Regular Meeting
February 1, 1977 1:30 P.M.
Mayor Gilday called the Regular Meeting to order at 1:30 P.M.
Present were:

Mayor Gilday called for a Motion to dispense with the
reading of the Minutes.

REPORTS OF THE TOWN COMMISSION
• (a) Mayor Morton E. Gilday - Mayor Gilday stated that there
has been a motion made on behalf of the Town to dismiss
a hearing brought by the Highland Beach Ambassadors
Corp. against the Town.

Mayor Gilday noted that there were two vacancies: one
on the Housing Board of Adjustment and Appeals (Regular
Member) and the second on the Board of Adjustment
(Alternate Member).
The Mayor proposed the name of Frank Carberry to fill the
alternate member vacancy on the Board of Adjustment.
MOTION by Mayor Gilday/Vice Mayor Hults: I move the appointment to
the Board of Adjustment, the name of Frank Carberry".
There were no other names offered.
ROLL CALL on the Motion Carried Unanimously.
The Mayor proposed the name of Walter Butler to fill the
regular member vacancy on the Housing Board of Adjustment
and Appeals.
• MOTION by Mayor Gilday/Commissioner Clark: "I move the name of
Walter Butler to fill this vacancy".

(b) Vice Mayor William S. Hults - No report.
(c) Commissioner Ruth E. Mumford - No report.

REPORTS OF VARIOUS AGENCIES OF THE TOWN
(a) Planning Commission - This Commission will hold a
continuation of the Public Hearing on February 2, 1977.
(b) Board of Adjustment - No report.
(c) Housing Board of Adjustment and Appeals - No report.
(d) Community Appearance Board - No report but discussion
developed relative to the criteria and ordinance and
workshop to be held in conjunction with the Town
Commission and the Community Appearance Board.
• (e) Police Committee - Mr. Horton gave the report for the
Police Department for the month of January, 1977. He
reported that the Police Committee had decided to hold
a hearing on Monday, February 14, 1977 at 7:30 P.M.,
to clear up the conflicting testimony by two officers.

The Town Attorney questioned Mr. Horton relative to
the Police Bill of Rights.
ORDINANCES (Proposed)
An Ordinance Amending Section 4.20 of the Code of
Ordinances (Regulation as to time for sale of
alcoholic beverages) was read in its entirety by
the Town Clerk.
Commissioner Clark suggested the wording "No
person may sell any, etc. after 2:00 A.M." - he
stated the phrase "the latest" seemed clumsy.
The Town Attorney agreed.
Ordinance No. 308 extending Ordinance No. 303 -
Building Moratorium was read in its entirety by
the Town Attorney.
• The Town Attorney noted that this Ordinance will
amend Ordinances 303 and 307. The sixty day
period will now start effective this date and run
to April 2, 1977. This Ordinance shall be treated
as an emergency and requirements of the Charter
were followed.
MOTION by Vice Mayor Hults/Commissioner Joy: "I move the adoption
of this Ordinance as read by Mr. Sliney".

REPORTS AND/OR RECOMMENDATIONS - TOWN MANAGER, ELAINE W. ROBERTS
Mrs. Roberts stated that the Palm Beach County Municipal
League held the January meeting in Atlantis. The next
meeting is scheduled for February 11th.
The next Treasure Coast Regional Planning Council meeting
will be held on February 10th in Stuart at 10:00 A.M.
The Florida League of Cities has a suggested amendment
• to the FCC Cable TV rules.

Mrs. Roberts referred to a meeting to be held relative
to water supply in Palm Beach County to be held on February
3 at 9:00 A.M. in the County Commission Chambers. Mrs.
Roberts will attend this meeting. The County Planning and
Zoning and Building Department has requested a meeting with
all of the Municipalities in Palm Beach County to discuss
the land use plan adopted by the County in December, 1972.
The Post Office Clerk notified the Town Manager that the
gross .receipts for 1976, excluding Money Orders, was
$80,000. - in 1975 it was $51,500, a 56% increase.
Mrs. Roberts stated that the Palm Beach Coumty Municipal
League has taken no official stand on the "Financial
Disclosure".
The Florida League of Cities replied with a letter from
Ray Sittig.
• BUILDING DEPARTMENT
Mrs. Roberts noted that the. Report from this Department
for the month of January had been submitted in detail.
She noted that the Building Official and Plumbing
Inspector will be attending the Building Official
Conference from February 27 to March 2, 1977.
FINANCE DEPARTMENT
Mrs. Roberts stated that a budget amendment will not be
necessary to pay the auditor's bill due to the fact that
the figure was included in a line item entitled
Professional Service. The Commission had received a
quarterly financial statement. Tax monies had been
received during the month of January in the amount of
$16,197. and this brings the total out of $320,600.
budgeted to almost $200,220. The Road and Bridge Fund
money received was approximately $16,000.
HEALTH DEPARTMENT
• Water quality in the Town is being investigated.

POLICE DEPARTMENT

All of the members of the Department are to take a six
hour course (2 three hour sessions) given by a fireman
from Boca Raton and sponsored by the Heart Fund.
Cardiopulmonary resuscitation is the name of the course.
TOWN CLERK'S DEPARTMENT
Mrs. Roberts noted that the Town Clerk has been working
on the revision of the employment application, the
preliminary work on the tangible property tax and the
exempt property report, investigated EDA grant for
another Florida Municipality, etc.
PUBLIC UTILITIES AND WORKS
Work has started on the water services entensions to
vacant properties in Bel'Lido.
• Mrs. Roberts stated that she is doing extensive research
on the water plant expansion. She noted that water
consumption was up during the month of January. Commissioner
Mumford asked that the bulletin carry a request to
residents to cut down on the usage of water.
Mrs. Roberts reported that a public hearing will be held
in Boca Raton on Monday, February 28 at 7:00 P.M. regarding
the Palmetto Park bridge over the Intracoastal.
She stated that an investigation and research will be
conducted on the height of seawalls in Town. This will be
done by the Building Official and report will be forthcoming.
UNFINISHED BUSINESS
Vice Mayor Hults questioned the Town's liability if one
of the Policemen should not properly administer to an
ailing person. The Town Attorney spoke to this matter.
Vice Mayor Hults commented on the engineer's report on the
• expansion of water treatment plant.

treatment plant, the consulting engineers, filters, etc.
BILLS FOR APPROVAL
The Finance Director presented the bills for approval.
MOTION by Vice Mayor Hults/Commissioner Mumford: "I move we pay
these two bills".
ROLL CALL on the Motion Carried Unanimously.
Being no further business to come before the Commission the meeting
