Special conditions and circumstances exist which are peculiar to the land, structure or building involved, and which are not applicable to other lands, structures or buildings in the same district. 2. The special conditions and circumstances do not result from the action of the applicant. 3. Granting the variance requested will not confer on the applicant any special privilege that is denied by the ordinance to other lands, structures or buildings in the same district. 4. Literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of the ordinance, and would work unnecessary and undue hardship on the applicant. 5. The reasons set forth in the applicant's petition justify the granting of the variance, and the variance granted is the minimum reasonable variance that will make possible the reasonable use of land, structure or building. 6. Granting of the variance will be in harmony with the general purpose and intent of the ordinance, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Extensions of variance approvals shall not be granted by the Board of Adjustment and Appeals. For a variance to be favorably considered, The Board adjustment must find that the following four re1 m uire of have been met. (a) That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same district; The special circumstances affecting the Ferguson rear property at 4320 Tranquility Drive is that the neighbor to the south, Mr Jeffery Samuels, has a very the seawall. He previously removed �erear xisti Of ng old dockfty feet along property and reconstructed a replacement dock. This new dock is thirteen feet ten inches from the side yard joint property line. Mr Ferguson acknowledged this in a letter to the Town dated giving his approval for Mr Samuels' dock location. Mr Samuels'property is in a dead corner thus he has no access to his dock when parking his boat except from the north. The adjacent lot to his south has a seawal; .xtendmg due west from orner and when another their joint properties creating a dead c boat is docked at that home's dock, the access to Samuel's dock is further impeded. Mr Samuels can thus only dock at his Property by navigating from the nOrtf,`Partially Mr Ferguson's seawall. See attached sketch ofth se docks. In order to give relief to Mr Samuels, to access his dock with his boat, and to insure that Mr Ferguson's boat will not be damaged by locating it in a safer position further north away from Mr Samuels access maneuvering area, we are requesting approval of a ten foot setback from the side property lines for the Ferguson dock. This will enable I Lr Ferguson to dock his boat to the north side of his Property. In Order to aesthecay balance the dock behind the property the dock will be centere equally in this manner. The boat access and the power supplies for the dock will all be located at the north end of the dock where the boat will be kept. Application was made to the Florida Department of Environmental Protection for the dock as proposed and approval of was received July 14, 2010. (b) That the special conditions and circumstances do not result from the actions of the applicant; The special conditions result from the,irregular small seawall and the location of our neighbor's dock to the south creating boat maneuvering and safety problems for both neighbors. (c) That granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, buildings or structures in the same district. This same relief would be available tQ; others upon application. The requested variance will be mutually beneficial to both neighbors with no negative impact on anyone. (d) That the literal interpretation of the provisions of this ordinance would deprive the applicant of the rights commonly enjoyed by other properties in the same district under the terms of this ordinance and would work unnecessary and undue hardship on the applicant. The literal interpretation of the ordinance would deprive the applicant of a safe docking area for his boat due to crammed access that it would create for his neighbor's boat. This might very well result in damage to the applicant's boat in normal operating conditions and especially during storms and high winds. Your application has been reviewed to determine whether it qualifies for any of three kinds of authorization that may be necessary for wo:•ks in wetlands or waters of the United States. The kinds of authorization are(1)regulatory authorization,'(2)proprietary authorization(related to stag;-owned submerged:lands), and (3)federal authorization (State Programmatic Cenral Permit). Proprietary Review.—NOT REQUIRED The Department acts as staff to the Board of Trustees of the Internal Improvement Trust Fund(Board of Trustees) and issues certain authorizations for the use of sovereignty submerged lands. The Department has the authority to review your projects under Chapters 253 and 258,F.S.,18-21,F.A.C.,and Section 62-343.075,F.A.C. Your projects will not occur on sovereignty submerg-d land.
