Minutes of Meeting of Town Commission

Workshop Meeting

Mayor Gilday called the meeting to order at 9:30 A.M.

Mayor Gilday announced that this meeting had been called for
the purpose of listening to the members of the Community
Appearance Board and to discuss the Procedures and Criteria
of this Board.
Mayor Gilday called on the Chairman, Mr. Rex, and he
referred. to the changes proposed by Commissioner Clark to
both the Ordinance and the Criteria.
Commissioner Clark noted that the interest in the Criteria
was due to the fact that the action passed made the Criteria
part of the Ordinance. He felt that if the Criteria were
not part of the Ordinance it would not affect the Town
Commission.
Discussion followed relative to Chapter 2, Section 2-52(b).
Commissioner Clark suggested the removal of the words
"excluding single family dwellings".

Commissioner Clark called for a consensus on this subject.
Commissioner Joy stated that there should be no interference
with private homeowners and he noted that the condominiums
were more of a commercial venture.

The Mayor noted that Commissioner Joy was agreeing with
Mr. Rex's position. Vice Mayor Hults, Commissioner
Mumford and the Mayor agreed against any interference with
the private homeowners.
Commissioner Clark referred to Section 2-52 (b) and
suggested changes. The Building Official also spoke
to this subject, as well as Mr. Rex. Discussion among
all evolved around the subject of an affidavit and the
specific word "materially". Mr. Schott suggested that
in the changq, should there be any changes in the
landscape plan, prior to that change the applicant
would have to appear before the CAB for approval. This
would depend upon the degree of change to be made.
Commissioner Clark asked that "in its final form" be
omitted.
• Commissioner Clark noted that he would give Mrs. Roberts
his revised copy when completed. Commissioner Clark
stated that these were the changes suggested for the
Ordinance.
Commissioner Clark asked the questions: "Do we really
want all of this to come to this .Community P,ppearane Board
Criteria? Do we (Town Commission) want to be a party to
the Criteria? Should the Criteria be part of the Ordinance?"
Discussion relative to this followed.
The Mayor noted that the Criteria would be adopted rules of
the Community Appearance Board. It was suggested that the
Criteria be removed from the Ordinance.
Discussion followed relative to "Plans". Mr. Rex explained
to concern of the Community Appearance Board in regard to
the plans.
Mr. Rex recommended that the Criteria should not only be
accepted by the Community Appearance Board but the Town
Commission as well. He noted that the approval of the Town
• Commission relative to the Criteria is most important to
the CAB.
Commissioner Clark asked if it would be satisfactory to the

CAB to make up whatever changes are necessary in the Criteria
and present that document to the Town Commission for their
approval or disapproval. The Commission would then vote
whether they approved or disapproved of the proposed changes.
Vice Mayor Hults noted that removing the Criteria from the
Code of Ordinances would make it much easier to change
the Criteria and not amend the Ordinance continually.
Mayor Gilday noted that any time the Commission wished to
change the Criteria that it would be done in consultation
with the CAB.
Mayor Gilday suggested that Mrs. Roberts, Mr. Rex, Mr.
Schott and the Town Attorney meet and discuss the problems
at hand, toward presentation to the CAB and the Town
Commission.
