Minutes of Meeting of Town Commission
Special Meeting
March 21, 1977 9.30 A.M.
Mayor Gilday called the Special Meeting to order at 9:40 A.M.
Present were:
Mayor Morton E. Gilday
Vice Mayor William S. Hults
Commissioner Leslie W. Joy
Commissioner Robert D. Clark
Absent: Commissioner Ruth E. Mumford
Also present:
Elaine W. Roberts, Town Manager
Thomas E. Sliney, Town Attorney
• Kenneth Jones, Police Chief
M. Maree Birkbeck, Acting Director of Finance
Kathryn M. Borgemenke, Town Clerk
Request to complete dredging (from Regency Highland
dated March 14, 1977) .
Mrs. Roberts noted that this work had not been completed
and the formal request for completion would be presented
at this time. Mr. Van Soosten and Mr. Earle (representing
Aztec Development Corporation) answered all questions
relative to this project.
MOTION by Commissioner Clark/Vice Mayor Hults: "I'll move that
the permit be approved and permission granted to complete the
dredging".
Discussion followed relative to a license, working hours,
maintenance of the dredge, etc.
ROLL CALL on the Motion Carried 4 - 0.

Approval of Edwards Electric bill and others

Miss Birkbeck presented the bills for approval.
Discussion followed relative to the Edwards Electric
bill in the amount of $2,592.00.
MOTION by Vice Mayor Hults/Commissioner Joy: "I move that we
pay these bills and include a reply from council not obligating
ourselves to a certain amount".
ROLL CALL on the Motion Carried 4 - 0.
Resolution No. 324 reaffirming Resolution No. 263
approving Countywide Coastal Preservation and Beach
Restoration program and req'uestin that the Town be
included in the County Study.
Resolution No. 324 was read in its entirety by the
Town Clerk.
• MOTION by Commissioner Clark/Commissioner Joy: "I'll move the
approval of the Resolution as read".
ROLL CALL on the Motion Carried 4 - 0.
Discussion about serious beach and dune erosion.
Mrs. Roberts presented to the Town Commission snapshots of
the erosion in the Town. Discussion followed regarding
relief to the citizens and various alternatives. In
order for the Town of Highland Beach to be a part of a
beach restoration project, the Town would have had to
have a study going on for at least two or three years;
plus the Town would have to provide public beach access
every quarter of a mile.
Mrs. Roberts stated that she will be notifying these
people of the help which they may obtain, at their own
expense. Discussion then followed relative to the
replenishment.

Notification from State Department of Environmental
Regulation application from August Urbanek to dred e,
fill and construct on Town Lots 93 and 94 west.
Mrs. Roberts read the complete notification for the record,
in accordance with Chapter 253, Florida State Statutes.
Mrs. Roberts reported on a letter from Mr. Goldberger,
Regency Highland, complaining about the litter from the
Intracoastal along property both north and south of the
Regency. Discussion followed relative to Chapter 15,
Code of Ordinances. Mrs. Roberts suggested that she
write to Mr. Steinhart and inform him of the condition
of the property. Mr. Sliney noted that unless this
condition constituted a menace, the Town should not
become involved.
Mrs. Roberts brought to the attention of the Commission
• that she had written about the condition of the dune
to both Mr. Mangurian and Mr. Urbanek. Mr. Mangurian
requested a more definite response. She requested
direction from the Commission. Mr. Sliney stated that
some agency that is in the area of this subject would
have to make some determination as to what the
possibilities are in that situation. Vice Mayor Hults
suggested that an Ordinance be proposed to halt this
condition before it should happen again. Discussion
relative to an ordinance followed.
Commissioner Clark brought to the attention of the
Commission an ar icle hat appeared in a recent issue of
the Delray News/~~i.ic~alstated the Palm Beach County
Municipal League criticized Property Appraiser David
Reid for his refusal to raise assessments. Commissioner
Clark wished to go on record by taking strong exception
to the League's stand and by stating that he was sure
he spoke for 95/ of the Townspeople in opposing the
increase of assessments on real property. He noted that
Mr. Ron Sanson, Delray Councilman, made derogatory remarks
at the retired people. He noted that retired people have
one vote each; just the same as anyone else and if they
• run the government, it is because they have the wit, time,
energy and the number of votes required. He asked that
these sentiments be voiced at the next Palm Beach County
Municipal League meeting. Discussion followed relative
to increasing taxes.

Commissioner Clark asked about the status of the
Cooperative Dispatch Center. Mrs. Roberts gave her
report on this matter and stated that the three City
Managers of the largest cities will meet with the
Town Commission to explain the situation. The Town
Commission was in agreement with this meeting.
Vice Mayor Hults referred to a letter from Farish and
Farish in reference to the extension of their RPUD.
He noted that the extension was to May 3, 1977 and
that being the date of the Municipal Election no
meeting will be held. He noted that this item should
be scheduled for the Regular Meeting to be held on
April 5, 1977. Vice Mayor Hults stated that he would
have information regarding the Town garage and handyman
to report at the Workshop Meeting March 29, 1977.
Bing no further business to come before the Comfriission, the
meeting ADJOURNED at 10:45 A.M.
