Present were: Mayor Morton E. Gilday Vice Mayor William S. Hults Commissioner Ruth E. Mumford Commissioner Leslie W. Joy Commissioner Robert D. Clark Also present: Elaine W. Roberts, Town Manager Thomas E. Sliney, Town Attorney Kenneth Jones, Police Chief M. Maree Birkbeck, Acting Finance Director Kathryn M. Borgemenke, Town Clerk • PLEDGE OF ALLEGIANCE Approval of Minutes, as written For meetings of March 1, 7, 11, 21 and 29, 1977. MOTION by Vice Mayor Hults/Commissioner Joy: "Mayor, I move that we dispose of the reading of the Minutes, synopsis by the Town Clerk, for the meetings of March 1, 7, 11, 21 and 29th". ROLL CALL on the Motion Carried Unanimously. PUBLIC REQUESTS Mr. Kendall Slinkman, Attorney, re: Hoffmann R.P.U.D. requested a reasonable extension in the discretion of the Commission of the pending R.P.U.D. He noted that through the Town Manager a letter from the Department of Environmental Regulation was furnished each Commissioner. Mr. Slinkman explained that they are still lacking the • permit from the DER and the Corps of Army Engineers. After much discussion, questions and answers, the Minutes Highland Beach Town Commission • Regular Meeting April 5, 1977 Page 2 of 10 Commission agreed to extend the time of the present application from May 3, 1977 to September 3, 1977 (a period of 4 months). Mr. Slinkman was directed to appear before the Town Commission at the August meeting. MOTION by Vice Mayor Hults/Commissioner Clark: "I move that we extend this four months from May 3, 1977 to September 3, 1977". ROLL CALL on the Motion Carried Unanimously. Peter J. Nixon, Realtor, re: Wayne J. Young Property Mr. Nixon referred to a letter he had written the Town Commission requesting relief from the building moratorium. Discussion followed relative to the period of time of the moratorium, preparation of plans, etc. REPORTS - TOWN COMMISSION • (a) Mayor Morton E. Gilday - Mayor Gilday stated that the Town Manager had received some inquiries as to the possibility of permitting public recreation behind the Town Hall; i. e., tennis courts. Further research will be done on this item. Mayor Gilday had the Town Clerk read a press release relative to the Committee on the Administration of Justice in the South County. Mayor Gilday is a member of this committee and much research is being done, with a report to be completed by September of this year with various recommendations relative to the new Court system. (b) Vice Mayor Hults - No Report (c) Commissioner Mumford - Mayor Gilday welcomed the Commissioner back from her vacation. Mrs. Mumford noted how fortunate we in Florida were in comparison with the people out west regarding the water shortage. (d) Commissioner Leslie W. Joy - No Report (e) Commissioner Robert D. Clark - No Report • Minutes Highland Beach Town Commission • Regular Meeting April 5, 1977 REPORTS OF VARIOUS AGENCIES OF THE TOWN Page 3 of 10 (a) Planning Commission - The Town Manager reported that the next meeting of the Planning Commission will be held on Wednesday, April 13, 1977 at 7:30 P.M. This will be a public hearing. Mayor Gilday noted how diligently this Commission had been working and expressed his thanks to them. (b) Board of Adjustment - No Report (c) Housing Board of Adjustment - No Report (d) Community Appearance Board - Mayor Gilday announced that there was a vacancy of an alternate member on this Board with the term to expire September of 1977. Mr. Don Rex requested the Town Commission to appoint Mr. William Atkinson of Regency Highland to fill this vacancy. MOTION by Vice Mayor Hults/Commissioner Mumford: "I move the appointment of Mr. Atkinson". • ROLL CALL on the Motion Carried Unanimously. (e) Police Committee - In Mr. Horton's absence, Mrs. Roberts gave a brief report on the Hearing held on Monday, April 4, 1977. She noted that Patrolman Leonard Tremitiedi and two witnesses appeared and Patrolman Giordano did not appear. She went on to elaborate. A written report is to be forthcoming to the Town Commission from the Police Committee. RESOLUTION{S) (a) Establishment of Toll Free Telephone Service Before this Resolution was read the Mayor recognized Mr. William Burson, Division Manager, Southern Bell, who spoke in relation to the additional costs if toll free service is established. Mr. Burson answered questions directed to him from the Commission and the audience. MOTION by Vice Mayor Hults/Commissioner Joy: "T move that we table this item temporarily". • ROLL CALL on the Motion Carried Unanimously. Minutes Highland Beach Town Commission • Regular Meeting April 5, 1977 Page 4 of 10 Mayor Gilday took this time to notice that the Town of Highland Beach was indirectly honored by the election of the Town Clerk, as president of the Florida Association of City Clerks. RESOLUTION NO. 326 Opposing Purchase of Beach Front Property in Highland Beach was read in its entirety by the Town Clerk. MOTION by Vice Mayor Hults/Commissioner Clark: "I offer this Resolution to be passed". Mayor Gilday noted that a similar Resolution had been passed by the Town a few years ago when this question arose. ROLL CALL on the Motion Carried Unanimously. Mrs. Mumford questioned the Town's proposed Beach Restoration Program. Mrs. Roberts noted that the • request was for inclusion in the County study only, not to include the Town in the restoration program until after consideration by the Town Commission. ORDINANCE (S) (Proposed) Ordinance No. 310 Amending Chapter 21 of the Code of Ordinances entitled "Seawalls, Bulkheads, Retaining Walls" was read in full by the Town Clerk for the Second and Final Reading and Public Hearing as advertised in the Boca Raton News on March 21, 1977. Mayor Gilday called for a Motion to adopt the Ordinance as read. MOTION by Commissioner Clark/Commissioner Joy: "I'll move the adoption of the Ordinance as read". ROLL CALL on the Motion Carried Unanimously. (b) Ordinance No. 312 Amending Chapter 23 of the Code of Ordinances entitled "Signs and Advertising" was read in its entirety by the Tawn Clerk for the • First Reading. MOTION by Commissioner Clark/Commissioner Mumford: "I so move". ROLL CALL on the Motion Carried Unanimously. Appointment of Clerk and Inspectors - Election May 3, 1977. The Town Clerk read the names of the Clerk and Inspectors who were appointed to work the Election May 3, 1977. (See list attached) MOTION by Mayor Gilday/Commissioner Clark: "I move the approval of the names of these persons that have just been read for the positions to which they have been nominated". There were no further names to be offered at this time. • ROLL CALL on the Motion Carried Unanimously. Appointment of Acting Town Treasurer Mrs. Roberts noted that the Charter called for an appointment of a Town Treasurer. At the present time the Town does not have a Town Treasurer and she asked the Commission to appoint the Town Manager to this position for the interim period. MOTION by Mayor Gilday/Commissioner Clark: "I so move". Discussion followed relative to Finance Director, Town Treasurer, the Charter requirements (Mrs. Roberts read the Charter for the record). A question was raised relative to the former Finance Director and the Mayor and Mrs. Roberts answered the question. ROLL CALL on the Motion Carried Unanimously. Proposal of Sewage System Maintenance • Mrs. Roberts noted that this item had been discussed at the last Workshop Meeting. The proposal is from Mr. Minutes Highland Beach Town Commission • Regular Meeting April 5, 1977 Page 6 of 10 Carl Howard. The Town Attorney has drawn up a contract which will be shown to Mr. Howard in the very near future. Mrs. Roberts stated that she is .asking for acceptance of Mr. Howard's proposal only today. Vice Mayor Hults gave this proposal his recommendation. Mayor Gilday called for a Motion to approve this proposal from Carl Howard provided Mr. Howard executes the contract with the approval of the Town Attorney. Mrs. Roberts stated that she would not ask the Commission to approve the contract until they had a chance to study it. This proposal will be based on a period of 30 days and cancellable on a period of 30 days. The amount of the contract is $1,030.00. MOTION by Vice Mayor Hults/Commissioner Clark: "I move that we approve this on that basis". ROLL CALL on the Motion Carried Unanimously. REPORTS OF TOWN DEPARTMENTS AND/OR RECOMMENDATIONS - TOWN MANAGER, ELAINE W. ROBERTS Mrs. Roberts noted the City Managers' meeting and the Palm Beach County Municipal League meeting will be held on Friday, April 8, 1977 in West Palm Beach. Mrs. Roberts noted that the last meeting held in March was attended by the Town Clerk in her stead. The Planning Congress met on Monday, March 14, 1977. The Treasure Coast Regional Planning Council will meet Thursday, April 14, 1977 in Stuart at 9:00 A.M. Mrs. Roberts noted that she spoke at another Career Day at Coral Springs High School on Friday, April 1st. She reported on her latest request to the Post Office officials for an increase. r1 U Minutes Highland Beach Town Commission • Regular Meeting April 5, 1977 Page 7 of 10 The State Legislature started today in session for 60 days. The Town has received from the County Commission a Resolution which rescinds an earlier Resolution relative to the Director of the Department of Civil Defense. BUILDING DEPARTMENT During March income from licenses totaled approximately $1,400.00 and estimated cost of construction permits issued is in the amount of $146,000.00. Two C.O.'s were issued in March. FINANCE DEPARTMENT Mrs. Roberts stated that Charlotte Reece, who was • formerly employed by the Town, has returned and has been appointed Acting Deputy Finance Director, effective March 21, 1977. Mrs. Roberts took this time to express her confidence publicly in the two employees in the Finance Department. There is approximately $50,000.00 outstanding in tax money. Approximately $275,000.00 has been received to date. Mrs. Roberts stated that the Acting Finance Director attended a conference in Daytona Beach from March 27th through March 30th. The C.D.'s that expired during March have been reinvested - a total of $140,000 for 90 days at 5.75% to expire June 14th and June 20th. The insurance program for the Town is an on-going project with the Town Manager and the Acting Finance Director. Mr. Hyden, the agent, will appear before the Commission on April 26, 1977. The auditor went through the books during .the month of March due to the change of personnel and is satisfied with the operation of the department. A six month financial statement will be distributed before the 26th of this month; at which time budget amendments will be considered. • HEALTH DEPARTMENT Because of the article that appeared in the Bulletin Minutes Highland Beach Town Commission • Regular Meeting April 5, 1977 Page 8 ~of 10 re: sea grape trees for sale for $1.00 several requests have been received. Mrs. Roberts called to the attention of the Commission that a request had been received by the Town for permission to conduct a Walk-A-Thon through the Town on the beach for the benefit of the March of Dimes. Discussion developed on the area of the beach, the coral rock on the beach, the dangers involved, having a scout determine the safety, etc. Mrs. Roberts was directed to have someone investigate the route of the walk. POLICE DEPARTMENT Mrs. Roberts is still conducting her annual review of the Department. She reported that Patrolman Simon is quite ill. Patrolman Giordano has returned to work on March 21, 1977. Mrs. Roberts read a letter from Mr. Lewis thanking the Highland Beach Police Department for their assistance • in towing a boat. TOWN CLERK The Town Clerk attended the annual conference for Municipal Finance Officers and City Clerks along with the Acting Finance Director in Daytona Beach. The Town Clerk has been continuing the work on the election and the annual report for the Federal Flood Insurance Program was completed by her and the Building Official. PUBLIC UTILITIES AND WORKS The Town Garage area has been staked out and fill will be arriving very shortly. A Beach Erosion Workshop scheduled by the Board of County Commissioners will be held on Thursday, Apri 1 7, 1977 at 1:30 P.M. in West Palm Beach. The March water consumption is up: January the consumption was approximately 19 million, February 18 million and March approximately 25 million. Mrs. Roberts announced that this was normal for this time of year. • Mrs. Roberts noted that she is thinking of being more firm in the next issue of the Bulletin re: water conservation. Minutes Highland Beach • Town Commission Regular Meeting April 5, 1977 Page 9 of 10 Mr. Dodson, of Permutit, and Mrs. Roberts met last week. He met with Mr. Arney at the Water Plant and Mrs. Roberts received a call from Mr. Dodson saying he would be submitting his findings in writing in the near future. He will return in two weeks to do a more detailed inspection. Mrs. Roberts noted that the recommendations to date mean a great savings to the Town. She then read the status report from the consulting engineers. At a request of some property owners, new street signs have been ordered by the Town. These signs will be the tall green and white street signs and take the place of markers. The cost of the signs is approximately $175.00. UNFINISHED BUSINESS • None BILLS FOR APPROVAL The Acting Director of Finance presented the bills for approval to the Commission. Miss Birkbeck took this time to thank the Town Manager and Town Commission for letting her attend the Municipal Finance Directors' Conference in Daytona Beach. MOTION by Vice Mayor Hults/Commissioner Joy: "I move that we accept and pay these bills". ROLL CALL on the Motion Carried Unanimously. Discussion relative to the next monthly meeting followed. MOTION by Mayor Gilday/Commissioner Mumford: "The next meeting of the Town Commission will be held on Tuesday, May 3, 1977 at 8:00 P.M.
