Present were: Mayor Morton E. Gilday Vice Mayor William S. Hults Commissioner Ruth E. Mumford Commissioner Leslie W. Joy Commissioner Robert D. Clark Also present: Elaine W. Roberts, Town Manager Thomas E. Sliney, Town Attorney Kathryn M. Borgemenke, Town Clerk • Kenneth Jones, Chief of Police PLEDGE OF ALLEGIANCE Approval of Minutes, as written For: Meetings of February 1, 1977 - Regular Meeting 22, 1977 - Workshop Meeting and Special Meeting Mayor Gilday called for a Motion to dispense with the reading of the Minutes. MOTION by Vice Mayor Hults/Commissioner Joy: "I so move". ROLL CALL on the Motion Carried Unanimously. PUBLIC REQUESTS None REPORTS OF THE TOWN COMMISSION • (a) Mayor Morton E. Gilday - Mayor Gilday made the statement that the rumor circulating around the Town relative to the Sheriff taking over the Police Department was not Minutes Highland Beach • Town Commission Regular Meeting March 1, 1977 Page 2 of 8 factual. He noted that the Town Manager was performing an annual review of the entire police function as recommended by the Standards and Goals for Florida's Criminal Justice System. The report will be discussed publicly after completion. (b) Vice Mayor William S. Hults - None (c) Commissioner Ruth E. Mumford - None (d) Commissioner Leslie W. Joy - None (e) Commissioner Robert D. Clark - None VARIOUS AGENCIES OF THE TOWN (a) Planning Commission - No Report -.The Planning Commission has meetings scheduled for March 2 and 9, 1977 at 7:30 P.M. (b) Board of Adjustment - No Report • (c) Housing Board of Adjustment and Appeals - No Report - Next meeting March 9, 1977 at 10:15 A.M. (d) Community Appearance Board - No Report - A meeting date for a Workshop with the Town Commission will be established later in this meeting. (e) Police Committee - No Report - The monthly report had been distributed to the Town Commission. RESOLUTION (Proposed) Resolution No. 323 - Requesting the Department of Transportation to authorize and direct the prohibition of parking along State Road AIA through the Town was read in its entirety by the Town Clerk. MOTION by Vice Mayor Hults/Commissioner Clark: "I move the Resolution as read" After discussion about the view of the ocean it was the consensus of the Commission that these words be stricken from the Resolution. It was brought out that this would be compulsory on both sides of AIA. • ROLL CALL on the Motion Carried Unanimously. Minutes Highland Beach Town Commission • Regular Meeting March 1, 1977 ORDINANCES (Proposed) Page 3 of 8 (a) An Ordinance Amending Chapter 21 of the Code of Ordinances, entitled "Seawalls, Bulkheads, Retaining Walls" was read by title only by the Town Clerk. (b) An Ordinance Amending Ordinance No. 299 - Budget Fiscal Year 1976-77 and (c) An Ordinance Amending Chapter 23 of the Code of Ordinances, entitled "Signs and Advertising". Mrs. Roberts asked the Town Commission that they table these two Ordinances for the time being. The Commission was in accord. Ordinance - Second and Final Reading and Public Hearing Ordinance No. 309 - Amending Section 4.20 of the Code of • Ordinances (Regulation as to time for sale of alcoholic beverages). This Ordinance was read in full by the Town Clerk. Mayor Gilday explained the reason and intent of this Ordinance. There was no discussion when called for. MOTION by Vice Mayor Hults/Commissioner Joy: "I move the adoption of this Ordinance as read". ROLL CALL on the Motion Carried Unanimously. The effective date of this Ordinance is March 1, 1977. PROCLAMATION MARCH - American National Red Cross Month This Proclamation was read in its entirety by the Town Clerk. Mayor Gilday called for a Motion for the issuance, by him, of the Proclamation. • MOTION by Commissioner Mumford/Commissioner Clark: "I so move". ROLL CALL on the Motion Carried Unanimously. Minutes Highland Beach Town Commission • Regular Meeting March 1, 1977 Page 4 of 8 POLICY DECISION - Pay for Police Officers called to appear in Court on day off. Mrs. Roberts noted that if the County pays $5.00 for the Officers' appearance and the Town matches it (with $15.00), the County will not pay their share. The Town either pays the $20.00 or just allows the Officers to receive the $5.00. After discussion among the Mayor, Town Attorney and Town Manager, it was decided that this policy decision be tabled. Chief Jones did bring out the fact that the Officers were paid mileage for their appearance, by the County. BID - Police Car A packet of three reports from the Police Chief was submitted to the Town Commission from the Town Manager. • MOTION by Vice Mayor Hults/Commissioner Mumford: "I move that we buy the new car from Hauser Dodge for $3,400.00". ROLL CALL on the Motion Carried Unanimously. REQUEST - James Schubert - Helicopter Landing Pad within Town Limits. Mr. Schubert gave a concise request for the benefit of the Commission. Mayor Gilday suggested that Mr. Schubert meet with the Town Attorney, if the Commission wished to grant this permission. This item was tabled for the time being. APPOINTMENT of Alternate Member to 208 Agency, Waste Water Management. Mayor Gilday asked the Town Manager if any names had been submitted for this appointment. She explained that if the Commission wished her to serve for a month of two she would be willing to do so. The Mayor agreed and this item will be published in the monthly bulletin. (Mrs. Roberts will be interim Alternate.) • Minutes Highland Beach Town Commission • Regular Meeting March 1, 1977 Page 5 of g REPORTS AND/OR RECOMMENDATIONS - TOWN MANAGER - MRS. ELAINE W. ROBERTS The next Palm Beach County Municipal League meeting will be held on Friday, March 11, 1977 at Boynton Beach. The last meeting was held in West Palm Beach and the subject of population update was discussed. Mrs. Roberts spoke to a representative of the Bureau of the Census and informed her that Highland Beach had been omitted. She requested a free census. There will be a report forthcoming on this matter. The Planning Congress met in West Palm Beach on the evening of February 14th. Mrs. Roberts was unable to attend the last meeting of the Treasure Coast Regional Planning Council, the next meeting will be held on March 10, 1977 in Stuart. The Civic League had its annual meeting on February 16th and both the Mayor and Town Manager were asked to speak. • Mrs. Roberts noted that she, Commissioner Clark and the Town Clerk met to discuss Charter changes that will be submitted to the Commission for a Workshop Meeting. Mrs. Roberts told the Commission that she had been invited as a guest speaker at Boca Raton High School for Career Day. The Town Manager has asked for a Post Office increase. She reported that the "Stop Signs" had been erected by St. Lucy's Church. The Town Manager then reported for the Departments: BUILDING DEPARTMENT. REPORT No building permits during the Miscellaneous permits totaling was in the amount of $350.00. and the Plumbing Inspector are Officials' Conference in Dayto: March 2, 1977. month of February. $16,000. The audit reports were submitted to the Auditor General and the State Comptroller and confirmation has been received. There is approximately $60,000 in tax monies outstanding. About $266,000 has been received. $3,000 has been received from the Homestead Trust Fund. HEALTH DEPARTMENT There have been more tress discovered having 3.ethal"yellow and letters have been sent to those property owners. POLICE DEPARTMENT Four Officers have completed the CTR course. (Including the • Chief) Officer Giordano is on sick leave. The Mayor called on the Chief of Police for an explanation of this sick leave. The Chief replied with a concise report. Mrs. Muriel Krieger called to commend the Highland Beach Police Department on their action when she summoned them. TOWN OLERK DEPARTMENT The Town Clerk attended a meeting relative to Federal Flood Insurance in Pinellas County February 17 and 18, 1977. She has been preparing for the Municipal Election, updated the Official Zoning Maps of the Town and has been in contact with the Ethics Commission, State of Florida, relative to the Financial Disclosure Forms. PUBLIC WORKS AND UTILITIES Mrs. Roberts attended a meeting sponsored by the County Commission. The subject was water quality in Palm Beach County. The resurfacing of streets in Bel Lido has been completed; after • the cuts and extensions of the water lines were finished. The water extensions work was done by the Town's employees. Minutes Highland Beach Town Commission ~' • Regular Meeting March 1, 1977 Page 7 of 8 Mrs. Roberts is continuing the work on the sewer facilities maintenance and the person she is considering for this job will submit his final proposal next week; at this time she will report her findings to the Commission. She has been in contact with the consulting engineers and has informed them that she will get in touch with the Permutit representative. She also will contact Southland Instruments to recalibrate the meters. The February water consumption is down from January about a little over a million gallons. Mrs. Roberts referred to a letter distributed to the Commission from the Technical Coordinating Committee. She read the letter for the record. She suggested that the Commission appoint Mr. Smoot as a regular member of this committee; and herself and Mr. Schott as alternate members of the committee. An item will be published in the next • bulletin requesting names for this committee, at the suggestion of the Town Commission. UNFINISHED BUSINESS Mrs. Roberts informed the Commission that Mr. Don Rex, Chairman of the Community Appearance Board will be available to meet with the Commission at a Workshop; and it was decided to set the meeting on Monday, March 7, 1977 at 9:30 A.M. Mrs. Roberts referred to an Attorney General's opinion relative to the collection of license fees within Municipalities. A report from the Town Attorney was presented to the Commission. Discussion on this matter followed. Mayor Gilday recognized Mr. Dent who requested, for the Civic League, a copy of any Charter changes.
