responded with a memo on November 15. Mayor Norton's summation of this matter is that any one who has paid sewer or water con- nection fees in advance is entitled to that particular number of connections no matter what happens to the cost of those fees. On the other side, he said, if some one ..had paid his water or sewer connection fees and then decided not to build - or to build after the zoning had been changed - the loss of any fees previously paid would be his loss and would not be refundable. This seemed to be the consensus of the Commission. 78.79 Proposed Ordinance to Amend Sewer Franchise Mayor Horton read the discussion draft of the amendment to the Town of Highland Beach Sewer Franchise Agreement presented by the Town Attorney. It was decided that this amendment would be further discussed after the Workshop Meeting in an effort to come up with some definite figures. 78.47 Urbanek Law Suit • Mayor Horton stated that he had received a telephone call this morning from Mr. Urbanek stating that they were trying to work out some plans that would conform with Ordinance 336 all the way. Mr. Urbanek hoped to have the plans in Town Hall by Thursday of this week. There was considerable discussion concerning fees that Mr. Urbanek had paid - whether they could be transferred to his property across the road. It was the consensus to wait until Mr. Urbanek turned in his plans for further discussion on this matter. Town Manager - Reports Mrs. Roberts reported that at the Palm Beach County Municipal League Executive Board Meeting last Friday, it was decided that the Municipal League should take a stand on either supporting or not supporting the County Land Use Element. Mrs. Roberts re- quested the Commission's wishes as to how she should vote on this matter, which she thinks will be on the agenda for the metting in Pahokee on December 8th. • Mrs. Roberts then announced that the Palm Beach County Legislative Delegation makes appointments to the three Boards that the Munic- ipal League is involved in; namely, the Area Planning Board, the I Minutes Highland Beach Town Commission • Workshop Meeting November 28, 1978 Page 4 of 5 Solid Waste Authority, and the Treasure Coast Regional Planning Council. Mrs. Roberts named the ones who are now on the Area Planning Board that the united Executive Board decided to promote. On the Solid Waste Authority, the Executive Board is supporting the present member for reappointment. On the Treasure Coast Regional Planning Council there are two alternative appointments and one regular member open and Mrs. Roberts asked if any member of the Town Commission would be interested in serving on this Council. Mrs. Roberts then announced that the Board of Adjustment is holding a Public Hearing on Monday, December 4 regarding the DeJoseph matter. A letter of resignation has been received from Patrolman Blonder, Mrs. Roberts said. This position vacancy is being advertised in the newspaper. Commissioner Bauer suggested that a letter of commendation be written to Officer Blonder when he terminates his employment with the Town. Mayor Horton read Officer Blonder's • letter of resignation for the record. Mrs. Roberts then stated that Shoreland-Norrine has been sold to people from Canada - the Townhouse closing was held last Friday. Mrs. Roberts then stated that bids had been received for a new police car. The Chief has recommended that a car be purchased from Miller Dodge of Delray in the amount of $4,685.00 and ordering it now, as it takes several weeks to get the car. Mrs. Roberts then reported that the State Supreme Court has over- turned the law protecting environmentally sensitive land. She understands that Governor Askew is going to call a special session to get this reinstated. Mrs. Roberts is seeking a copy of the decision on this from our Town Attorney. The Town Manager then said that she was going to be attending a Grants Seminar on Thursday, November 30, 1978 in Ft. Lauderdale.
